Take notice that on August 7, 1996, Alabama-Tennessee Natural Gas Company (Alabama-Tennessee), tendered for filing a refund report required by Article 1, Paragraph 1.5, of the general rate case settlement in the referenced proceeding. Alabama-Tennessee states that it previously filed to eliminate a volumetric charge of $0.0027 per dekatherm from its rates and that although it has issued refunds attributable to the elimination of the surcharge, it inadvertently failed to file the subject report. Alabama- Tennessee states that the subject report is intended to meet its obligation in that regard. Alabama-Tennessee requests that the Commission grant any waivers necessary to permit review of the report and states that a copy of the report has been served on all parties named on the official service list in this proceeding. Any person desiring to protest said filing should file a protest with the Federal Energy Regulatory Commission, 888 First Street, N.E., Washington, D.C., 20426 in accordance with Rule 211 of the Commission's Rules of Practice and Procedure (18 CFR 385.211). All such protests must be filed on or before August 26, 1996. Protests will be considered by the Commission in determining the appropriate action to be taken but will not service to make protestants parties to the proceeding.
