ACTION: Withdrawal of petition to initiate rulemaking. ----------------------------------------------------------------------- SUMMARY: At the request of the petitioners, the Office of Surface Mining Reclamation and Enforcement is withdrawing a petition for rulemaking submitted by the Interstate Mining Compact Commission that was published in the August 17, 1993 Federal Register (58 FR 43594). SUPPLEMENTARY INFORMATION: On August 17, 1993 (58 FR 43594), OSM published in the Federal Register a notice of availability and request for comment on a petition for rulemaking submitted by the Interstate Mining Compact Commission (IMCC). The petition, submitted under section 201(g) of the Surface Mining Control and Reclamation Act of 1977, requested that the Federal regulations at 30 CFR parts 840, 842 and 843 be amended to address the oversight role of OSM in States where a regulatory program approved by the Secretary of the Interior is in effect. The petition focused on the treatment of citizen complaints alleging violations at surface coal mining and reclamation operations and on citizen complaints alleging that a State permitting decision does not conform to applicable regulatory program requirements. The IMCC in a letter to OSM dated January 24, 1994, withdrew the petition for rulemaking without prejudice, prior to any decision by OSM with respect to the petition. Therefore, OSM is terminating further action on a decision to grant or deny the petition. Dated: February 3, 1994. Anne H.
