Environmental Response, Compensation, and Liability Act

Pursuant to Section 122(d) of CERCLA, 42 U.S.C. Sec. 9622(d),
notice is hereby given that a proposed Consent Decree in United States
v. NL Industries, et al., No. CV 98-322-HA, was lodged on March 10,
1998, with the United States District Court for the District of Oregon.
In this action the United States sought injunctive relief and
recovery of response costs incurred and to be incurred by the United
States at the Gould Superfund Site located near Portland, Oregon (the

commit to implement the remedial actions selected in the amended Record
of Decision, at a cost estimated by EPA to be approximately $15
million. They also agree to reimburse the United States for future
response costs at the Site in excess of $100,000. In addition, the
Settling Defendants will covenant not to sue the United States for
claims against the Superfund, claims for contribution, and claims based
on EPA's selection of response actions.
The Department of Justice will receive, for a period of thirty (30)
days from the date of this publication, comments relating to the
proposed Consent Decree. Comments should be addressed to the Assistant
Attorney General for the Environment and Natural Resources Division,
Department of Justice, Washington, DC 20530, and should refer to United
States v. NL Industries, et al., DOJ Ref. #90-11-3-397C.
