ACTION: Issuance of an Amendment to Modification 3 of Scientific Research and Enhancement Permit 817 (P45K). ----------------------------------------------------------------------- Notice is hereby given that on July 6, 1994, as authorized by the provisions of the Endangered Species Act (ESA), NMFS issued the first amendment to Modification 3 of Permit Number 817 (P45K) to Stanley D. Smith of the National Biological Survey for an increased take of listed Snake River fall chinook salmon and listed Snake River spring/summer chinook salmon for scientific research and enhancement purposes, subject to certain conditions set forth therein. Issuance of this amendment, as required by the ESA, was based on a finding that the permit and modifications, as amended: (1) Were applied for in good faith; (2) will not operate to the disadvantage of the listed species which is/are the subject of the permit; (3) is consistent with the purposes and policies set forth in section 2 of the ESA. This amendment was also issued in accordance with and is subject to parts 217-222 of Title 50 CFR, the NMFS regulations governing listed species permits.
