    The Federal Communications Commission (FCC) has received Office of 
Management and Budget (OMB) approval for the following public 
information collections pursuant to the Paperwork Reduction Act of 
1995, Public Law 104-13. An agency may not conduct or sponsor and a

    Title: Procedures for Formal Complaints Filed Against Common 
Carriers.
    Form No.: FCC Form 485.
    Respondents: Business or other for-profit entities, including small 
business; not-for-profit institutions; state, local or tribal 
government, individuals or households.
    Estimated Annual Burden: 5645 respondents; 2.95 hours per response 
(avg.); 16,677 total annual burden hours.
    Estimated Annual Reporting and Recordkeeping Cost Burden: $63,000.
    Frequency of Response: On occasion, third party disclosure, 
recordkeeping.
    Description: Sections 206 to 209 of the Communications Act of 1934, 
as amended provide the statutory framework for our current rules for 
resolving formal complaints filed against common carriers. Section 
208(a) authorizes complaints by any person ``complaining of anything 
done or omitted to be done by any common carrier'' subject to the 
provisions of the Act. Section 208(a) specifically states that ``it 
should be the duty of the Commission to investigate the matters 
complained of in such manner and by such means as it shall deem 
proper.'' In the Second Report and Order issued in CC Docket No. 96-
238, the Commission makes certain changes in the rules for formal 
complaints filed against common carriers to make them move more 
quickly. Information filed pursuant to 47 CFR 1.720 et seq. is provided 
either with or in response to a formal complaint to determine whether 
or not there has been a violation of the Communications Act of 1934, as 
amended, or the Commission's Rules or Orders. Affected respondents are 
complainants and potential defendant common carriers. Obligations to 
respond: required to obtain or retain benefits. Following is a listing 
of new or modified collections contained in the Second Report and 
Order:
