                    <P>In this rule, the Bureau of Industry and Security (BIS) amends the Export Administration Regulations (EAR) by adding 29 entries (26 entities and 3 addresses) to the Entity List under the destinations of People's Republic of China (China) (19), Turkey (9), and the United Arab Emirates (UAE) (1). These entities have been determined by the U.S. Government to be acting contrary to the national security or foreign policy interests of the United States.</P>

                <HD SOURCE="HD1">Background</HD>
                <P>
                    The Entity List (supplement no. 4 to part 744 of the EAR (15 CFR parts 730-774)) identifies entities for which there is reasonable cause to believe, based on specific and articulable facts, that the entities have been involved, are involved, or pose a significant risk of being or becoming involved in activities contrary to the national security or foreign policy interests of the United States, pursuant to § 744.11(b). The EAR imposes additional license requirements on, and limit the availability of, most license exceptions for exports, reexports, and transfers (in-country) when a listed entity is a party to the transaction. The license review policy for each listed entity is identified in the “License Review Policy” column on the Entity List, and the impact on the availability of license exceptions is described in the relevant 
                    <E T="04">Federal Register</E>
                     document that added the entity to the Entity List. The Bureau of Industry and Security (BIS) places entities on the Entity List pursuant to part 744 (Control Policy: End-User and End-Use Based) and part 746 (Embargoes and Other Special Controls) of the EAR.
                </P>
                <P>Entity List license requirements and other Entity List restrictions also apply to any foreign entity that is owned, directly or indirectly, individually or in aggregate, 50 percent or more by one or more listed entities. Exclusions to this rule will be identified by specifying in the relevant entry on the Entity List that the 50 percent ownership rule does not apply to any foreign affiliate owned by a particular listed entity or that a specific foreign affiliate is excluded. For any foreign entity that is owned, directly or indirectly, individually or in aggregate, 50 percent or more by one or more listed entities with different Entity List license requirements, the most restrictive of those Entity List license requirements apply to that foreign entity. If an exporter, reexporter, or transferor cannot determine the ownership percentage of a foreign entity that is an entity owned by one or more listed entities, they must resolve the Red Flag or obtain a license from BIS prior to proceeding with the export, reexport, or transfer (in-country), unless a license exception is available (see Red Flag 29 in supplement no. 3 to part 732). The End-User Review Committee (ERC), composed of representatives of the Departments of Commerce (Chair), State, Defense, Energy and, where appropriate, the Treasury, makes all decisions regarding additions to, removals from, or other modifications to the Entity List. The ERC makes all decisions to add an entry to the Entity List by majority vote and makes all decisions to remove or modify an entry by unanimous vote.</P>
                <HD SOURCE="HD2">Additions to the Entity List</HD>
                <P>
                    The ERC determined to add Goodview Global, under the destination of China, to the Entity List. This entity is part of an illicit procurement network that supplies components, including UAV components, to front companies of the Islamic Revolutionary Guard Corps' Qods Force (IRGC-QF). In 2007, the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC) sanctioned the IRGC-QF pursuant to E.O. 13224, 
                    <E T="03">Designating Cartels and Other Organizations as Foreign Terrorist Organizations and Specially Designated Global Terrorists,</E>
                     for providing material support to the Taliban and other terrorist organizations. The illicit procurement of UAV and other component parts and the supplying of those parts to IRGC-QF-affiliated companies is contrary to the national security and foreign policy interests of the United States under § 744.11 of the EAR. This entity is added with a license requirement for all items subject to the EAR, and licenses will be reviewed under a presumption of denial.
                </P>
                <P>The ERC determined to add Atadoruk Havacilik Savunma Sanayi Ticaret Limited Sirketi; Business Metal Sanayi Ve Dis Ticaret Limited Sirketi; DBC Makina Sanayi ve Ticaret A.S.; Ercetin Is Makinalari Yedek Parcalari Insaat Ve Dis Ticaret Limited Sirketi; PMR Teknik Makine Ticaret Limited Sirketi; UMS Ankara Kalibrasyon Mühendislik Müusavirlik Mümessillik Sanayi Ve Ticaret Limited Sirketi; and Yant Insaat Gida Turizm Sanayi Dis Ticaret Limited Sirketi, under the destination of Turkey, to the Entity List. These additions are being made based on information indicating that these companies divert U.S.-origin items to Iran, including to parties on the BIS Entity List and on OFAC's Specially Designated Nationals (SDN) List. Iran has been subject to comprehensive sanctions and export controls by the United States for decades and, pursuant to § 746.7 of the EAR, most items on the Commerce Control List, and certain EAR99 items, require a license or other authorization from BIS for export, reexport, or in-country transfer to or within Iran. The diversion of U.S.-origin items in contravention of these controls is contrary to U.S. national security and foreign policy interests under § 744.11 of the EAR. A license is required for all items subject to the EAR. License applications will be reviewed under a presumption of denial.</P>
                <P>
                    The ERC determined to add TGB Aviation, under the destination of

                    Turkey, to the Entity List. This entity is associated with the transshipment of U.S.-origin aircraft components into Iran. This transshipment network is connected to Iran Aircraft Manufacturing Industries (HESA), an entity designated by the OFAC as an SDN. This activity is contrary to the national security and foreign policy interests of the United States under § 744.11 of the EAR. These entities will be added with a license requirement for all items subject to the EAR and licenses will be reviewed under a presumption of denial.
                </P>
                <P>The ERC determined to add Sisdoz Aritma Ve Pompa Teknolojileri Sanayi Ticaret Anonim Sirketi, under the destination of Turkey, and Royal Impact Trading L.L.C., under the destination of the UAE, to the Entity List. These additions are being made because these entities have diverted U.S.-origin items to Iran, including items classified under Export Control Classification Number (ECCN) 2B350. Iran has been subject to comprehensive sanctions and export controls by the United States for decades, including pursuant to § 746.7 of the EAR. Most items on the Commerce Control List, and certain EAR99 items, require a license or other authorization from BIS for export, reexport, or in-country transfer to or within Iran. Diversion of U.S.-origin items in contravention of these controls is contrary to U.S. national security and foreign policy interests under § 744.11 of the EAR. A license is required for all items subject to the EAR, and license applications will be reviewed under a presumption of denial.</P>
                <P>The ERC determined to add Arrow China Electronics Trading Co., Ltd.; Arrow Electronics (Hong Kong) Co., Ltd.; Beijing Kevins Technology Development Co., Ltd.; Beijing Plenary Technology Co., Ltd.; Beijing Rageflight Technology Co., Ltd.; Gansu Shuili Hoisting Equipment Co., Ltd.; Jinan Xin Yin Bo Electronic Equipment Co. Ltd.; Schmidt &amp; Co., (HK) Ltd.; Shangdong Xin Yin Bo IOT Technology Co. Ltd.; and Shanghai Sisheng Power Control Technology Co., Ltd., under the destination of China, to the Entity List. Since 2017, nations located in the Gulf and Middle East regions have recovered numerous weaponized unmanned aircraft systems (UAS) operated by Iranian proxies, including Houthi militants. Exploitation of the recovered UAS debris identified multiple U.S.-origin electronic components. The addition of these ten entities is based on information indicating that these entities facilitated the purchase of some of these electronic components. These activities are contrary to the national security and foreign policy interests of the United States. These entities are added with a license requirement for all items subject to the EAR and license applications will be reviewed under a presumption of denial.</P>
                <P>The ERC determined to add five entities to the Entity List under the destination of China: Easy Fly Intelligent Technology Co., Ltd; Feng Bao Trading Hong Kong Ltd; Feng Bao Electronic Information Technology (Shanghai) Co., Ltd; Shanghai Bitconn Electronics Co., Ltd.; and Shanghai Langqing Electronic Technology Co. These additions are being made based on information indicating that around October 7, 2023, Israel Defense Forces recovered numerous weaponized unmanned aircraft vehicles (UAVs) operated by Iranian proxies, including Hamas militants. Exploitation of the recovered UAV debris identified multiple U.S.-origin electronic components. Information indicates that these entities facilitated the purchase and procurement of some of these electronic components. The procurement of U.S.-origin electronic components for Iranian proxies is contrary to U.S. national security and foreign policy interests under § 744.11 of the EAR. A license is required for all items subject to the EAR. License applications will be reviewed under a presumption of denial.</P>
                <P>The ERC determined to add three addresses, all under the destination of China, to the Entity List. These addresses are denoted as Address 16, 17, and 18. These addresses are associated with the procurement network of Emily Liu, an individual previously designated by OFAC for having provided and/or attempted to provide support for Iran's Shiraz Electronics Industries (SEI). OFAC designated SEI as an SDN for being owned or controlled by Iran's Ministry of Defense and Armed Forces Logistics (MODAFL). These activities are contrary to U.S. national security and foreign policy interests under § 744.11 of the EAR. Licenses will be required for all entities at these addresses for all items on the Commerce Control List and EAR99 items listed in supplement no. 7 to part 746 of the EAR. License applications will be reviewed with a license review policy of presumption of denial.</P>

                    Shipments of items removed from eligibility for a License Exception or export, reexport, or transfer (in-country) without a license (NLR) as a result of this regulatory action that were en route aboard a carrier to a port of export, reexport, or transfer (in-country), on October 8, 2025, pursuant to actual orders for export, reexport, or transfer (in-country) to or within a foreign destination, may proceed to that destination under the previous eligibility for a License Exception or

                    export, reexport, or transfer (in-country) without a license (NLR), provided the export, reexport, or transfer (in-country) is completed no later than on November 7, 2025.
                </P>
                <HD SOURCE="HD1">Export Control Reform Act of 2018</HD>
                <P>On August 13, 2018, the President signed into law the John S. McCain National Defense Authorization Act for Fiscal Year 2019, which included the Export Control Reform Act of 2018 (ECRA) (50 U.S.C. 4801-4852). ECRA provides the legal basis for BIS's principal authorities and serves as the authority under which BIS issues this rule. In particular, Section 1753 of ECRA (50 U.S.C. 4812) authorizes the regulation of exports, reexports, and transfers (in-country) of items subject to U.S. jurisdiction. Further, Section 1754(a)(1)-(16) of ECRA (50 U.S.C. 4813(a)(1)-(16)) authorizes, inter alia, establishing and maintaining a list of foreign persons and end-uses that are determined to be a threat to the national security and foreign policy of the United States pursuant to the policy set forth in Section 1752(2)(A), and restricting exports, reexports, and in-country transfers of any controlled items to any foreign person or end-use so listed; apprising the public of changes in policy, regulations, and procedures; and any other action necessary to carry out ECRA that is not otherwise prohibited by law. Pursuant to Section 1762(a) of ECRA (50 U.S.C. 4821(a)), these changes can be imposed in a final rule without prior notice and comment.</P>
                <HD SOURCE="HD1">Rulemaking Requirements</HD>
                <P>1. This rule has been determined to be not significant for purposes of Executive Order 12866. This final rule is exempt from E.O. 14192 because it is being issued with respect to a national security function of the United States.</P>
                <P>
                    2. Notwithstanding any other provision of law, no person is required to respond to or be subject to a penalty for failure to comply with a collection of information, subject to the requirements of the Paperwork Reduction Act of 1995 (44 U.S.C. 3501 
                    <E T="03">et seq.</E>
                    ) (PRA), unless that collection of information displays a currently valid Office of Management and Budget (OMB) Control Number. This regulation involves an information collection approved by OMB under control number 0694-0088, Simplified Network Application Processing System. BIS does not anticipate a change to the burden hours associated with this collection as a result of this rule. Because a notice of proposed rulemaking and an opportunity for public comment are not required to be given for this rule by 5 U.S.C. 553, or by any other law, the analytical requirements of the Regulatory Flexibility Act, 5 U.S.C. 601,

                <P>
                    Atlantic BFT fisheries are managed under the 2006 Consolidated HMS Fishery Management Plan (HMS FMP) and its amendments, pursuant to the Magnuson-Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act; 16 U.S.C. 1801 
                    <E T="03">et seq.</E>
                    ) and consistent with the Atlantic Tunas Convention Act (ATCA; 16 U.S.C. 971 
                    <E T="03">et seq.</E>
                    ). HMS implementing regulations are at 50 CFR part 635. Section 635.27(a) divides the U.S. BFT quota, established by the International Commission for the Conservation of Atlantic Tunas (ICCAT) and as implemented by the United States among the various domestic fishing categories, per the allocations established in the HMS FMP and its amendments. NMFS is required under the Magnuson-Stevens Act at 16 U.S.C. 1854(g)(1)(D) to provide U.S. fishing vessels with a reasonable opportunity to harvest quotas under relevant international fishery agreements such as the ICCAT Convention, which is implemented domestically pursuant to ATCA.
                </P>
                <P>Under § 635.28(a)(1), NMFS files a closure action with the Office of the Federal Register for publication when a BFT quota (or subquota) is reached or is projected to be reached. Retaining, possessing, or landing BFT under that quota category is prohibited on or after the effective date and time of a closure action for that category until the opening of the relevant subsequent quota period or until such date as specified.</P>

                <P>As described in § 635.27(a), the current baseline U.S. BFT quota is 1,316.14 metric tons (mt) (not including the 25 mt ICCAT allocated to the United States to account for bycatch of BFT in pelagic longline fisheries in the Northeast Distant Gear Restricted Area per § 635.27(a)(3)). The General category baseline quota is 710.7 mt. The General category baseline quota is suballocated to time periods. Relevant to this action, the baseline subquota for the October through November time period is 92.4 mt.</P>
                <HD SOURCE="HD1">Closure of the October Through November 2025 BFT General Category Fishery</HD>
                <P>As described above, the baseline subquota for the October through November time period is 92.4 mt. However, landings estimates from 2024 indicate that the General, Harpoon, and Angling category quotas were exceeded. Additionally, the 2025 General category January through March time period subquota was exceeded. Thus, under § 635.27(a)(9) and consistent with ICCAT requirements, in order to ensure the overall U.S. quota is not exceeded, NMFS expects to take action later this year to reduce the various category quotas consistent with the estimated overharvest. While that action is not yet final, NMFS must still consider the implications of reduced quotas for various categories, including the General category. If both the 2024 and 2025 U.S. adjusted quotas are exceeded, under ICCAT requirements, the United States could be required to pay back 125 percent of the second year's (2025) overharvest in 2026.</P>
                <P>
                    Based on that consideration and the current landings data, as well as average catch rates and anticipated fishing conditions, NMFS has determined that the October through November time period subquota is projected to be reached and exceeded shortly. Therefore, retaining, possessing, or landing large medium or giant (
                    <E T="03">i.e.,</E>
                     measuring 73 inches (185 cm) CFL or greater) BFT by persons aboard vessels permitted in the Atlantic Tunas General category and HMS Charter/Headboat permitted vessels (while fishing commercially) must cease at 11:30 p.m., local time on October 7, 2025.
                </P>
                <P>Pursuant to Executive Order 14276, “Restoring American Seafood Competitiveness,” (April 17, 2025), NMFS is making prudent efforts to identify strategies to expand fishing opportunities within the requirements of the Magnuson-Stevens Act. Should NMFS determine that reasonable fishing opportunities are available at a later date, NMFS may reopen the October through November fishery. The BFT General category will automatically reopen December 1, 2025, for the December time period. This action applies to Atlantic Tunas General category (commercial) permitted vessels and HMS Charter/Headboat permitted vessels with a commercial sale endorsement when fishing commercially for BFT and is taken consistent with the regulations at § 635.28(a)(1).</P>
                <HD SOURCE="HD1">Waiver for Remaining October Through November RFDs</HD>
                <P>On May 31, 2024 (89 FR 47095), NMFS published a final rule, which among other things, implemented RFDs every Tuesday, Friday, and Saturday from July 1 through November 30 of each year. Since the fishery will be closed for the remainder of the October through November time period, NMFS has decided to waive the previously scheduled RFDs for the remainder of that time period.</P>
                <P>
                    With the RFDs waived during a closure, consistent with § 635.23(a)(7), fishermen aboard General category permitted vessels and HMS Charter/Headboat permitted vessels may tag and release BFT of all sizes, subject to the requirements of the catch-and-release and tag-and-release programs at § 635.26. All BFT that are released must be handled in a manner that will maximize their survival, and without removing the fish from the water, consistent with requirements at § 635.21(a)(1).                     NMFS will continue to monitor the BFT fisheries closely. Per § 635.5(b)(2)(i)(A), dealers are required to submit landing reports within 24 hours of a dealer receiving BFT. Late reporting by dealers compromises NMFS' ability to timely implement actions such as quota and retention limit adjustments, as well as closures, and may result in enforcement actions. Additionally, and separate from the dealer reporting requirement, General category and HMS Charter/Headboat permitted vessel owners are required per § 635.5(a)(4) to report their own catch of all BFT retained or discarded dead within 24 hours of the landing(s) or end of each trip, by accessing

                     using the HMS Catch Reporting app, or calling 888-872-8862 (Monday through Friday from 8 a.m. until 4:30 p.m. Eastern Time).
                </P>
                <P>
                    After the fishery reopens on December 1, depending on the level of fishing effort and catch rates of BFT, NMFS may determine that additional adjustments are necessary to ensure available subquotas are not exceeded or to enhance scientific data collection from, and fishing opportunities in, all geographic areas as specified under § 635.27(a)(7). If needed, subsequent adjustments will be published in the 
                    <E T="04">Federal Register</E>
                    . In addition, fishermen may access

                     for updates on quota monitoring and inseason adjustments.
                </P>
                <HD SOURCE="HD1">Classification</HD>
                <P>NMFS issues this action pursuant to section 305(d) of the Magnuson-Stevens Act (16 U.S.C. 1855(d)) and regulations at 50 CFR part 635 and this action is exempt from review under Executive Order 12866.</P>
                <P>The Assistant Administrator for NMFS (AA) finds that pursuant to 5 U.S.C. 553(b)(B), there is good cause to waive prior notice of, and an opportunity for public comment on, this action because it is impracticable and contrary to the public interest for the following reasons. Specifically, the regulations implementing the 2006 Consolidated HMS FMP and amendments provide for inseason retention limit adjustments and fishery closures to respond to the unpredictable nature of BFT availability on the fishing grounds, the migratory nature of this species, and the regional variations in the BFT fishery. Providing prior notice and an opportunity to comment is impracticable and contrary to the public interest as this fishery is currently underway and, based on the most recent landings information, the 2025 October through November subquota is projected to be reached shortly. Delaying this action could result in BFT landings that exceed the final 2025 General category quota, which may result in future potential quota reductions for other BFT categories or the General category quota, depending on the magnitude of a potential October through November subquota overharvest. NMFS notes that the public had an opportunity to comment on the underlying rulemakings that established the U.S. BFT quota and the inseason adjustment and closure criteria.</P>

                <P>Under TSCA section 6(a) (15 U.S.C. 2605(a)), if the Agency determines through a TSCA section 6(b) risk evaluation that the manufacture, processing, distribution in commerce, use or disposal of a chemical substance presents an unreasonable risk of injury to health or the environment, EPA must by rule apply one or more requirements listed in TSCA section 6(a)(1)-(7) to the extent necessary so that the chemical substance no longer presents such risk.</P>
                <HD SOURCE="HD2">C. What action is the Agency taking?</HD>
                <P>On December 18, 2024, EPA released the final risk management rule for CTC titled “Carbon Tetrachloride (CTC); Regulation Under the Toxic Substances Control Act (TSCA)” (89 FR 103512 (FRL-8206-02-OCSPP)) (hereinafter “CTC final rule”). Following its publication, EPA received several petitions for review related to the rule. These petitions for review were consolidated in the U.S. Court of Appeals for the Eighth Circuit. On September 12, 2025, EPA announced its decision to reconsider the CTC final rule through further rulemaking. In that announcement, the Agency expressed its intent to open a comment period on the final rule. EPA is now soliciting early stakeholder input regarding its intended reconsideration of the rule. EPA invites public comment on requirements and implementation of the CTC final rule (89 FR 103512), particularly on the topics described in Unit II. The information received in response to this notice will inform EPA's considerations of these provisions.</P>

                <P>
                    MCC evaluates the policy performance of all candidate countries and statutorily-prohibited countries by dividing them into separate income categories for the purposes of creating “scorecards”, which utilize objective and quantitative data to measure countries' policy performance on statutorily mandated criteria. These scorecard categories are used to account for the income bias that occurs when countries with more per capita resources perform better than countries with fewer. Appendix B lists all candidate countries and statutorily-prohibited countries for scorecard evaluation purposes and their income category. In FY 2026, those scorecard evaluation income categories

                         The first two income groups align with the definition of low income and lower middle countries using the historical International Development Association (IDA) threshold published by the World Bank. The third category was added in FY 2025 by the passage of the Millennium Challenge Corporation Candidate Country Reform Act and includes a subset of upper middle income countries.

                <P>• Countries with gross national income (GNI) per capita of $2,155 or less;</P>
                <P>• Countries with GNI per capita between $2,156 and $4,495; and</P>
                <P>• Countries with GNI per capita between $4,496 and $7,855.</P>
                <HD SOURCE="HD1">(II) How does the Board evaluate these countries?</HD>
                <HD SOURCE="HD2">A. Overall Evaluation</HD>
                <P>By statute, when evaluating candidate countries for compact eligibility, the Board assesses (1) performance on a set of statutorily mandated eligibility criteria, (2) the opportunity to invest in shared prosperity and promote economic growth, and (3) the availability of MCC funds.</P>
                <HD SOURCE="HD3">(1) Policy Performance on Statutorily Mandated Eligibility Criteria</HD>
                <P>
                    By statute, the Board relies, to the maximum extent possible, upon the best-available objective and quantifiable policy performance indicators. These indicators evaluate country policy performance in a comparable, cross-country fashion. Comprised of 22 third-party indicators in the statutory categories of ruling justly, encouraging economic freedom, and investing in people, MCC scorecards are created for all candidate countries and statutorily-prohibited countries. Appendix C lists the 22 indicators that comprise the MCC scorecards and their relationship to the statutory criteria. MCC also routinely conducts reviews of its indicators to ensure that current indicators remain relevant, effective, and transparent in measuring the statutorily mandated eligibility criteria. This includes the conduct of rigorous reviews to ensure MCC is employing the best data available. MCC is committed to continue updating and revising data annually to ensure continued alignment with statutory principles and administration priorities. To “pass” most indicators on the scorecard, a country's score on each indicator must be above the median score 
                    <E T="03">in its income group</E>
                     (as defined above for scorecard evaluation purposes). For the inflation, government accountability, and personal freedom indicators, however, MCC has established minimum or maximum scores for “passing.” In particular, the Board considers whether a country:
                </P>
                <P>• passes at least 11 of the 22 indicators,</P>
                <P>• passes the Personal Freedom indicator; and</P>
                <P>• passes either the Control of Corruption indicator or Government Accountability indicator.</P>
                <P>
                    While satisfaction of all three aspects means a country is termed to have “passed” the scorecard, the Board also considers whether the country performs “substantially worse” in any one policy

                    category than it does on the scorecard overall.
                </P>
                <P>
                    The mandatory passing of the Personal Freedom indicator is called the Personal Freedom “hard hurdle” on the scorecard, while the mandatory passing of either the Control of Corruption or Government Accountability indicator is called the Control of Corruption and Accountability “hard hurdle.” Not passing 
                    <E T="03">either</E>
                     “hard hurdle” results in not passing the scorecard overall, regardless of whether at least 11 of the 22 total indicators are passed.
                </P>
                <P>
                    • 
                    <E T="03">Personal Freedom “hard hurdle:”</E>
                     This hurdle sets a minimum bar for personal freedom below which the Board will not consider a country for compact eligibility. This indicator creates an incentive for countries to undertake reform, recognizes the relationship between freedom and prosperity, and holds MCC to the high standard of working with the best governed countries.
                </P>
                <P>
                    • 
                    <E T="03">Control of Corruption and Accountability “hard hurdle:”</E>
                     Corruption in any country is an unacceptable tax on economic growth and an obstacle to private sector investment. The Control of Corruption and Accountability “hard hurdle” helps ensure that MCC works with countries committed to combatting corruption and strengthening transparent and accountable governance. When a candidate country only passes one of the two indicators comprising the hurdle (instead of both), the Board closely examines the reason it is not passing one of the indicators to understand the broader governance environment and trajectory of the country. This includes consultation with U.S. Embassy officials, interagency partners, and other experts.
                </P>
                <P>
                    A country's scorecard performance is a key factor the Board uses to select countries for an MCC program. The Board, however, also recognizes that even the best-available data have inherent challenges. Data gaps, real-time events versus data lags, the absence of narratives and nuanced detail, and other data features affect each indicator. As a result, the Board uses its judgment to interpret policy performance as measured by the scorecards. The Board also consults other sources of information to enhance its understanding of country context (
                    <E T="03">e.g.,</E>
                     specific policy issues related to trade, U.S. business opportunities, other U.S. engagement with the country, financial sector performance, and security/foreign policy concerns). The Board uses its judgement on how best to weigh such information in assessing overall policy performance and making a final determination.
                </P>
                <HD SOURCE="HD3">(2) The Opportunity To Advance America First Priorities and Invest in Shared Prosperity</HD>
                <P>Beyond the scorecards, the Board considers a range of information sources depending on the country. Examples include sources that provide a better understanding of:</P>
                <P>• a country's economy and business enabling environment;</P>
                <P>• market fundamentals, trade dynamics, critical supply chains, and opportunities to facilitate U.S. business investments;</P>
                <P>• the potential for the private sector to lead investment and growth; and</P>
                <P>• the control of corruption and rule of law.</P>
                <P>Where applicable, the Board also considers MCC's own experience and ability to work with a country to promote investments that advance our shared prosperity, including by considering MCC's core areas of expertise and skills versus a country's needs, and MCC's capacity to work with a country.</P>
                <P>This information provides greater clarity regarding the opportunity for MCC investments to make America safer, stronger, and more prosperous.</P>
                <HD SOURCE="HD3">(3) The Availability of MCC Funds</HD>
                <P>The Board considers the availability of funds when evaluating countries. This includes consideration of MCC's pipeline of countries in program development, implementation, and closure. Consequently, the Board factors in MCC's overall portfolio when making its selection decisions given current and projected funding availability.</P>
                <STARS/>
                <P>The following subsections describe how the Board applies each of these three statutorily-mandated factors to: selection of countries for compacts, selection of countries for subsequent compacts, selection of countries for the threshold program, and selection of countries for concurrent compacts. A note follows on considerations for countries that might transition out of MCC's candidate pool after initial selection.</P>
                <HD SOURCE="HD2">B. Evaluation for Selection of a Country for a First Compact</HD>
                <P>When selecting countries for a compact, the Board looks at the statutorily-mandated aspects described in the previous section, including a country's performance on the MCC scorecard, evidence of a country's commitment to ensuring a positive enabling environment for economic growth and private sector investment, including for U.S. businesses, and the availability of funding.</P>
                <P>At a minimum, the Board considers whether a country passes its scorecard. The Board also examines supporting evidence that a country's commitment to good governance, economic freedom, and investing in its people is on a sound footing and performance is on a positive trajectory (especially on the “hard hurdles” of Personal Freedom and Control of Corruption and Accountability), and that MCC will have the funds to support a meaningful compact with that country. Where applicable, previous threshold program information is also considered. For those countries currently developing or implementing a threshold program, the Board examines the progress the country has made toward substantial implementation.</P>
                <HD SOURCE="HD2">C. Evaluation for Selection of a Country for a Subsequent Compact</HD>
                <P>Section 609(l) of the Act authorizes MCC to enter into “one or more subsequent Compacts.” MCC does not consider the eligibility of a country for a subsequent compact before the country has completed its compact or is within 18 months of compact end date. Selection for a subsequent compact is not automatic and is intended for countries that (1) exhibit successful performance on their previous compact(s); (2) exhibit improved policy performance on the eligibility criteria assessed by the scorecard during the partnership; and (3) exhibit a commitment to further sector reform.</P>
                <HD SOURCE="HD3">(1) Successful Implementation of the Previous Compact(s)</HD>
                <P>To evaluate any previous compact's success, the Board examines whether the compact succeeded within its budget and time limits, in particular by looking at three aspects of each compact program:</P>
                <P>
                    • 
                    <E T="03">The degree to which there is evidence of strong political will and management capacity;</E>
                </P>
                <P>
                    • 
                    <E T="03">The degree to which the country has exhibited commitment and capacity to achieve program result</E>
                    s; and
                </P>
                <P>
                    • 
                    <E T="03">The degree to which the country has implemented the compact in accordance with MCC's core policies and standards.</E>
                </P>
                <P>Appendix D provides details regarding the information types examined and sources used.</P>
                <HD SOURCE="HD3">(2) Improved Policy Performance</HD>
                <P>
                    The Board also expects the country to improve its overall policy performance on the eligibility criteria assessed by the

                    scorecard during the partnership and to pass the scorecard in the year of selection for the subsequent compact. The Board considers the trajectory of a country's overall policy performance on key indicators over time.
                </P>
                <P>While the Board expects the country to be passing its scorecard, the Board also examines other sources of information to understand the nuance and reasons behind scorecard performance over time. The Board also consults other information sources to look at policy performance over time in areas not covered by the scorecard, but that the Board deems to be important (such as trade, U.S. business opportunities, critical supply chains, and foreign policy concerns).</P>
                <HD SOURCE="HD3">(3) A Commitment To Further Sector Reform</HD>
                <P>The Board expects subsequent compacts to endeavor to tackle policy reforms necessary to unlock an identified constraint to economic growth. Consequently, the Board considers MCC's own experience during the previous compact in considering how committed the country is to advancing investments in shared prosperity and economic growth. This includes assessing:</P>
                <P>• The country's delivery of policy reform during the previous compact (as described above);</P>
                <P>• Expectations of the country's ability and willingness to continue sector policy reform in a subsequent compact;</P>
                <P>• The opportunity to invest in shared prosperity and advance America First priorities (as outlined in A.2 above);</P>
                <P>• The prior compact's relative success overall (as discussed above), and how well future funding can be leveraged for impact, given the country's experience in the previous compact.</P>
                <HD SOURCE="HD2">D. Evaluation for Concurrent Compacts</HD>
                <P>Section 609(k) of the Act authorizes MCC to enter into one additional concurrent compact with a country if one or both of the compacts with the country is for the purpose of regional economic integration, increased regional trade, or cross-border collaborations.</P>
                <P>The fundamental criteria and process for the selection of countries for such compacts remains the same as those for the selection of countries for non-concurrent compacts: countries continue to be evaluated and selected individually, as described in sections II.A, II.B, II.C, and II.F.</P>
                <P>Section 609(k) also requires as a precondition for a concurrent compact that the Board determine that the country is making “considerable and demonstrable progress in implementing the terms of the existing Compact and supplementary agreements thereto.” This statutory requirement is consistent with prior Board practice regarding the selection of a country for a non-concurrent compact. For a country where a concurrent compact is contemplated, the Board will take into account whether there is clear evidence of success, as relevant to the phase of the current compact. Among other information, the Board will examine the evaluation criteria described in Section II.C.1 above.</P>
                <P>In addition to providing information to the Board so it can make its determination regarding the country's progress in implementing its current compact, MCC provides the Board with additional information relating to the potential for regional economic integration, increased regional trade, or cross-border collaborations for any country being considered for a concurrent compact. This information may include items such as:</P>
                <P>• The current state of a country's regional integration, such as common financial and political dialogue frameworks, integration of productive value chains, and cross-border flows of people, goods, and services.</P>
                <P>• The current and potential level of trade between a country and its neighbors, including analysis of trade flows and unexploited potential for trade, and an assessment of the extent and significance of tariff and non-tariff barriers, including information regarding the patterns of trade.</P>
                <P>• The potential gains from cross-border cooperation between a country and its neighbors to alleviate bilateral and regional bottlenecks to economic growth and poverty reduction, such as through physical infrastructure or coordinated policy and institutional reforms.</P>
                <HD SOURCE="HD2">E. Evaluation for Threshold Program Assistance</HD>
                <P>The Board also evaluates countries for participation in the threshold program. Threshold programs provide assistance to candidate countries exhibiting a significant commitment to meeting the criteria described in the previous subsections but failing to meet such requirements. Specifically, in examining a candidate country's policy performance, the opportunity to advance shared prosperity and generate economic growth, and available funds, the Board will consider whether a country appears to be on a trajectory to becoming viable for compact eligibility in the medium or short term.</P>
                <HD SOURCE="HD2">F. A Note on Potential Transition Out of MCC's Candidate Pool After Initial Selection</HD>
                <P>Some candidate countries may have a high per capita income or a high growth rate that implies there is a chance they could transition out of MCC's candidate pool during the life of an MCC partnership. It is not possible to accurately predict if or when such a transition may occur.</P>
                <P>Nonetheless, such countries may have more resources at their disposal for funding their own growth. As a result, in addition to using the regular selection criteria described in the previous sections, the Board will use its discretion to assess both the need and the opportunity presented by partnering with such a country, in order to ensure that MCC's scarce grant funds are directed appropriately.</P>
                <P>Accordingly, if a candidate country with a high probability of transitioning out of MCC's candidate pool is under consideration for selection, the Board will examine additional data and information related to:</P>
                <P>• Whether the country faces significant challenges accessing other sources of development financing (such as international capital, domestic resources, and other donor assistance) and, if so, whether MCC grant financing would be an appropriate tool;</P>
                <P>• Whether there is a clear and strategic opportunity for MCC to assist the country through investments that spur economic growth and shared prosperity;</P>
                <P>• Whether the country demonstrates particularly strong policy performance; and</P>
                <P>• Whether MCC can reasonably expect that the country would contribute a significant amount of funding to the compact.</P>
                <P>Should a country eventually transition out of MCC's candidate pool during compact development, continuing compact development beyond that point would then be at the Board's discretion.</P>
                <HD SOURCE="HD1">Appendix A: Statutory Basis for This Report </HD>

                    <P>This report to Congress is provided in accordance with section 608(b) of the Millennium Challenge Act of 2003, as amended (the Act), 22 U.S.C. 7707(b).</P>

                        Section 605 (22 U.S.C. 7704) of the Act authorizes the provision of assistance to countries that enter into a Millennium Challenge Compact with the United States to support policies and programs that advance the progress of such countries in achieving lasting economic growth and poverty reduction.                     <P>(1) The countries that are “candidate countries” for assistance for FY 2026 based on per capita income levels and eligibility to receive assistance under U.S. law and countries that would be candidate countries but for specified legal prohibitions on assistance (section 608(a) of the Act; 22 U.S.C. 7707(a));</P>
                    <P>(2) The criteria and methodology that MCC's Board of Directors (Board) will use to measure and evaluate policy performance of the candidate countries consistent with the requirements of subsections (a) and (b) of section 607 of the Act (22 U.S.C. 7706) in order to determine “eligible countries” from among the “candidate countries” (section 608(b) of the Act; 22 U.S.C. 7707(b)); and</P>
                    <P>(3) The list of countries determined by the Board to be “eligible countries” for FY 2026, with justification for eligibility determination and selection for compact negotiation, including those eligible countries with which MCC will seek to enter into compacts (section 608(d) of the Act; 22 U.S.C. 7707(d)).</P>

                        Since MCC was created, it has relied on the

                         (Atlas method) and the historical ceiling for eligibility as set by the World Bank's International Development Association (IDA) to divide countries into separate income categories for purposes of creating scorecards. These categories are used to account for the income bias that occurs when countries with more per capita resources perform better than countries with fewer. Using the historical IDA eligibility ceiling for the scorecard evaluation groups ensures that the poorest countries compete with their income level peers and are not compared against countries with more resources to mobilize. Following the passage of the Millennium Challenge Corporation Candidate Country Reform Act in FY 2025, MCC began grouping the countries newly added into the income pool by this legislation (countries with GNI per capita above the World Bank's lower middle income/upper middle income country threshold but below the threshold for initiating the International Bank for Reconstruction and Development (IBRD) graduation process) in a third group to maintain this principle of countries competing with their income peers.

                    <P>In FY 2026, MCC will continue to use the historical IDA classifications for eligibility and the lower middle income/upper middle income country threshold to categorize countries in groups for purposes of FY 2026 scorecard comparisons:</P>

The indicators are intended to assess the degree to which the political and economic conditions in a country serve to promote broad-based sustainable economic growth and reduction of poverty and thus provide a sound environment for the use of MCC funds. The indicators are not goals in themselves; rather, they are proxy measures of policies that are linked to broad-based sustainable economic growth. The indicators were selected based on (i) their relationship to economic growth and poverty reduction; (ii) the number of countries they cover; (iii) transparency and availability; and (iv) relative soundness and objectivity. Where possible, the indicators are developed by independent sources.</P>
                    <HD SOURCE="HD1">Ruling Justly</HD>
                    <P>
                        <E T="03">1. Control of Corruption:</E>
                         An index of surveys and expert assessments that rate countries on: “grand corruption” in the political arena; the frequency of petty corruption; the effects of corruption on the business environment; and the tendency of elites to engage in “state capture,” among other things. Pass: Score must be above the median score for the income group.
                    </P>
                    <P>
                        <E T="03">2. Government Accountability:</E>
                         Independent experts rate countries on the prevalence of free and fair electoral processes; political pluralism and participation of all stakeholders; government accountability and transparency; freedom from domination by the military, foreign powers, totalitarian parties, religious hierarchies and economic oligarchies; and the political rights of all groups, among other things. Pass: Score must be above the minimum score of 17 out of 40.

                        <E T="03">6. Rule of Law:</E>
                         An index of surveys and expert assessments that rate countries on the extent to which the public has confidence in and abides by the rules of society; the incidence and impact of violent and nonviolent crime; the effectiveness, independence, and predictability of the judiciary; the protection of property rights; and the enforceability of contracts, among other things. Pass: Score must be above the median score for the income group.

                         An index that rates countries on the time and cost of complying with all procedures officially required for an entrepreneur to start up and formally operate an industrial or commercial business as well as the overall business environment in a country. Pass: Score must be above the median score for the income group.

                        <E T="03">2. Inflation:</E>
                         The most recent average annual change in consumer prices. Pass: Score must be 15 percent or less.
                    </P>

                        <E T="03">3. Regulatory Quality:</E>
                         An index of surveys and expert assessments that rate countries on the burden of regulations on business; price controls; the government's role in the economy; and foreign investment regulation, among other areas. Pass: Score must be above the median score for the income group.

                        <E T="03">4. Trade Policy:</E>
                         A measure of a country's openness to international trade based on weighted average tariff rates and non-tariff barriers to trade. Pass: Score must be above the median score for the income group.
                    </P>

                        <E T="03">5. Women in the Economy:</E>
                         An index that measures the extent to which laws provide men and women equal capacity to generate income or participate in the economy, including factors such as the capacity to access institutions, get a job, register a business, sign a contract, open a bank account, choose where to live, to travel freely, property rights protections, and protections against domestic violence, among others. Pass: Score must be above the median score for the income group.
                    </P>
                    <P>
                        <E T="03">6. Property and Land Rights:</E>
                         An index that rates countries on the extent to which the institutional, legal, and market framework provides secure land tenure and access to land in rural areas and the extent to which all individuals have the right to private property in practice and in law, including measures of intellectual property rights, risk of expropriation, and the quality of contract enforcement. Pass: Score must be above the median score for the income group.
                    </P>
                    <P>
                        <E T="03">7. Access to Credit:</E>
                         An index that ranks countries based on access and use of formal and informal financial services as measured by the number of bank branches and ATMs per 100,000 adults and the share of adults that have an account at a formal or informal financial institution. Pass: Score must be above the median score for the income group.
                    </P>

                        <E T="03">8. Employment Opportunity:</E>
                         Measures the rights of people to work. Pass: Score must be above the median score for the income group.
                    </P>

                        <E T="03">1. Health Expenditures:</E>

                        <E T="03">3. Child Health:</E>

                    The U.S. Secretary of Transportation (Secretary) established the U.S. DOT Advisory Board as a Federal Advisory Committee in accordance with the

                    <FP>During Fire Prevention Week, we call on every household and community to prioritize fire prevention by taking steps that reduce risks and strengthen safety. Americans honor the steadfast courage and dedication of firefighters and first responders across our Nation who protect our lives, property, and natural resources from the devastation of fire. Together, we also renew our commitment to promoting commonsense awareness and preparedness measures to prevent fires—and to keeping the American people safe and secure in the face of disaster.</FP>
                    <FP>In recent years, our Nation has seen the staggering costs of poor fire prevention and disaster preparedness. When wildfires erupted in California earlier this year, sparked by arson and exacerbated by the Green New Scam agenda and disastrous forest management, State and local leaders were left totally unprepared to safeguard our fellow citizens. Hydrants ran dry. Reservoirs were left empty. Due to this incompetent leadership, at least 30 people died, while survivors saw their homes and belongings descend in flames, costing hundreds of billions of dollars in damages.</FP>
                    <FP>To reverse this and similar derelictions, this past June I proudly signed an Executive Order returning common sense to wildfire prevention and response. Among other key actions, the order directs the Secretary of the Interior and the Secretary of Agriculture to consolidate their wildland fire programs, encourages local wildfire preparedness and response, and orders the use of new technology—including artificial intelligence and data sharing—to enhance State and local wildfire identification and response. I also established a Task Force to assess the Federal Emergency Management Agency's ability to address disasters. I also signed an Executive Order to expedite response and recovery efforts for the people of California, including the largest wildfire hazardous waste cleanup in the history of the Environmental Protection Agency.</FP>
                    <FP>This week, we offer our sincere thanks to all the dedicated firefighters and first responders who do not flinch in times of crisis. Without regard for their own safety, they plunge into roaring flames to bring hope to the desperate and comfort to the afflicted. That is why, earlier this year, I was proud to sign a bill into law for permanent pay increases for Federal wildland firefighters. Their courage and service, along with our local first responders, help protect our Nation's bountiful resources and keep our communities strong in times of hardship. We also express our deep appreciation for critical infrastructure personnel and disaster volunteers for their selfless service to their fellow citizens when fires do break out.</FP>
                    <FP>As my Administration works to prevent wildfires, we encourage every family to take measures to avert the risks and damages caused by household fire—including by having a fire escape plan, testing smoke and carbon monoxide alarms on a monthly basis, and identifying potential hazards like unattended cooking, faulty wiring, or overheated appliances.</FP>
                    <FP>
                        This week, we pledge to provide all resources necessary to keep our communities safe when fire blazes—and we express our unending thanks to every

                        heroic first responder who embodies the strength and determination of the American spirit.

                    <FP>NOW, THEREFORE, I, DONALD J.
