OFFICE OF PERSONNEL MANAGEMENT

5 CFR Part 213

RIN 3206-AH18

Revocation of Schedule A Authority 213.3102(cc)

AGENCY: Office of Personnel Management.

ACTION: Final rule.

-----------------------------------------------------------------------

SUMMARY: The Office of Personnel Management (OPM) is eliminating the
regulation establishing Schedule A authority 213.3102(cc) because it
will be revoked. Under the terms of this authority, its Schedule A
positions are filled by persons identified as Interchange Executives by
the President's Commission on Executive Exchange. This Commission no
longer exists.

EFFECTIVE DATE: November 2, 1995.

FOR FURTHER INFORMATION CONTACT:
Armond A. Grant, (202) 606-0950.

SUPPLEMENTARY INFORMATION: E.O. 12760 abolished the President's
Commission of Executive Exchange and terminated its functions. Since
new appointments can no longer be made and no appointments under this
authority currently remain, the authority is not needed and will be
revoked.

Waiver of Notice of Proposed Rulemaking and 30-day Delay of Effective
Date

    Under 5 U.S.C. 553(b)(3)(B) and (d)(3), I find that good cause
exists for waiving the general notice of proposed rulemaking and for
making this amendment effective in less than 30 days. That is because
this amendment is solely for the purpose of deleting an outdated
regulation.

Regulatory Flexibility Act

I certify that these regulations will not have a significant
economic impact on a substantial number of small entities (including
small businesses, small organizational units, and small governmental
jurisdictions) because they apply only to Federal employees.

Accordingly, OPM is amending 5 CFR part 213 as follows:

    1. The authority citation for part 213 continues to read as
follows:

    Authority: 5 U.S.C. 3301 and 3302, E.O. 10577, 3 CFR 1954-1958
Comp., p. 218; section 213.101 also issued under 5 U.S.C. 2103;
section 213.3102 also issued under 5 U.S.C. 3301, 3302, 3307,

Sec. 213.3102 [Amended]

    2. In 213.3102, paragraph (cc) is removed and reserved.
