Federal Activities Inventory Reform (FAIR) Act of 1998, Pub. L.

ACTION: Notice.

SUMMARY: The Department of Defense has issued interim final guidelines 
and model procedures to implement section 3 of the Federal Activities 
Inventory Reform Act of 1998.

SUPPLEMENTARY INFORMATION: The Federal Activities Inventory Reform Act 
of 1998, or the FAIR Act, requires each Executive agency, including the 
Department of Defense, to compile a list of commercial activities 
within the agency that are performed by the government, and to make 
that list available to the public. Section 3 of the FAIR Act allows 
interested parties to challenge the contents of the list and to appeal 
an adverse decision on that challenge to a higher level official within 
the agency. The guidelines and model procedures issued by the 
Department of Defense provide information to subordinate organizations 
within the Department on developing and implementing procedures for 
this process. Written requests for the guidelines and model procedures 
will be accepted on or about the time the Office of Management and 
Budget (OMB) announces in the Federal Register the availability of the 
Department of Defense FAIR Act inventory. The guidelines and model 
procedures are currently in effect, but the Department of Defense will 
accept comments on them from the public for 60 calendar days from the 
date of the OMB notice. Persons submitting comments should address them 
to the address listed in this notice.
    The model procedures and other information regarding Department of 
Defense compliance with the FAIR Act may be found by accessing the 
world-wide web at http://gravity.lmi.org/dodfair. This website will be 
available to the public on or about the time OMB announces in the 
Federal Register the availability of the Department of Defense FAIR Act 
inventory.
