Establishment of Class E Airspace; Apalachicola, FL

AGENCY: Federal Aviation Administration (FAA), DOT.

ACTION: Final rule.

SUMMARY: This amendment establishes Class E airspace at Apalachicola, 
FL. A NDB RWY 13 and a NDB RWY 31 Standard Instrument Approach 
Procedures (SIAPs) have been developed for Apalachicola Municipal 
Airport. Controlled airspace extending upward from 700 feet above the 
surface (AGL) is needed to accommodate these SIAPs and for instrument 
flight rules (IFR) operations at the airport. The operating status of 
the airport will change from VFR to include IFR operations concurrent 
with publication of these SIAPs.

SUPPLEMENTARY INFORMATION: 

History

    On December 2, 1996, the FAA proposed to amend Part 71 of the 
Federal Aviation Regulations (14 CFR Part 71) by establishing Class E 
airspace at Apalachicola, FL, (61 FR 63766). This action will provide 
adequate Class E airspace for IFR operations at Apalachicola Municipal 
Airport.
    Interested parties were invited to participate in this rulemaking 
proceeding by submitting written comments on the proposal to the FAA. 
No comments objecting to the proposal were received. Designations for 
Class E airspace extending upward from 700 feet or more above the 
surface are published in Paragraph 6005 of FAA Order 7400.9D dated 
September 4, 1996, and effective September 16, 1996. The Class E 
airspace designation listed in this document will be published 
subsequently in the Order.

The Rule

    This amendment to Part 71 of the Federal Aviation Regulations (14 
CFR part 71) establishes Class E airspace at Apalachicola, FL, to 
accommodate a NDB RWY 13 and a NDB RWY 31 SIAPs and for IFR operations 
at Apalachicola Municipal Airport. The operating status of the airport 
will be changed from VFR to include IFR operations concurrent with 
publication of these SIAPs.
    The FAA has determined that this regulation only involves an 
established body of technical regulations for which frequent and 
routine amendments are necessary to keep them operationally current. 
It, therefore, (1) is not a ``significant regulatory action'' under 
Executive Order 12866; (2) is not a ``significant rule'' under DOT 
Regulatory Policies and Procedures (44 FR 11034; February 26, 1979); 
and (3) does not warrant preparation of a regulatory evaluation as the 
anticipated impact is so minimal. Since this is a routine matter that 
will only affect air traffic procedures and air navigation, it is 
certified that this rule will not have a significant economic impact on 
a substantial number of small entities under the criteria of the 
Regulatory Flexibility Act.

    In consideration of the foregoing, the Federal Aviation 
Administration amends 14 CFR Part 71 as follows:

Reporting Points, dated September 4, 1996, and effective September 16, 
1996, is amended as follows:
