ACTION: Notice of Final Results of Full Sunset Review and Revocation of Countervailing Duty Order: Porcelain-on-Steel Cooking Ware from Mexico. ----------------------------------------------------------------------- SUMMARY: On August 26, 1999, the Department of Commerce (``the Department'') published a notice of preliminary results of the full sunset review of the countervailing duty order on porcelain-on-steel cooking ware from Mexico (64 FR 46651) pursuant to section 751(c) of the Tariff Act of 1930, as amended (``the Act''). We provided interested parties an opportunity to comment on our preliminary results. We did not receive comments from any interested party. As a result of this review, the Department finds that revocation of the countervailing duty order would not be likely to lead to continuation or recurrence of countervailable subsidy. Effective Date: January 1, 2000. Statute and Regulations This review was conducted pursuant to sections 751(c) and 752 of the Act. The Department's procedures for the conduct of sunset reviews are set forth [[Page 285]] in Procedures for Conducting Five-year (``Sunset'') Reviews of Antidumping and Countervailing Duty Orders, 63 FR 13516 (March 20, 1998) (``Sunset Regulations'') and in 19 CFR Part 351 (1999) in general. Guidance on methodological or analytical issues relevant to the Department's conduct of sunset reviews is set forth in the Department's Policy Bulletin 98:3--Policies Regarding the Conduct of Five-year (``Sunset'') Reviews of Antidumping and Countervailing Duty Orders; Policy Bulletin, 63 FR 18871 (April 16, 1998) (``Sunset Policy Bulletin''). Scope Imports covered by this order are shipments of porcelain-on-steel cooking ware from Mexico, except teakettles, which do not have self- contained electric heating elements. All of the foregoing are constructed of steel, and are enameled or glazed with vitreous glasses. This merchandise is classifiable under item number 7323.94.0020 of the Harmonized Tariff Schedule (``HTSUS''). The HTSUS item number is provided for convenience and customs purposes. The written description remains dispositive. Background On August 26, 1999, the Department issued the Preliminary Results of Full Sunset Review: Porcelain-on-Steel Cooking Ware from Mexico (64 FR 46646 ) (``Preliminary Results''). In our Preliminary Results, we found that revocation of the countervailing duty order would not be likely to result in recurrence of a countervailable subsidy. We provided all interested parties the opportunity to respond to our preliminary determination. W received no comments from any interested party. Final Results of Review As described in more detail in the Preliminary Results, in our analysis of likelihood of continuation or recurrence of a countervailable subsidy, we relied on factual information from the investigation and administrative reviews of this order. Because the Department conducted verification during the investigation and administrative reviews, we consider that the provisions of 19 CFR 351.307(b)(1)(iii) have been met. As a result of this review, we find that revocation of the countervailing duty order on porcelain-on steel cooking ware from Mexico would not be likely to lead to continuation or recurrence of a countervailable subsidy for the reasons set forth in our Preliminary Results of review. As a result of this determination by the Department that revocation of the countervailing duty order on porcelain-on steel cooking ware from Mexico would not be likely to lead to continuation or recurrence of a countervailable subsidy, the Department, pursuant to section 751(d)(2) of the Act, is revoking the countervailing duty order. Pursuant to 751(c)(6)(A)(iv) of the Act, this revocation is effective January 1, 2000. The Department will complete any pending administrative reviews of this countervailing duty order and will conduct administrative reviews of subject merchandise entered prior to the effective date of revocation in response to appropriately filed requests for review. This notice serves as the only reminder to parties subject to administrative protective order (``APO'') of their responsibility concerning the disposition of proprietary information disclosed under APO in accordance with 19 CFR 351.305 of the Department's regulations. Timely notification of return/destruction of APO materials or conversion to judicial protective order is hereby requested.
