<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xaf4b1abb-e883-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Credit Union Share Insurance Fund Parity Act.</p></sidenote>
<section id="d287147e88" identifier="/us/pl/113/252/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Credit Union Share Insurance Fund Parity Act</shortTitle>”.</content></section>
<section id="d287147e98" identifier="/us/pl/113/252/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>INSURANCE OF AMOUNTS HELD ON BEHALF OF OTHERS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xaf4b8fec-e883-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 207(k) of the Federal Credit Union Act (<ref href="/us/usc/t12/s1787/k">12 U.S.C. 1787(k)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yaf4b8fed-e883-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/252/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in paragraph (1)(A)—</chapeau><subparagraph class="fontsize10" id="yaf4b8fee-e883-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/252/s2/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="insert">inserting</amendingAction> after “<quotedText>payable to any member</quotedText>” the following: “<quotedText>, or to any person with funds lawfully held in a member account,</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="yaf4b8fef-e883-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/252/s2/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>and paragraphs (5) and (6)</quotedText>”;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yaf4b8ff0-e883-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/252/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in paragraph (2)(A), by <amendingAction type="delete">striking</amendingAction> “<quotedText>(as determined under paragraph (5))</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="yaf4b8ff1-e883-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/252/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraph (5) as paragraph (6); and</content></paragraph>
<paragraph class="fontsize10" id="yaf4b8ff2-e883-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/252/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>by <amendingAction type="insert">inserting</amendingAction> after paragraph (4) the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="yaf4bb703-e883-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Coverage for interest on lawyers trust accounts (iolta) and other similar escrow accounts</inline>.—</heading><subparagraph class="fontsize10" id="yaf4bb704-e883-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Pass-through insurance</inline>.—</heading><content>The Administration shall provide pass-through share insurance for the deposits or shares of any interest on lawyers trust account (IOLTA) or other similar escrow accounts.</content></subparagraph>
<subparagraph class="fontsize10" id="yaf4bb705-e883-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Treatment of ioltas</inline>.—</heading><clause class="fontsize10" id="yaf4bb706-e883-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">Treatment as escrow accounts</inline>.—</heading><content>For share insurance purposes, IOLTAs are treated as escrow accounts.</content></clause>
<clause class="fontsize10" id="yaf4bb707-e883-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Treatment as member accounts</inline>.—</heading><content>IOLTAs and other similar escrow accounts are considered member accounts for purposes of paragraph (1), if the attorney administering the IOLTA or the escrow agent administering the escrow account is a member of the insured credit union in which the funds are held.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yaf4bb708-e883-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>For purposes of this paragraph:</chapeau><clause class="fontsize10" id="yaf4bb709-e883-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">Interest on lawyers trust account</inline>.—</heading><content>The terms ‘interest on lawyers trust account’ and ‘IOLTA’ mean a system in which lawyers place certain client funds in interest-bearing or dividend-bearing accounts, <page identifier="/us/stat/128/2894">128 STAT. 2894</page>
with the interest or dividends then used to fund programs such as legal service organizations who provide services to clients in need.</content></clause>
<clause class="fontsize10" id="yaf4bb70a-e883-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Pass-through share insurance</inline>.—</heading><content>The term ‘<term>pass-through share insurance</term>’ means, with respect to IOLTAs and other similar escrow accounts, insurance coverage based on the interest of each person on whose behalf funds are held in such accounts by the attorney administering the IOLTA or the escrow agent administering a similar escrow account, in accordance with regulations issued by the Administration.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yaf4bb70b-e883-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Rule of construction</inline>.—</heading><content>No provision of this paragraph shall be construed as authorizing an insured credit union to accept the deposits of an IOLTA or similar escrow account in an amount greater than such credit union is authorized to accept under any other provision of Federal or State law.”</content></subparagraph>
