Approval and Promulgation of State Plans for Designated 
Facilities and Pollutants; Utah; Control of Landfill Gas Emissions From 
Existing Municipal Solid Waste Landfills

AGENCY: Environmental Protection Agency (EPA).

ACTION: Proposed rule.

SUMMARY: The EPA is proposing to approve the Utah plan for implementing 
the Municipal Solid Waste (MSW) Landfill Emission Guidelines at 40 CFR 
part 60, subpart Cc, which was required pursuant to section 111(d) of 
the Clean Air Act (Act). The State's plan, which was originally 
submitted to EPA on April 2, 1997 with revisions to the plan submitted 
on October 31, 1997, establishes performance standards for existing MSW 
landfills and provides for the implementation and enforcement of those 
standards.
    In the final rules section of this Federal Register, the EPA is 
approving the State's submittal in a direct final rule without prior 
proposal because the Agency views this as a noncontroversial action and 
anticipates no adverse comments. A detailed rationale for the approval 
is set forth in the direct final rule. If no adverse comments are 
received in response to this proposed rule, no further activity is 
contemplated and the direct final rule will become effective. If EPA 
receives adverse comments, the direct final rule will be withdrawn and 
all public comments received will be addressed in a subsequent final 
rule based on this proposed rule. EPA will not institute a second 
comment period on this proposed rule. Any parties interested in 
commenting on this proposed rule should do so at this time.
