ACTION: Final rule; petition for reconsideration. ----------------------------------------------------------------------- SUMMARY: The Commission denies the petition filed by CWA Broadcasting, Inc. for reconsideration of the Report and Order in MM Docket 92-291, 59 FR 32177, June 22, 1994. In that proceeding, CWA Broadcasting, Inc., the permittee of Station WFBR, Cambridge, Maryland, requested the reallotment of Channel 232A to St. Michaels, Maryland, and modification of the construction permit for Station WFBR to specify St. Michaels as the new community of license. The proposal was denied because it violated a policy that the Commission will not accept petitions to change the community of license before or during the first year of station operation when a permittee or licensee received in a comparative hearing a decisionally significant preference. CWA has not shown that this policy was improperly applied to its rulemaking proposal. FOR FURTHER INFORMATION CONTACT: Kathleen Scheuerle, Mass Media Bureau, (202) 418-2180.
