ACTION: Notice of submission for review by the office of Management and Budget (OMB) and request for comments. ----------------------------------------------------------------------- SUMMARY: The Federal Energy Regulatory Commission (Commission) has submitted the energy information collection listed in this notice to the Office of Management and Budget (OMB) for review under the provisions of Section 3507 of the Paperwork Reduction Act of 1995 (Pub. The Commission received no comments in responses to an earlier Federal Register notice of May 29, 1999 (64 FR 14893) and has made this notation in its submission to OMB. SUPPLEMENTARY INFORMATION: Description The energy information collection submitted to OMB for review contains: 1. Collection of Information: FERC-519 ``Application for Sale, Lease or Disposition, Merger or Consolidation of Facilities or for Purchase or Acquisition of Securities of a Public Utility'' 2. Sponsor: Federal Energy Regulatory Commission. 3. Control No.: OMB No. 1902-0082. The Commission is now requesting that OMB approve a three-year extension of the current expiration date, with no changes to the existing collection of data. There is an increase in the reporting burden due to an increase in the number of entities that submit this collection of information. This is a mandatory information collection requirement. 4. Necessity of Collection of Information: Submission of this information is necessary to enable the Commission to carry out its responsibilities in implementing the statutory provisions of Section 203 of the Federal Power Act (FPA), 16 U.S.C. Section 203 authorizes the Commission to grant approval for transactions in which a public utility disposes of jurisdictional facilities, merges such facilities with the facilities owned by another person or acquires the securities of another pubic utility. Under the statute, the Commission must find that the proposed transaction will be consistent with the public interest. Section 318 of the FPA exempts certain persons from the requirements of Section 203 which would otherwise concurrently apply under the Public Utility Holding Company Act of 1935. The Commission implements these filing requirements in the Code of Federal Regulations (CFR) under 18 CFR Part 33. 5. Respondent Description: The respondent universe currently comprises on average 125 entities subject to the Commission's jurisdiction. 6. Estimated Burden: 10,000 total burden hours, 125 respondents, 1 response annually, 80 hours per response. 7. Estimated Cost Burden to Respondents: 10,000 hours2,080 hours per year x $109,889 per year $528,313, average cost per respondent = $4,226.50.
