Aerodynamic Plating Co., Inc., CV-94-4750-WDK(Ex), was lodged with the United States District Court for the Central District of California. The proposed Consent Decree resolves the United States' claims against Aerodynamic Plating Co., Inc., under Section 309 (b) and (d) of the Clean Water Act, 33 U.S.C. 1319 (b) and (d). The Complaint alleged that Aerodynamic violated Section 307 of the Clean Water Act, 33 U.S.C. 1317, by introducing pollutants into the County Sanitation District of Los Angeles' publicly owned treatment works in violation of pretreatment standards. Under the proposed Consent Decree, Aerodynamic will install new pretreatment equipment, modify existing pretreatment equipment, modify operations, conduct training for both buildings, conduct additional self-monitoring and reporting, pay a civil penalty of $7,500 within three (3) years of entry in settlement of the United States' claims, pay NRDC's attorneys' fees and costs of $17,500 within one (1) year of entry, and pay the Santa Monica Bay Restoration Project $10,000 within two (2) years of entry in settlement of NRDC's claims. Aerodynamic is subject to stipulated penalties for failures to comply with the terms of the proposed Consent Decree. The Department of Justice will receive, for a period of thirty (30) days from the date of this publication, comments relating to the proposed Consent Decree.
