SUPPLEMENTARY INFORMATION: The Department of Labor is updating and revising the regulations issued under the Fair Labor Standards Act (FLSA) implementing the exemptions from minimum wage and overtime pay requirements for executive, administrative, professional, outside sales, and computer employees. The Department uses the Employment Information Form to obtain information from complainants regarding FLSA violations; the ICR covers complaints alleging violations of various labor standards that the agency administers and enforces, and will incorporate the provisions in the final rule, ``Defining and Delimiting the Exemptions for Executive, Administrative, Professional, Outside Sales and Computer Employees,'' RIN 1235-AA20, applicable to complaints. OMB asked the Department to resubmit the information collection request upon promulgation of the associated final rule and after considering public comments on the proposed rule. Additionally, this ICR seeks approval for a revision related to the Payroll Audit Independent Determination (PAID) program. OMB authorization cannot be for more than three (3) years and the current approval for this collection is scheduled to expire on December 31, 2019. The DOL seeks to extend PRA authorization for this information collection for three (3) more years, with change to the existing requirements stemming from the PAID program and a revision to the burden requirements stemming from the Final Rule and PAID program. This information collection is subject to the PRA. A Federal agency generally cannot conduct or sponsor a collection of information, and the public is generally not required to respond to an information collection, unless the OMB, under the PRA, approves it and displays a currently valid OMB Control Number. In addition, notwithstanding any other provisions of law, no person shall generally be subject to penalty for failing to comply with a collection of information that does not display a valid Control Number. See 5 CFR 1320.5(a) and 1320.6. The DOL obtains OMB approval for this information collection under Control Number 1235-0021. New requirements would only take effect upon OMB approval of the ICR and publication of the final rule.
