Clarification of Licensee Actions in Support of Enforcement
Guidance for Tornado-Generated Missiles
AGENCY: Nuclear Regulatory Commission.
ACTION: Draft interim staff guidance; request for comment.

SUMMARY: The U.S. Nuclear Regulatory Commission (NRC) is issuing for
public comment its draft Interim Staff Guidance (ISG) DSS-ISG-2015-XX,
``Clarification of Licensee Actions in Receipt of Enforcement
Discretion per Enforcement Guidance Memorandum (EGM) 15-002,
`Enforcement Discretion for Tornado-generated Missile Protection
Noncompliance.' '' This draft ISG will provide clarifying guidance for
NRC staff understanding of expectations for consistent oversight
associated with implementing enforcement discretion for tornado missile
protection noncompliance per EGM 15-002. This guidance will allow
consistent enforcement and regulation of licensees that implement
corrective actions outlined in EGM 15-002.
DATES: Submit comments by December 2, 2015. Comments received after
this date will be considered if it is practical to do so, but the NRC
is able to ensure consideration only for comments received on or before
this date.

II. Background
Following the issuance of EGM 15-002 (ADAMS Accession No,
ML15111A269), the NRC staff received internal and external stakeholder
comments requesting clarification in complying with NRC expectations
for implementing enforcement discretion in accordance with the EGM 15-
002, specifically the implementation of compensatory measures and
guidance on addressing operability status of equipment once the EGM is
implemented. Therefore, the NRC staff has developed draft ISG DSS-ISG-
2015-XX, ``Clarification of Licensee Actions in Receipt of Enforcement
Discretion per Enforcement Guidance Memorandum (EGM) 15-002,
`Enforcement Discretion for Tornado-generated Missile Protection
Noncompliance,' '' to provide clarification concerning the
implementation of EGM 15-002.
The NRC is requesting public comments on the draft ISG to ensure
that it provides sufficiently clear guidance to the NRC staff
concerning expectations for implementation of EGM 15-002.
