SUPPLEMENTARY INFORMATION: OMB Approval No.: 3060-0446. Title: Section 1.402 Pioneer's Preference. Form No.: N/A. Type of Review: Revision of a currently approved collection. Respondents: Businesses or other for-profit. Number of Respondents: 14. Estimated Time Per Response: 500 hours for new applicants, 10 hours per respondent to amend existing applications. Total Annual Burden: 1,120 hours. Needs and Uses: The information will be used to evaluate existing pioneer's preference request in proceedings in which tentative decisions have not been made, as well as any new pioneer's preference requests that may be received. The collection requires that an applicant submit a statement that a new allocation of spectrum is necessary for its innovation to be implemented. Further, if the applicant relied on experimental results to demonstrate the technical feasibility of its innovation, it must submit a summary of those results. Additionally, for pioneer's preference requests filed after September 1, 1994, an applicant must submit a showing demonstrating that the Commission's public rulemaking process inhibits it from capturing the economic rewards of its innovation unless it is grated a pioneer's license.
