Notice of Lodging of Partial Consent Decree Pursuant to the 
Comprehensive Environmental Response, Compensation and Liability Act, 
42 U.S.C. Secs. 9601, et seq.

    In accordance with Departmental policy, 28 C.F.R. Sec. 50.7, notice 
is hereby given that a proposed partial consent decree in United States 
v. Excel Corp., Civil Action No. 3:93CV0119RM, was lodged on August 13, 
1996 with the United States District Court for the Northern District of 
Indiana. The consent decree resolves the claims alleged against Excel 
Corporation, Elkhart Products Corporation, Detrex Corporation, NIBCO, 
Inc., Miles, Inc. and Adams & Westlake, Ltd. under the Comprehensive 
Environmental Response, Compensation and Liability Act, 42 U.S.C. 
Secs. 9601, et seq., (``CERCLA''). The proposed Consent Decree provides 
for the payment by these settling parties of $4,452,500 of the United 
States unrecovered response costs at the Main Street Well Field Site in 
Elkhart, Indiana (the ``Site''). The proposed Consent Decree also 
resolves the United States claim against Detrex Corporation for a civil 
penalty for its alleged failure to perform response activities at the 
Site pursuant to an administrative order issued by the United States 
Environmental Protection Agency.
    The Department of Justice will receive, for a period of thirty (30) 
days from the date of this publication, comments relating to the 
proposed consent decree. Comments should be addressed to the Assistant 
Attorney General for the Environment and Natural Resources Division, 
Department of Justice, Washington, D.C. 20530, and should refer to 
United States v. Excel Corp., DOJ Ref. #90-11-3-799.
    The proposed consent decree may be examined at the office of the 
United States Attorney, 301 Federal Building, 204 South Main Street, 
South Bend, Indiana; the Region 5 Office of the Environment Protection 
Agency, 77 West Jackson Boulevard, Chicago, IL 60604; and at the 
Consent Decree Library, 1120 G Street, N.W., 4th Floor, Washington, 
D.C. 20005, (202) 624-0892. A copy of the proposed consent decree may 
be obtained in person or by mail from the Consent Decree Library, 1120 
G Street, N.W., 4th Floor, Washington, D.C. 20005. In requesting a copy 
please refer to the referenced case and enclose a check in the amount 
of $10.25 (25 cents per page reproduction costs), payable to the 
Consent Decree Library.
