Federal Acquisition Regulation; Revisions to Standard Forms 1414 
and 1415

AGENCIES: Department of Defense (DOD), General Services Administration 
(GSA), and National Aeronautics and Space Administration (NASA).

ACTION: Final rule.

SUMMARY: The Civilian Agency Acquisition Council and the Defense 
Acquisition Regulations Council have agreed on a final rule to revise 
Standard Form 1414, Consent of Surety, and Standard 1415, Consent of 
Surety and Increase of Penalty, to accommodate consents by individual 
sureties and to provide space for entry of dates of execution. This 
regulatory action was not subject to Office of Management and Budget 
review under Executive Order 12866, dated September 30, 1993.

EFFECTIVE DATE: February 27, 1995.

SUPPLEMENTARY INFORMATION:

A. Background

    Standard Form (SF) 1414 is used to obtain the consent of surety 
when a contract is modified. SF 1415 is used when additional bond 
coverage is required from the original surety. Changes to these forms 
were determined to be necessary to accommodate consents by individual, 
as well as corporate, sureties and to provide space to enter dates of 
execution.

B. Regulatory Flexibility Act

    The final rule does not constitute a significant FAR revision 
within the meaning of FAR 1.501 and Public Law 98-577, and publication 
for public comments is not required. Therefore, the Regulatory 
Flexibility Act does not apply. However, comments from small entities 
concerning the affected subpart will be considered in accordance with 5 
U.S.C. 610. Such comments must be submitted separately and cite 5 
U.S.C. 601, et seq. (FAC 90-23, FAR case 92-9), in correspondence.

C. Paperwork Reduction Act

    The Paperwork Reduction Act does not apply because the changes to 
the FAR do not impose recordkeeping or information collection 
requirements, or collections of information from offerors, contractors, 
or members of the public which require the approval of the Office of 
Management and Budget under 44 U.S.C. 3501, et seq.
