Devoe & Raynolds Company, Louisville, Kentucky; Notice of 
Negative Determination on Reconsideration

    On July 18, 1997, the Department issued an Affirmative 
Determination Regarding Application for Reconsideration for the workers 
and former workers of the subject firm. The petitioner presented new 
evidence regarding company imports of paint. The notice was published 
in the Federal Register on August 1, 1997 (62 FR 41424).
    The Department initially denied TAA to workers of Devoe & Raynolds 
Company, Louisville, Kentucky because the ``contributed importantly'' 
group eligibility requirement of Section 222(3) of the Trade Act of 
1974, as amended, was not met. The workers at the subject firm produced 
latex and alkyd paints. The layoffs at the Louisville plant were 
attributed to the corporate decision to consolidate operations with 
that of the parent company's domestic plants in Texas, Ohio, 
Pennsylvania, and Florida. The parent company did not import paint from 
foreign sources.
    New findings on reconsideration show that the parent company of 
Devoe & Raynolds, ICI Paints, operating in the U.S. as Glidden, had a 
corporate-wide sales increase from 1995 to 1996. Other new findings 
reveal that the company did import paint from its foreign production 
facility. Company imports, however, were negligible, accounting for 
less that 1 percent of corporate-wide sales in 1995 and 1996.

Conclusion

    After reconsideration, I affirm the original notice of negative 
determination of eligibility to apply for worker adjustment assistance 
for workers and former workers of Devoe & Raynolds Company, Louisville, 
Kentucky.
