PRICE SCHEDULE NO. 19¹

        Southern Pine Lumber

[As Revised by Amendment No. 2, Effective November 24, 1941.
See Note, p. 4]

  Southern pine lumber is widely used in the construction industry for exterior and interior finish, framing, millwork, sheathings, floorings, and subfloorings, and in the manufacture of motor vehicles, low-grade furniture, and household and farm appliances. In the defense program it has been extensively employed in the construction of cantonments, defense housing projects, and factories. The increased use of southern pine lumber stemming from the defense program and the accompanying expanded economic activity has caused demand to exceed supply. As a consequence, inflationary pressure has caused prices to rise greatly in excess of previously existing industry levels. Such price increases have markedly outstripped cost advances. Warnings to industry members to reduce prices to reasonable levels have failed to secure more than temporary price reductions. Those producers who have manifested a willingness to cooperate with the Government have been unable effectively to keep prices down because of the large number of operators who have consistently maintained high prices. Under these circumstances, voluntary cooperation with the request of the Office of Price Administration to maintain reasonable prices would subject those complying with the request to unjust discrimination.
  Accordingly, under the authority vested in me by Executive Order No. 8734,² it is hereby directed that:
       1.   Maximum prices for southern pine lumber.—On and after November 24,1941, regardless of the terms of any contract of sale or purchase, or other commitment, except as provided in section 8 hereof, no person shall sell, offer to sell, deliver, or transfer, for domestic or export use, any southern pine lumber, where the shipment originates at the mill rather than at a distribution yard, at prices higher than the maximum prices set forth in Appendix A, incorporated herein as section 9: Provided^ That in the case of retail sales as defined in section 7, where the shipment originates at a mill rather than at a distribution yard, a

      mark-up of not more than $3.50 per 1,000 feet board measure may be added to the maximum prices set forth in Appendix A.
       2.   Less than maximum prices.—Lower prices than those set forth in Appendix A may be charged, demanded, paid, or offered.
       3.   Erosion.—The price limitations set forth in this Schedule shall not be evaded whether by direct or indirect methods in connection with a purchase, sale, delivery or transfer of southern pine lumber, alone or in conjunction with any other material; or by way of any commission, service, transportation, or other charge, or discount, premium, or other privilege ; or by tying-agreement, or other trade understanding : or by making terms or conditions of sale more onerous than those in effect or available to the purchaser on September 5, 1941; or by unnecessarily routing lumber through a distribution yard; or by unreasonably refusing to ship except in mixed cars or trucks, or in specified lengths, or under other circumstances entitling the seller to a premium ; or by charges for delivery which exceed the actual cost to the seller of such delivery; or by falsely or wrongly grading or invoicing lumber; or by grading as a special grade lumber which can be graded as a standard grade ; or by any other means.
       4.   Records and reports.—Every person who, during any calendar month, shall sell 34,000 pounds or more of southern pine lumber for shipment originating at the mill shall keep for inspection by the Office of Price Administration, for a period of not less than one year, a complete and accurate record of every such sale made during such month, showing the date thereof, the name and address of the buyer, the prices, and the quantities and grades sold.
        Persons affected by this Schedule shall submit such reports to the Office of Price Administration as it may from time to time require.
       5.   Enforcement.—In the event of refusal or failure to abide by the price limitations and other provisions contained in this Schedule, or in the event of any evasion or attempt to evade the price limitations or other provisions contained in this Schedule, the Office of Price Administration will make every effort to assure (a) that the Congress and the public are fully informed thereof, (&) that the powers of the Government, both state and federal, are fully exerted in order to protect the public interest and the interests of those persons who conform to this Schedule, and (c) that the procurement services of the Government are requested to refrain from selling to or purchasing from those persons who fail to comply with this Schedule. Persons who have evidence of the demand of prices above the limitations set forth, of any evasion or effort to evade the provisions hereof, or of speculation, or manipulation of prices of southern pine lumber, or the hoarding or accumulating of unnecessary inventories thereof, are urged to communicate with the Office of Price Administration.

     6.   Modification of the schedule.—Persons complaining of hardship or inequity in the operation of this Schedule may apply to the Office of Price Administration for approval of any modification thereof or exception therefrom : Provided', That no application under this section will be considered unless filed by persons complying with this Schedule.
     7.        Definitions.—When used in this Schedule, the term :
      (a)    “Person” means an individual, partnership, association, corporation, or other business entity. The term includes, without restricting the generality of the foregoing, any mill operator, manufacturer, commission salesman, manufacturer’s representative, con» centration yard operator, wholesaler, wholesale distributor, wholesaler’s agent, or retailer.
      (b)    “Southern pine” means the species of shortleaf pine (Pinus eschinata), loblolly pine (Pinus taeda), slash pine (Pinus caribaed), such longleaf pine (Pinus pdlustris) as contains less than six annual rings per inch and less than one-third summerwood, or any other Pinus species known commercially as “southern pine.”³
      (c)    “Mill” means a manufacturing plant, concentration yard, or other establishment which sells less than 75 percent of the volume of its southern pine lumber at retail and which processes, by sawing, or by planing or other comparable method, at least 25 percent of the volume of southern pine logs or lumber purchased or received by it.
      (d)    “Distribution yard” means a wholesale or retail lumber yard which purchases or receives southern pine logs or lumber from a producer, a mill, or another distribution yard for purposes of unloading, sorting, and resale or redistribution, which regularly maintains a stock of lumber, and which (1) processes, by sawing, or by planing or other comparable method, less than 25 percent of the volume of such logs or lumber so purchased or received by it, or (2), regardless of the percentage of such processing, sells more than 75 percent of the volume of its southern pine lumber at retail.
      (e)    “Retail sale” means a sale which satisfies all of the following tests :
      (1)    It must be a sale of lumber to a consumer or contractor for use in building, construction, remodeling, repair, maintenance, or fabrication, and not for resale in substantially the same form.
      (2)    It includes only sales in less than carload quantities. Where shipment is by water or by truck, the maximum retail sale quantity shall be 20,000 feet board measure. For the purpose of this subparagraph, the size of the sale is determined by the size of the order.
      (3)    The sale must be accompanied by the following services : delivery to the job site or other point specified by the purchaser, and at

such times and in such quantities as the purchaser specifies; tallying and checking; the privilege of exchanging goods and returning unused material; and the readiness and ability of the seller to replace deficiencies and adjust complaints from stocks kept on hand for such purposes.
        (/) “Volume” means the board feet volume of lumber processed from logs, processed from other lumber, or sold, as the case may be, within the 6 months immediately prior to the transaction subject to this Schedule.
      (g) “Deliver” means to make physical transfer of lumber to a purchaser, or to a carrier, not owned or controlled by the seller, for carriage to a purchaser to whom the lumber has been previously sold.
     8.  Effective date of amendments.—Amendment No. 2, amending sections 1, 3, 4, 5, 6, 7, 8, and 9, shall become effective November 24,1941: Provided, That firm commitments entered into prior to November 24, 1941, for the sale of any southern pine lumber covered by Price Schedule No. 19 prior to Amendment No. 2, at prices not exceeding the maximum prices established by such Schedule, may be completed at the contract price. [See note below.]

  For grades and specifications other than those contained in the AAR Rules, the maximum price shall be the price for the AAR grade and specification which most closely corresponds* to the grade and specification of the car material item involved in the sale governed by this Schedule.

  ¹    Specifications for car material (designated above as “AAR Rules”) correspond to the specifications issued by the Association of American Railroads as set forth in its pamphlet M907-33, adopted, 1910; revised, 1933.

  (      &) For mixed car or mixed truck shipments, $1 additional per 1,000 feet board measure may be charged. A mixed car shipment consists of three or more items as hereinafter defined, provided at least 3 items amount to not less than 2,000 board feet each, or at least 6 items amount to not less than 1,000 board feet each, or at least 12 items amount to not less than 500 board feet each. A mixed truck shipment consists of three or more items as hereinafter defined, provided at least 3 items amount to not less than 500 board feet each, or at least 6 items amount to not less than 250 board feet each. An item consists of one width, thickness, or pattern of finish, casing, base, mouldings, partition, ceiling, siding, plain end flooring, end matched flooring, shiplap, boards, strips, dimension, or timbers.

   (c) For export sales, an addition of not more than $3.50 per 1,000 feet board measure may be charged for the services of switching, unloading at the dock, tallying, marking, and dock insurance.
   (c?) A delivered price in excess of the maximum f. o. b. mill prices set forth in (a) hereof may be charged, consisting of such maximum prices plus actual transportation costs to the extent that such costs are paid by the seller. Issuance of Price Schedule No. 19

  Prices of southern pine lumber, which stands with Douglas fir at the top of the list of primary construction materials, are reduced roughly $3 per thousand board feet from recent high levels by Price Schedule No. 19 announced today by Leon Henderson, Administrator, Office of Price Administration and Civilian Supply.
  Simultaneously, Mr. Henderson disclosed that ceiling prices for Douglas fir lumber, which is generally competitive with southern pine, will be established in the near future.¹ A meeting to discuss such a schedule'with representatives of the Douglas fir lumber industry has been called by OPACS for August 20 in Portland, Oreg.
  The southern pine lumber schedule will go into effect as of September 5, 1941.
  Preliminary to its determination of ceiling prices, OPACS consulted with representatives of the southern pine lumber industry at a conference on August 6 and subsequently met with numerous individual members of the trade. Discussions similarly were had with Government agencies concerned, including the Procurement Services of the War and Navy Departments; Forest Service of the Department of Agriculture; Federal Works Administration; Department of Commerce; Division of Purchases of the Office of Production Management; Department of Justice, and the Procurement Division of the Treasury Department.
  Mr. Henderson stated that lumber prices have been a matter of serious concern to him for almost a year and have occasioned several warnings against unjustified increases. Such stability as these warnings achieved was dissipated in June of the current year, when a new succession of price increases began. Prices of No. 2 common boards advanced from $22 per thousand board feet in July 1940, to $30 per thousand, f. o. b. mill, in July 1941. Today the cost of this and other types of lumber to the general public and to the defense program is exorbitant.

    OP ACS ceiling action, applied to the present annual scale of lumber buying, means a saving to civilian consumers and to the Government of more than $20,000,000 a year. At the same time the southern pine lumber industry is accorded a schedule of prices adequate to permit continued profitable operations.
    The price schedule applies only to sales from mills or concentration yards. Wholesale or retail yard prices, currently inflated, are expected to fall into line promptly.
    “If this does not occur,” Mr. Henderson said, “the ceiling will be extended to cover all wholesale and retail sales.”
    Costs of finishing and dressing, as well as expenses of distribution, are reflected in the schedule. Because of this latter factor, it is expected that mills will continue wholesalers’ margins and other discounts now prevailing. Thus, present industry practices need not be disturbed.
    Southern pine, sometimes called yellow pine, includes longleaf, slash shortleaf, loblolly, and several other species of less importance. Southern pine lumber is employed in all kinds of building construction and has an important use in the defense program, particularly for cantonments and defense housing in the South and East.
    About 95 percent of southern pine is cut in 10 States: Alabama, Texas, North Carolina, Mississippi, Arkansas, Louisiana, Georgia, Florida, South Carolina, and Virginia, ranking in importance in that order.
    The price schedule recognizes no difference between longleaf and shortleaf pine in the grades and types covered. Long and large timbers, which are usually made of the longleaf variety, are excluded, as are certain other sizes. It is expected that the prices of these sizes will fall into line with the prices for the kinds and grades of lumber included in the schedule. Should this not follow, Mr. Henderson stated, the schedule will be extended to take them in.
    Maximum prices are established for siding, ceiling, flooring, finish, boards, shiplap, fencing, dimension, and small timbers.
    Top prices that may be charged for siding range from $20 for 4-inch drop", plain end, to $47 for grade B and better bevel siding. Ceiling and flooring lumber, vertical grain, has a maximum price of $60 for grade B and better, plain end, with a range downward on lower grades. End-matched ceiling and flooring, vertical grain, is given a top price of $52.50 for grade B or better with similar differentials on lower grades. Flat grain ceiling and flooring goes down from a top price of $43 on grade B or better.
    “Finish,” a high grade of southern pine generally stocked by lumber yards for clear shelving, panelling, etc., has a price range for standard lengths in the schedule of $51 to $70 for grade B and better and $47 to $58 for grade C, all in widths of 3- to 12-inch.

  Boards, shiplap, and fencing come in three base grades, known as 1, 2, and 3 common. Maximum prices in 1- by 6-inch, 14-f oot lengths, are $31 for No. 1 grade and $26.50 for No. 2 grade. The No. 3 grade, random lengths, has a price range of $16 to $21 based on width.
  Ceiling prices on “dimension” lumber, using 2 by 4’s as the most representative type, range from $28.50 for No. 1 grade down to $26 for No. 2 grade in 10-, 12-, and 14-foot lengths. Random lengths in No. 3 grade have top prices of from $18.50 to $20.
  Small and utility timbers are priced from $26.50 for 3- by 4-inch No. 2 grade in 12- to 14-foot lengths up to $42.50 on No. 1 grade 8 by 8’s in 18- to 20-foot lengths.
  All prices quoted are for 1,000 board feet and are f. o. b. mill. In the case of direct mill shipments, delivered prices must not exceed the ceiling price f. o. b. mill, plus actual transportation charges to the point of delivery. In estimating such transportation charges, it is permitted to use the standard weights adopted by the Southern Pine Inspection Bureau.
  The ceiling prices established in the schedule apply on all sales and deliveries on and after the effective date, September 5, 1941, notwithstanding any then existing contracts or commitments.²

Changes in Price Schedule No. 19 in Advance of Effective Date (Amendment No. 1)

     Substantial changes in the southern pine lumber price schedule in advance of its effective date, September 5, were announced today by Leon Henderson, Administrator, Office of Price Administration.
     The general effect of the revisions, which are incorporated in a detailed amendment, is to raise the ceiling prices so that the thousands of small lumber mills throughout the southern pine area will be able to continue in profitable operation. While the maximums are raised, Mr. Henderson pointed out, the prices for southern pine lumber will be below the levels of August 15 and the net annual saving to the defense program and to civilian users will not be lowered greately from his original estimate of $20,000,000.
     “Since the schedule of southern pine lumber prices was announced on August 16, I have received many complaints from mills throughout the Southern States asserting that if ceiling prices thus imposed were permitted to go into effect on September 5 without change, widespread hardship would result,” Mr. Henderson said. “These complaints asserted that the stumpage costs of the small mills have risen sharply in recent months and that their logging problems are more difficult due to the fact that available timber stands are less accessible. Furthermore, the schedule made no special allowance for air-dried lumber, which is the kind currently being sold by the small mills.
     “It always has been the policy of my office to investigate complaints of this nature and to make such adjustments as appear to be warranted, if careful appraisal of the facts substantiates the complaints. In keeping with this policy, a meeting of OP A officials with approximately 450 mill operators was held on August 30 in New Orleans. After full hearing of their complaints and in the light of additional data collected by my office, it became apparent that adjustments in the schedule were necessary. A committee, representing all sections and all types of mills producing southern pine lumber, is in thorough accord with the revisions that have been worked out. Moreover, the 450 lumber producers present at the New Orleans meeting have

promised their full cooperation in maintaining the ceiling prices, as amended.”
  Maximum prices in the original schedule were based upon air-dried lumber in finished form. By the amendment, ceiling prices are based on “rough green” lumber and additional charges are allowed to be made for air-drying or kiln-drying, surfacing, grooving, etc. In many instances the prices themselves have been changed within the various grades, although the net effect as applied to an entire grade is not substantial. One grade, known as “finish,” is eliminated as unimportant.
  Several refinements of definition also are contained in the amended schedule, reflecting trade usage or practices. For example, longleaf pine is further defined so as to make it clear that only the coarsegrained variety is covered by schedule. The definition of a “mill” is restated so as to exempt from the price schedule the large number of lumber retailers in the South who operate planing and similar mills as adjuncts to their retail businesses. A “retail sale,” according to the amendment, means a sale to consumer or contractor in less-than-carload quantity. Mixed car shipments are defined and an explanation of mixed truck shipments is added.
  To cover the extra services and costs involved, an addition of not more than $3.50 for 1,000 board feet is allowed in the case of export sales.

   Request for Geographical Differential in Ceiling Prices Refused

     A request for an over-all increase of $2 per 1,000 board feet in the established maximum prices for No. 2 grade southern pine lumber produced in Virginia and North Carolina was refused today by Leon Henderson, Administrator, Office of Price Administration.
     Freight rates on 1,000 board feet of lumber from Virginia and North Carolina mills to such major industrial centers as New York, Philadelphia, and Baltimore are from $2.50 to $5 less than freight charges to these centers from Georgia mills. Under the OPA price schedule, ceiling prices at mills are the same in all Southern States for given grades of lumber.
     The Virginia and North Carolina mills asked that they be permitted to take advantage of this difference in freight rates by adding $2 per 1,000 board feet to the ceiling price in their States. They also contended that their costs were higher than in other States.
     Mr. Henderson rejected the request for the following reasons:
     Increases such as the one requested would set up differentials between prices received by mills based solely on favorable or unfavorable situations with respect to freight rates. It would end in a “complete delivered price or basing point system” for the industry. Such a system would mean that there would be only one price to the consumer whether he is next door to or 500 miles from the mill.
     If this increase were allowed a similar increase could justifiably be claimed by all areas where freight rates were lower than those from the more remote areas.
     Actually, Mr. Henderson said, the maximum prices established in the southern pine schedule (Price Schedule No. 19) provide a ceiling that is liberal in relation to costs for the entire producing area.
     It is important in this connection that many sales are now being made by mills at prices below the maximums. An increase accorded to one area would result in similar requests from numerous other areas. In a period of unusual demand this might lead to a general rise in the whole level of prices established in the schedule, the Administrator said.

Amendment No. 2 to Price Schedule No. 19, Bringing Freight Car Construction Materials Under Ceiling and Adjusting Established Prices

  Amendment of the Southern pine lumber price schedule to bring freight-car construction materials under a ceiling and to make other important adjustments was announced today by Leon Henderson, Administrator, Office of Price Administration.
  Maximum prices established for freight-car decking, sheathing, and lining are from $2 to $8 per thousand board feet below existing levels.
  Other changes made by the amendment, which becomes effective November 24, 1941, include:
  1.   Top prices for flooring are raised for the two highest grades and reduced for the two lowest grades.
  2.   Allowance for mixed shipments is reduced from $2 to $1 per thousand board feet.
  3.   An addition of $3.50 per thousand board feet is allowed in the case of retail direct-mill shipments, accompanied by specified retail services.
  4.   Ceiling prices of bevel siding are reduced, and those for the two highest grades of drop siding are adjusted to decrease the maximum for certain patterns and to increase the prices of other patterns.
  5.   Permissible additions to maximum prices for planing of boards are lowered and those for drying are increased.
  When the Southern pine lumber schedule originally was issued, it was not considered necessary to include freight car materials since it was expected that the OPA ceilings for other items would serve to keep car material prices stable.
  This expectation was not realized. Moreover, manufacturers of the higher grades of flooring, which are under the OPA ceiling, diverted some of their flooring production to freight car materials. Supplies of high-grade flooring, already short, thus were reduced further.
  The OPA amendment is designed to correct this situation in two ways. First, by setting maximum prices for the principal types of freight car materials at less than current levels and, second, by in

creasing the ceilings for the two upper grades of flooring by $3 per thousand board feet. Simultaneously, the top prices for the two lowest grades of flooring, supplies of which are adequate, are reduced by $1 per thousand board feet.
      A special allowance is made in the amendment for final inspection of car material^ at the destination point, rather than at the mill. Destination inspections usually result in more rejections for defects, and leave the rejected lumber at a distance from the mill; hence, they involve higher costs for the seller. The amendment allows an additional charge of $5 per thousand board feet to cover these greater costs.
      Reduction of the additional charge which the schedule allows for mixed car shipments from $2 to $1 per thousand board feet is intended to eliminate abuses.
      The mixed car allowance was designed solely to compensate the seller for added trouble and expense when the buyer wants a variety of items. Some sellers have attempted to obtain an extra $2 per thousand by insisting that the buyer take a mixed car, whether he needs it or not, and by the inclusion in a straight car of the minimum number of added items to satisfy the mixed car definition. In spite of repeated warnings to individuals by the OP A, this practice has continued. A trial period under the reduced allowance will be permitted, Mr. Henderson said, and if abuses continue, the mixed car allowance will be eliminated from the schedule altogether. The same warning applies to the practice of insisting on selling specified lengths of kiln-dried lumber, for no other reason than to obtain a premium.
      The schedule does not compel a seller to sell straight cars or random lengths if he has not customarily done so or is unable to do so; it merely requires that a seller who has usually filled such orders shall not now refuse to do so and demand that the buyer take a mixed car or specified lengths whether he originally wanted to or not.
      Allowance of not more than $3.50 per thousand board feet in the case of direct mill shipments of a retail nature is intended to make provision for lumber retailers who are doing an increasing amount of business of this character. In order to be entitled to the additional charge, the sale must involve less than 20,000 board feet and must be accompanied by the usual services attending the sale of lumber out of a retail distribution yard. Among these services are: delivery to the job site or other point specified by the purchaser in such quantities and at such times as the purchaser specifies; tallying and checking; the privilege of exchanging goods and returning unused material^ and replacement of deficiencies out of stock.
      The original schedule set a top price of $47 per thousand board feet on bevel siding Grade B and better. By the amendment, bevel siding is divided into two thicknesses, %" and Maximum prices

    of $45 and $39 per thousand board feet, respectively, are established for the %" and thicknesses. This change brings bevel siding prices more nearly in line with the present market.
   Drop siding is regrouped in the amendment to set specific prices for four leading patterns and a separate list of prices for all other patterns. With respect to those patterns that are most costly to produce, the ceiling prices are raised $4 per thousand feet in the 8" widths. The remaining patterns are reduced by $5 per thousand in both 6" and 8" widths. These adjustments apply only to B and better and C grades df drop siding, the prices of other grades remaining unchanged.
   The allowable addition to ceiling prices for air and kiln-dried boards and strips is increased 500 a thousand feet and now corresponds to the additions permitted for drying dimension lumber. The permissible addition for matched and shiplap boards and strips is reduced 500 a thousand. By these changes, the schedule will reflect more accurately the actual costs involved in rendering these services.
   As amended, the schedule expressly stipulates that the 500 allowable addition for chemical anti-stain^ treatment of boards, strips, and dimensions can be made to rough or air-dried prices, but not to kiln-dried prices.

    (d) A delivered price in excess of the maximum f. o. b. mill prices set forth in (a) hereof may be charged, consisting of such maximum prices plus actual transportation costs to the extent that such costs are paid by the seller. In computing such actual transportation costs, the parties may adopt the practice of charging a sum equivalent to the one-quarter of a dollar nearest to such actual transportation costs.     Supplement

      Establishment of the Office of Price Administration

   On April 11, 1941, the President issued Executive Order No. 8734,¹ establishing the Office of Price Administration and Civilian Supply, which combined the Price, Consumer, and, in part, Agricultural Divisions of the National Defense Advisory Commission. On April 15, 1941, Leon Henderson, Administrator of the Office of Price Administration and Civilian Supply, issued an order ratifying action taken by the Price Stabilization Division prior to the Executive order of April 11,1941. This order provided as follows :
    1.   All price schedules, instructions, announcements, forms, and notices heretofore issued, promulgated, or adopted, and all committees formed, by the Advisers on Price Stabilization and Consumer Protection, members of the Advisory Commission to the Council of National Defense, or by the Price Stabilization and Consumer Divisions of the Advisory Commission to the Council of National Defense are hereby ratified, adopted, and continued in effect, until modified, terminated, or superseded, as price schedules, instructions, announcements, forms, notices, and committees, of the Office of Price Administration and Civilian Supply and the Administrator thereof.
    2.   This ruling is issued under, and in execution of the purposes of, Executive Order No. 8734, Issued by the President on April 11, 1941.

   On August 28, 1941, the President issued Executive Order No. 8875,³ which transferred the Division of Civilian Supply from the Office of Price Administration and Civilian Supply to the Office of Production Management. The title of the Office of Price Admin-istration and Civilian Supply was changed to the Office of Price Administration. On August 30,1941, Leon Henderson issued a press release stating that all action taken by the Office of Price Administration and Civilian Supply remained in full force and effect regardless of the change of name to Office of Price Administration. nounced in the President’s Executive Order of Thursday, Leon Henderson, Administrator of the Office of Price Administration announced today.
        “The Executive order,” Mr. Henderson said, “merely provides that the title of the Office of Price Administration and Civilian Supply be changed to Office of Price Administration. It does not affect in any way the powers of the agency in regard to price control. Consequently all price-ceiling schedules issued and all other action taken by this agency under the prior name remain fully effective under our new name.” ⁴
