Press Release January 12, 191$—PM 2120 Striking directly at widespread profiteering in se’cond-hand tires, Price Administrator Leon Henderson today announced an emergency schedule of maximum prices for “retreadable” tire carcasses and “retreads” and said he would impose a price ceiling over used tires in the very near future. Today’s schedule, which goes in effect Monday, January 19, 1942, establishes the maximum prices that may be charged for “retreadable” and retreaded or recapped rubber tires for passenger cars, trucks, busses, agricultural implements, industrial machines, motorcycles, and other vehicles of common use. The ceiling over used tire prices, expected in a few days, will take the form of an amendment to the OPA schedule of maximum prices over new tires, which was announced on December 30.1 With the issuance of this amendment, Administrator Henderson will have established maximum prices over tires at every stage of condition and use. “The public must be protected from exploitation,” Mr. Henderson stated. “Your Government has been compelled to suspend sales of tires to ordinary civilian users in order that our armed forces may have adequate supplies. Excepting for doctors, nurses, and public services essential to the general health and safety, civilians will have to equip their cars and trucks with used or retreaded tires. Profiteering in these tires already has reached serious proportions, a condition that cannot and will not be allowed to continue. Your Government cannot permit price to determine who can afford and who cannot afford to buy second-hand tires in this time of war.” Sets of ceiling prices in today’s schedule are given for the various sizes of used tire carcasses in such condition as to warrant retreading, for the actual retreading or recapping, and for retreaded or recapped tires. Specific top prices are set according to the market price of “camelback” used (the uncured rubber compound which is applied to worn tires to make the new tread) and the depth of the new tread. Maximum prices for retreaded or recapped tires are arrived at by adding together the maximum price of the carcass used and the applicable maximum price for the actual retreading or recapping. 1 Price Schedule No. 63—Retail Prices for New Rubber Tires and Tubes. There are various other categories of camelback and tread depths for which the schedule lists maximum prices. A “basic tire carcass”, according to the schedule, means a used rubber tire retaining a maximum of 2/32ds of an inch of the original tread when measured at the shallowest point of the center circumference. “Retreading” is defined as the process of reconditioning a tire where all of the original tread rubber is removed from the worn tire down to the fabric and new rubber applied to the tread surface and side walls. “Top capping,” the schedule states, means the application of new rubber to the tread surface only, after buffing off the old tread, while a “full cap” involves the application of new rubber to the tread surface and shoulders as well. Each retreaded or recapped tire sold must be accompanied by a statement to the purchaser reciting whether the tire has been retreaded, top capped, or full capped; the market price of camelback used; and the depth of the nonskid tread at the center of the tire after completion of retreading or recapping. This is the fifth step affecting tires that the Government has taken since the outbreak of war in the Pacific threatened to halt imports of crude rubber from the Far East. Restrictions on the processing of crude rubber were imposed by the Office of Production Management on December 11 and at the same time all sales of new tires for civilian use were halted temporarily. These actions were followed by OPA’s tire rationing program that limited new tire sales to civilians to uses directly connected with public health and safety. The fourth step was the issuance on December 30 of a schedule of maximum prices at retail over all new tires.2 Under provisions of today’s schedule, on and after 8 a. m. on January 19, 1942, all sellers of retreaded or recapped tires, including establishments engaged in retreading or recapping, are required' to post prominently in their shops or stores a list of maximum prices as determined by the emergency schedule. A copy of the OPA printed price list contained in the schedule may be used for this purpose, or the seller may draw up his own list, using the OPA maximum prices for such sizes of tires as he may handle or such types of retreading or recapping operations as he may perform. In order to protect buyers, the schedule forbids the addition to the maximum prices of any charges not already in effect. If, on January 9, 1942, any seller made special charges for extending credit, or for demounting or mounting of tires, and wishes to continue such charges after the effective date of this schedule, he must post publicly, on or before 8 a. m. January 19,1942, a sworn statement listing such charges. Unless the list of charges is posted along with the actual maximum price list, no special charges may be collected. Complete records of all sales of basic tire carcasses, and of retreaded or recapped tires, as well as of retreading and recapping work done, must be kept by sellers for inspection by the Office of Price Administration. An Open Letter From Leon Henderson, Administrator of the Office of Price Administration, to Tire Retreading and Recapping Establishments and Sellers of Retreaded or Recapped Tires War in the Far East, where we normally get over 90 percent of our crude rubber, has compelled your Government to ration new tires in order that our armed forces may be assured of adequate supplies. You have already observed the effect of this on the second-hand tire markets. Overnight the demand for used and retreaded tires has increased a thousandfold, and, unfortunately, this rush of business has resulted in profiteering. A flood of complaints is reaching Washington about tire dealers who are asking fantastic prices for secondhand tires from motorists and truck owners. Under these circumstances, the Government has stepped in to restore order and to protect the public and those tire dealers who have steadfastly refused to take advantage of the unusual situation by inflating their prices. The Government’s action takes the form of a maximum price schedule issued by the Office of Price Administration. This schedule, known as Price Schedule No. 66—Retreaded and Recapped Tires, becomes effective on Monday, January 19, 1942. I urge you to read its provisions carefully. You must comply with all of them. The following is a summary of what the schedule does and what it requires of you as a tire retreader or seller of retreaded or recapped tires: 1. The schedule establishes the maximum prices you may charge for: (a) “Basic tire carcasses”; that is, tire carcasses retaining a maximum of %2-inch of the original tread at the center. (6) Retreading or recapping, based upon the market price of the camelback used and the depth of tread after retreading or recapping. (c) A retreaded or recapped tire. The schedule contains lists of all of the sizes of tires commonly subjected to retreading and gives specific maximum prices for the carcasses and the various grades of retreading and recapping work. A retreaded or recapped tire may not be sold for more than the total of (a) the maximum price of . the carcass used and (6) the maximum price for tbe retreading or recapping, based upon the market price of camelback used and the depth of tread design imposed. 2. If you operate a retreading establishment or sell retreaded or recapped tires you must post conspicuously on or before 8 AM, January 19, 19/^2, lists of maximum prices as established by the schedule, for tires sold or retreading work done. 3. After 8 AM on January 19, 1942, no matter what price you may have quoted for work on tires now in the process of being recapped or retreaded, you cannot collect any price that exceeds the maximum prices established by the schedule. 4. After 8 AM on January 19, 1942, you cannot collect any special charges for mounting or demounting a tire, extending credit, or any other service unless— (a) You collected such charges on January 9, 1942; and (6) You post publicly a list of such special charges, along with the list of maximum prices. 5. You must give to every purchaser of a retreaded or recapped tire or to anyone who has a tire retreaded or recapped a written statement stating whether the tire has been retreaded, full capped, or top capped ; the market price of camelback used; and the depth of the nonskid tread at the center of the tire after it has been retreaded or recapped. 6. You must keep full and detailed records bf your sales for inspection by the Office of Price Administration. These records must contain date of each transaction; name and address of the purchaser; price per unit; quantity and size of tire sold, retreaded, or recapped, specifying whether the work was retreading; full-capping or top-capping; market price of camelback used; and depth of the nonskid tread at the center of the tire after it has been retreaded or recapped. 7. You also must keep for OPA inspection complete records of your entire inventory of camelback, showing the date of each purchase or acquisition ; name of seller or source ; price paid and stocks on hand as of the 19th and 31st days of January 1942 and as of the last day of each month thereafter. I have complete confidence that you will cooperate patriotically with your Government in this war emergency. Your patriotic support will make it possible for other Americans to obtain at fair prices the tires they need to keep in operation many passenger automobiles, trucks, and busses that otherwise would disappear from our streets and highways. C., January 10, 191$. 437570°—42---------2 9 Price Schedule No. 661 Retreaded and Recapped Rubber Tires, the Retreading and Recapping of Rubber Tires, and Rasic Tire Carcasses The war being waged with the Japanese Empire makes uncertain the future shipment of rubber from the Far East, which has hitherto been supplying this country with the greatest part of its crude rubber. In order to conserve for military and essential civilian purposes the rubber stockpile already accumulated in this country, it has been necessary to curtail sharply the consumption of rubber in the manufacture of products not essential to the immediate national defense. The production and sale of new rubber tires and tubes for ordinary civilian use have been greatly curtailed by Supplementary General Limitation Orders M-15-b2 and M-15-c 3 of the Office of Production Management. The maximum prices for which new rubber tires and tubes may be sold at retail have been fixed by Price Schedule No. 63. A result of the regulation of the manufacture, sale, and price of new rubber tires has been a sudden, greatly increased demand for basic tire carcasses, retreaded and recapped rubber tires, and for the retreading and recapping of rubber tires. In a number of instances, in the last few weeks, prices, excited by the demand, have shot upward without regard to reason and with not even a claim of justification. Indeed, the price of camelback, the principal material used in the retreading and recapping process, was stabilized by action taken by the Office of Price Administration on December 3, 1941. To halt such flagrant profiteering and pending the outcome of a thorough investigation now in process of completion, the Office of Price Administration finds it necessary to issue a Price Schedule establishing as maximum prices the prices presently prevailing. These prices have been established after independent investigation and conferences with the industry. Maximum prices for retreaded and recapped rubber tires, the retreading and recapping of rubber tires, and basic tire carcasses.—On and after January 19, 1942, regardless of the terms of any contract of sale or other commitment: (1) no person shall sell, offer to sell, deliver, or transfer any retreaded or recapped tire or any basic tire carcass at prices higher than the maximum prices set forth in Appendix A hereof, incorporated herein as Section 10; and (2) no person shall retread or recap any tire at prices higher than the maximum prices set forth in Appendix A hereof. 2. Less-than-maximum prices.—Lower prices than those set forth in Appendix A may be charged or demanded. 3. Evasion.—The price limitations set forth in this Schedule shall not be evaded whether by direct or indirect methods in connection with the sale, delivery, or transfer of a tire carcass or retreaded or recapped rubber tire, alone or in conjunction with any other article or material, or in connection with the retreading or recapping of any rubber tire, by way of any commission, service, transportation, or other charge, or by tying agreement, or other trade understanding, or by increasing the charges for the extension of credit, or for the demounting or mounting of a tire on a vehicle, or rim or for any other service over those in effect on January 9, 1942, or by making the terms and conditions of sale more onerous to purchasers than those available or in effect on January 9, 1942, or by any other means. The purchaser shall always have the option of paying at the time of the purchase the full cash price for any basic tire carcass or retreaded or recapped rubber tire or for retreading or recapping any rubber tire. When a purchaser has a tire retreaded or recapped he shall have the option of bringing it to the seller’s place of business without having it demounted from a vehicle or rim by the seller or having any other service performed, and of receiving delivery of any basic tire carcass or retreaded or recapped rubber tire at the seller’s place of business without having it mounted on a vehicle or rim or having any other service performed. 4. Posting of prices.—Every person engaged in the business of retreading or recapping rubber tires or of selling retreaded or recapped rubber tires or basic tire carcasses shall keep posted in a conspicuous place in each establishment at which such tires are offered for sale, or at which such retreading or recapping is contracted for, a statement setting forth the maximum prices which he is permitted to charge under this Schedule for such basic tire carcasses, retreaded or recapped rubber tires, and for retreading or recapping such rubber tires. For this purpose it shall be permissible to employ a copy of the printed list of maximum prices published by the Office of Price Administration if a copy of such list is then in the hands of such person. Such statement or list shall be posted not later than 8 A. M. on January 19,1942. If, on January 9, 1942, the seller made special charges for the extension of credit or for the demounting or mounting of tires or tubes on a rim or vehicle, or for any other service, and if he desires to continue such charges after January 19, 1942, such seller shall prepare a notarized statement listing the prices charged on January 9, 1942, for such extra service and shall post such statement not later than 8 A. M. on January 19, 1942, along with the statement or list of maximum prices required to be posted by this section. 5. Records and reports.—(a) Every person engaged in the business of selling retreaded or recapped rubber tires or of retreading or recapping rubber tires shall furnish the purchaser with a written statement reciting (1) whether the tire has been retreaded, full capped, or top capped ; (2) the market price of the camelback used ; and (3) the depth of the nonskid tread at the center of the tire after the completion of the retreading or recapping. (6) Every person engaged in the business of selling basic tire carcasses or retreaded or recapped rubber tires or of retreading or recapping rubber tires shall keep for inspection by the Office of Price Administration, for a period of not less than two years, complete and accurate records of every sale of such articles or of every retreading or recapping operation performed including the date thereof, the name and address of the purchaser, the price per unit, the quantity and size of tires sold, retreaded, or recapped, specifying whether the work was retreading, full capping, or top capping, the market price of the camelback used, and the depth of the nonskid tread at the center of the tire after the completion of the retreading or recapping, (c) Every person engaged in the business ôf retreading or recapping rubber tires shall keep for inspection by the Office of Price Administration, for a period of not less than two years, complete and accurate records of his entire inventory of camelback, showing the date of each purchase or acquisition, the name of the seller or source, the price paid, and the stocks on hand as of the 19th and 31st days of January 1942 and of the last day of each succeeding month thereafter, (d) Persons affected by this Schedule shall submit such reports to the Office of Price Administration as it may, from time to time, require. 6. Enforcement— In the event of refusal or failure to abide by the price limitations, posting or record requirements, or other provisions of this Schedule, or in the event of evasion or attempt to evade the price limitations, or other provisions of this Schedule, the Office of Price Administration will invoke all appropriate sanctions at its command, including taking action to see (a) that the Congress and the public are fully informed thereof; (6) that the powers of Government, both State and Federal, are fully exerted in order to protect the public interest and the interests of those persons who comply with the Schedule; (c) that full advantage will be taken of the cooperation of the various political subdivisions of State, county, and local government by calling to the attention of the proper authorities failures to comply with this Schedule which may be regarded as grounds for the revocation of licenses and permits; and (d) that the Rubber Reserve Company and the procurement services of the Government are requested to refrain from selling to or purchasing from those persons who fail to comply with this Schedule. Persons who have evidence of the offer, receipt, demand, or payment of prices higher than the maximum prices, or of any evasion or effort to evade the provisions hereof, or of speculation, or manipulation of prices of basic tire carcasses, retreaded or recapped rubber tires or retreading or recapping rubber tires, or the hoarding or accumulating of unnecessary inventories thereof, are urged to communicate with the Office of Price Administration. 7. Modification of the Schedule.—Persons complaining of hardship or inequity in the operation of this Schedule may apply to the Office of Price Administration for approval of any modification thereof or exception therefrom: Provided, That no application under this section will be considered unless filed by persons complying with this Schedule. 8. Definitions.—When used in this Schedule the term— (a) “person” means an individual, partnership, association, corporation, or other business entity; (6) “retreading” means the prt>cess of reconditioning a tire by removing all the original tread rubber from the worn tire down to the fabric and applying new rubber to the tread surface and side walls; (c) “recapping” means the process of applying a top cap or full cap to a used rubber tire; (d) “top cap” means a tread renewal where the worn tread of the tire is buffed off the top surface of the tire and new rubber is applied to the tread surface only; (e) “full cap” means a tread renewal where in addition to buffing off the worn tread the shoulders of the tire also are buffed below the shoulder design and new rubber is applied to both the tread surface and tire shoulders; (/) “purchaser” means a person who buys or offers to buy a basic tire carcass or retreaded or recapped tire, or who has any tire retreaded or recapped; (g) “seller” means a person who sells or offers to sell a basic tire carcass or retreaded or recapped rubber tire, or who retreads or recaps or offers to retread or recap used tires; (A) “basic tire carcass” means a used rubber tire retaining a maximum of ^2 inch of the original tread when measured at the shallowest point of the center circumference; (ï) “a tire” means any rubber tire of the size and type described in Appendix A to this Schedule; (j) “camelback” means the uncured rubber compound applied to the worn tire to make the new tread in the process of retreading. 9. Supplement Establishment of the Office of Price Administration On April 11, 1941, the President issued Executive Order No. 8734/ establishing the Office of Price Administration and Civilian Supply, which combined the Price, Consumer, and, in part, Agricultural Divisions of the National Defense Advisory Commission. On April 15, 1941, Leon Henderson, Administrator of the Office of Price Administration and Civilian Supply, issued an order ratifying action taken by the Price Stabilization Division prior to the Executive Order of April 11, 1941. This order provided as follows: 1. All price schedules, instructions, announcements, forms, and notices heretofore issued, promulgated, or adopted, and all committees formed, by the Advisers on Price Stabilization and Consumer Protection, members of the Advisory Commission to the Council of National Defense, or by the Price Stabilization and Consumer Divisions of the Advisory Commission to the Council of National Defense are hereby ratified, adopted, and continued in effect, until modified, terminated, or superseded, as price schedules, instructions, announcements, forms, notices, and committees, of the Office of Price Administration and Civilian Supply and the Administrator thereof. 2. This ruling is issued under, and in execution of the purposes of, Executive Order No. 8734, issued by the President on April 11, 1941. On August 28, 1941, the President issued Executive Order No. 8875/ which transferred the Division of Civilian Supply from the Office of Price Administration and Civilian Supply to the Office of Production Management. The title of the Office of Price Administration and Civilian Supply was changed to the Office of Price Administration. On August 30, 1941, Leon Henderson issued a press release stating that all action taken by the Office of Price Administration and Civilian Supply remained in full force and effect regardless of the change of name to Office of Price Administration. No. 170, Aug. 30, 1941. in the President’s Executive Order of Thursday, Leon Henderson, Administrator of the Office of Price Administration, announced today. The Executive Order, Mr. Henderson said, merely provides that the title of the Office of Price Administration and Civilian Supply be changed to Office of Price Administration- It does not affect in any way the powers of the agency in regard to price control.
