Proposed Consent Decree, Clean Air Act Citizen Suit
AGENCY: Environmental Protection Agency (EPA).
ACTION: Notice of proposed consent decree; request for public comment.

SUMMARY: In accordance with the Clean Air Act, as amended (CAA or the
Act), notice is given of a proposed consent decree in Growth Energy v.
Regan, No. 1:22-cv-01191 (D. DC). On April 29, 2022, Plaintiff Growth
Energy filed a complaint in the United States District Court for the
District of Columbia alleging that the Environmental Protection Agency
(EPA or the Agency) failed to perform a non-discretionary duty in
accordance with the Act to establish volumes under the renewable fuel
program for 2023. The proposed consent decree would establish deadlines
for EPA to establish the 2023 renewable fuel program volumes: Signature
of a proposed rule by September 16, 2022, and signature of a final rule
by April 28, 2023.

SUPPLEMENTARY INFORMATION:
I. Obtaining a Copy of the Proposed Consent Decree
The official public docket for this action (identified by Docket ID
No. EPA-HQ-OGC-2022-0437) contains a copy of the proposed consent

II. Additional Information About the Proposed Consent Decree
The proposed consent decree would establish deadlines for EPA to
establish volumes for the renewable fuel program for 2023: September
16, 2022, for EPA to sign a proposed rule, and April 28, 2023, for EPA
to sign a final rule. EPA is obligated to establish the 2023 renewable
fuel program volumes under 42 U.S.C. 7545(o)(2)(B)(ii). For years after
the statutory volumes in 42 U.S.C. 7545(o)(2)(B)(i) cease, the Agency
is statutorily obligated to establish the renewable fuel program
volumes ``no later than 14 months before the first year for which such
applicable volume will apply.'' Under this provision, EPA was required
to establish the volumes for 2023 by October 31, 2021. EPA intends to
establish applicable percentage standards for obligated parties for
2023 in the same rulemaking that establishes volumes for 2023.
In accordance with section 113(g) of the CAA, for a period of
thirty (30) days following the date of publication of this document,
the Agency will accept written comments relating to the proposed
consent decree. EPA or the Department of Justice may withdraw or
withhold consent to the proposed consent decree if the comments
disclose facts or considerations that indicate that such consent is
inappropriate, improper, inadequate, or inconsistent with the
requirements of the Act.

Decree
