SUMMARY:  Pursuant to the Regulatory Flexibility Act, 5 U.S.C. 601-612, 
and Executive Order 12866 ``Regulatory Planning and Review,'' dated 
September 30, 1993, the National Endowment for the Humanities is 
required to publish in April and October of each year, an agenda of 
proposed regulations that the Endowment has issued or expects to issue 
and current rules that are under agency review.

4029.  NONDISCRIMINATION ON THE BASIS OF RACE, COLOR, NATIONAL 
ORIGIN, HANDICAP, AND AGE IN PROGRAMS AND ACTIVITIES RECEIVING FEDERAL 
FINANCIAL ASSISTANCE

Abstract: The National Endowment for the Humanities (NEH) proposes to 
make amendments to its regulations implementing Title VI of the Civil 
Rights Act of 1964 (title VI) and Section 504 of the Rehabilitation Act 
of 1972 (section 504). Together, these statutes prohibit discrimination 
on the basis of race, color, national origin, and disability in 
programs or activities that receive Federal financial assistance. In 
1988, the Civil Rights Restoration Act (CRRA) added definitions of 
``program or activity'' and ``program'' to title VI and added a 
definition of ``program or activity'' to section 504. The added 
definitions were designed to clarify the broad scope of coverage of 
recipients' programs or activities under these statutes. The 
promulgation of this proposed regulation explicitly incorporates the 
CRRA's definition of ``program or activity'' and ``program'' into the 
NEH's title VI and section 504 regulations. The NEH's proposed 
regulations will be published as part of a joint Department of Justice 
Notice of Proposed Rulemaking.
