Commission Determination Not To Review an Initial Determination
Terminating the Investigation As To Intervenor Cyrix Corporation
In the Matter of Certain Personal Computers With Memory
Management Information Stored in External Memory and Related
Materials.
AGENCY: U.S. International Trade Commission.
ACTION: Notice.

SUMMARY: Notice is hereby given that the U.S. International Trade
Commission has determined not to review the presiding administrative
law judge's (ALJ's) initial determination (ID) in the above-captioned
investigation terminating the investigation with respect to intervenor
Cyrix Corporation.

SUPPLEMENTARY INFORMATION: The Commission instituted this investigation
on June 16, 1993, based on a complaint alleging violations of section
337 of the Tariff Act of 1930 in the importation into the United
States, the sale for importation into the United States, and the sale
within the United States after importation of certain personal
computers with memory management information stored in external memory
and related materials by reason of direct and induced infringement of
claims 2 and 6 of U.S. Letters Patent 4,972,338. 58 FR 33283 (1993).
After institution of the subject investigation, Advanced Micro Devices,
Inc. and Cyrix Corporation intervened separately on the side of
respondents Twinhead Int'l Corp. and Twinhead Corp. (Twinhead)
asserting that they supplied microprocessors for Twinhead's personal
computers. 58 FR 41486 and 44851 (1993).
On February 14, 1994, intervenor Cyrix filed a motion to terminate
this investigation as to Cyrix as a party, and with respect to any
personal computers or related materials containing microprocessors
designed by Cyrix, on the basis of a settlement agreement.
On February 23, 1994, the ALJ issued an ID (Order No. 23) granting
the motion to terminate as to Cyrix on the basis of the settlement
agreement. No petitions for review were filed. No agency or public
comments were received.
This action is taken under the authority of section 337 of the
Tariff Act of 1930, 19 U.S.C. 1337, and Sec. 210.53(h) of the
Commission's Interim Rules of Practice and Procedure, 19 CFR 210.53(h).
Copies of the ID and all other nonconfidential documents filed in
connection with this investigation are or will be available for
inspection during official business hours (8:45 a.m. to 5:15 p.m.) in
