AUTOMOTIVE REPAIR SERVICES
A statement of the considerations involved in the issuance of this regulation, issued simultaneously herewith, has been filed with the Division of the Federal Register.
§ 1499.682 Maximum prices for specific automotive repair services. The provisions of RMPR 165 are modified to the extent set forth below as far as automotive repair services are concerned.
(a)	Charge based on customer’s hourly rate. Your maximum price for each automotive repair service listed in Appendix A of this regulation shall not exceed:
(1)	A charge for labor resulting from multiplication of your customer’s hourly rate established under RMPR 165 or any applicable supplementary service regulation by the hours or fractions of hours which are specified in Appendix A, plus
(2)	A charge for parts and. materials not to exceed your maximum prices therefor.
If you have not already established a customer’s hourly rate for pricing any service listed in Appendix A, you must establish such a rate under section 5 of RMPR 165.
(b)	Fixed charge. If, however, your maximum price under RMPR 165 for any service listed in Appendix A, is a “fixed charge,” you may not charge more for that service than your fixed charge or the price determined under the preceding paragraph, whichever is lower. A “fixed charge” means a charge which is not computed by means of a customer’s hourly rate.
(c)	Lower prices. Prices lower than those established by this regulation may be charged at any time.
(d)	Overlapping operations; discounts. The practice of charging not more than once for overlapping operations, which has applied to pricing by use of manuals or labor schedules, also applies to pricing under this regulation. If you perform an operation listed in Appendix A which contains a step included in another operation which you perform, follow this rule, unless otherwise indicated in Appendix A—Use Ap-

pendix Afto compute your price for the longer operation; and price under RMPR 165 that part of the shorter operation which has not already been taken into account.
For example—Assume that the longer operation consists of three steps (A, B, and C) and that the shorter operation consists of two steps (B and D). One step (B) is common to both operations. Compute your price for the longer operation (ABC) by using the time set forth in Appendix A. Price under RMPR 165 that part (D) of the shorter operation (BD) which you have not already taken into account. You have already taken into account the step (B) common to both operations in computing your price for the longer operation.
You must maintain your customary allowances, discounts, or other price differentials.
(e)	Sales slips or receipts. Regardless of any request therefor, you must give to any person purchasing a service listed in Appendix A a sales slip or receipt showing:
(1)	Your name and address,
(2)	The date,
(3)	A brief description of each service supplied,
(4)	The number for that service given in Appendix A,
(5)	Your customer’s hourly rate,
(6)	The number of hours charged for (indicating overtime hours if charged for at overtime rates),
(7)	The prices charged for parts and materials, and
(8)	The total charge.
(f)	Services not listed in Appendix A., The following rules shall govern services not listed in Appendix A:
(1)	Maximum prices. Your maximum price for any service not listed in Appendix A shall continue to be your maximum price for that service as established by RMPR 165 or any applicable supplementary service regulation.
(2)	Availability to customers of flat rate manual or labor schedule. If you use a flat rate manual or labor schedule in pricing any service not listed in Appendix A, you must on request make such manual or schedule available to your customer for his inspection.
(3)	Sales slips or receipts. If your cutomer requests a sales slip or receipt for any service not listed in Appendix A, you must give him a sales slip or receipt showing:
(i)	Your name and address,
(ii)	The date,
(iii)	A brief description of each service for which a separate charge is made,
(iv)	(a) If customer’s hourly rate alone is used in pricing the service, your customer’s hourly rate and the number of hours for which a charge is made (indicating overtime hours if charged for at overtime rates).
(b)	If flat rate manual or labor schedule is used in pricing the service, the name of the manual or schedule, the number or other identification of the service as it appears in the manual or schedule, your customer’s hourly rate, and the number of hours for which a charge is made (indicating overtime hours if charged for at overtime rates).
(b)	If fixed charge is used in pricing the service, the fixed charge.
(v)	The prices charged for parts and materials,
(vi)	Any other charge (and indication of its nature), and
(vii)	. The total charge.
(g) Availability of this regulation to customers. A copy of this regulation shall be kept available at your place of business for inspection by your customers.
This regulation shall become effective June 14,1945.

Appendix A—Automotive Repair Services
Important! So that you will properly determine your maximum prices, it is important that you understand the terms defined below. These terms as used in Appendix A shall have the meanings indicated, unless the context clearly otherwise requires. All other terms used in Appendix A shall have their customary trade meanings.
“Automotive repair services” means the repair operations listed in Appendix A when performed on any automobile listed there which is primarily designed for transporting persons, except ambulances and hearses.
“Remove” means to take off or to take out a part or parts.
“Install” means to put back the same part or parts.
“Replace” means to remove a part or parts and to put in or attach a different part or parts.
“Overhaul” means to tear down an assembly, to inspect all its parts, and to rebuild the assembly, replacing parts where necessary.

STATEMENT OF THE CONSIDERATIONS INVOLVED IN THE ISSUANCE OF SUPPLEMENTARY SERVICE REGULATION 49 TO RMFR 165
Automotive repair service labor charges are characteristically priced upon the basis of the time required for performance of a given, operation. Repair shops usually price either upon the basis of time used on individual jobs or upon the basis of time-studies for given operations as listed in flat rate manuals or labor schedules. Such shops (with minor exceptions) bill their customers for labor by multiplying their customer’s hourly rate by the actual hours of time or by the hours of time set forth in the manual or schedule.
To the extent that “actual” time (as distinguished from time specified in a flat rate manual or labor schedule) has been used as the basis for pricing automotive repair services, adequate compliance with the services regulation has not been secured. In many such cases, consumers have been charged for more time than was usedi The accompanying regulation is calculated to check this practice insofar as many standard operations are concerned, while at the same time recognizing a pricing method long familiar to the automotive repair trade as reflected in the use of flat rate manuals or labor schedules for standard operations.
The regulation limits the time for which a customer may be charged for certain common automotive repair services for specified makes of automobiles. The listed operations correspond to those customarily used in the trade, excépt for such minor changes as are required for uniformity. The time allowances follow as closely as possible those determined in the base period by the automobile manufacturers to be generally adequate for the performance of the operations.' These allowances, in the Administrator’s opinion, are representative of the times customarily required to complete the. operations specified, and when ap
plied to customer’s hourly rates established for individual repair shops under the services regulation, will result in priées which are generally fair and equitable.
In any case where a person has a fixed (dollars-and-cents) charge for an operation listed in the regulation, he must compare that charge with the one resulting from multiplication of his customer’s hourly rate by the time specified in the regulation. He must then charge no more than the lower of the two figures for that operation. If any person supplying a service listed in the regulation has not established a customer’s hourly rate, he must apply to OPA under Section 5 of RMPR 165 for the establishment of such a rate, to be used in determining a price for that service.
The regulation also requires persons supplying any of the specific, services listed therein to give their customers informative invoices. A salient feature of this provision, and of the regulation generally, is that a practicable means will for the first time be afforded the customer to ascertain the correctness of charges for automotive repair work. The average customer is unfamiliar with the technicalities of automotive repair work and has little knowledge of the manner in which it is priced. The regulation will help to remedy a condition which has hitherto constituted a marked impediment to price control.
It is contemplated that other standard operations will be added to the list which appears in the regulation in order to make it an ever more effective instrument of price control.
The regulation requires continuance of a seller’s previous pricing practices as authorized by RMPR 165, For example, , he must adhere to his base period pricing policy, if fie had one, of giving discounts or price differentials; he must re
tain his pricing policy as far as multiple operations are concerned; etc.
Automotive repair services not listed in the regulation continue to be priced under RMPR 165. With respect to such services the regulation specifies the information to appear on the sales slip or receipt if a customer requests one; and it also provides that if a flat rate manual or labor schedule is used to price the service, the manual or schedule must on request be made available for the customer’s inspection.
All provisions of the regulation and their effect upon business practices, cost practices or means or aids to distribution in the industry affected have, been carefully considered. No provisions which might have the effect of requiring, a change in such practices, means, aids or methods established in the automotive repair trade are included in the regulation unless such provisions have been found necessary to achieve effective price control. To the extent that the provisions of this regulation compel or may operate to compel changes in business practices, cost practices or methods, or means or aids to distribution established in the industry such provisions are necessary to prevent circumvention or evasion of RMPR 165 or the Emergency Price Control Act of 1942, as amended.
Insofar as the provisions of this regulation use specifications and standards which were not, prior to such use, in general use in the trade or industry affected, or insofar as their use was not lawfully required by another Government agency, it is determined, with respect to such standardization, that no practicable alternative exists for securing effective price control with respect to the services subject to this regulation.
