Notice of Lodging of Consent Decree Pursuant to the Clean Air Act

    In accordance with Departmental policy, 28 C.F.R. Sec. 50.7, notice 
is hereby given that a proposed consent decree in United States v. 
Alloyd Asbestos Abatement Co., et al., Civil Action No. C-3-91-107, 
were lodged on November 8, 1994 with the United States District Court 
for the Southern District of Ohio. The Consent Decree resolves 
violations of Section 112(c) of the Clean Air Act, 42 U.S.C. 
Sec. 7412(c), as amended, and the National Emission Standards for 
Hazardous Air Pollutants for asbestos (the ``asbestos NESHAP''), 40 
C.F.R. Part 61, Subpart M. The Consent Decrees require Defendant Ohio 
State University (``OSU'') to pay civil penalties of $7500 and to 
establish asbestos control programs and achieve full compliance with 
the asbestos NESHAP.
    The Department of Justice will receive, for a period of thirty (30) 
days from the date of this publication, comments relating to the 
proposed consent decree. Comments should be addressed to the Assistant 
Attorney General for the Environment and Natural Resources Division, 
Department of Justice, Washington, DC 20530, and should refer to United 
States v. Alloyd Asbestos Abatement Co., et al., DOJ Ref. #90-5-2-1-
1554.
    The proposed consent decree may be examined at the office of the 
United States Attorney, 602 Federal Building, 200 West Second Street, 
Dayton, Ohio 45402; the Region Five Office of the Environmental 
Protection Agency, 77 West Jackson Blvd., Chicago, Illinois 60604; and 
at the Consent Decree Library, 1120 G Street, NW., 4th Floor, 
Washington, DC 20005, (202) 624-0892. A copy of the proposed consent 
decree may be obtained in person or by mail from the Consent Decree 
Library, 1120 G Street, NW., 4th Floor, Washington, DC 20005. In 
requesting a copy please refer to the referenced case, and enclose a 
check in the amount of $5.75 for the OSU decree (25 cents per page 
reproduction costs), payable to the Consent Decree Library.
