Shenkle PROGRAM SUMMARY The Delaware County Coastal Zone Task Force is an outgrowth of the Delaware County Planning Department's 1992 Delaware County Waterfront Resources Manage- ment Plan in which the concept of a task force was listed under Immediate/Important Actions. The Waterfront Plan identified a need to create a forum for coastal zone communities to discuss common goals and problems and to work collectively with-- developers, business and industry, and other public and quasi-public agencies to develop an overall vision for the Delaware County waterfront area. The Delaware County Planning Department (DCPD) undertook the responsibility to establish such a task force as the first phase of the Waterfront Plan's implementation; DCPD's goal being to create an independent, self-sustaining task force comprised of coastal zone stakeholders with its own list of goals and objectives. The 1995 Task Force program consisted of a series of meetings at which various stakeholders discussed coastal zone issues and priorities. In the early part of 1995, DCPD began organizing the Task Force's initial kick-off meeting by compiling a list of prospective invitees from all important stakeholder groups in the coastal zone, including municipalities, business/industry, environmental, County agencies, citizens, etc. (See Tab #1 for supporting materials.) The kick-off meeting, held on April 24, 1995, was hosted by County Council and DCPD. The meeting agenda included a hearty welcome by County Council Chairman Ward T. Williams and an inspiring address by Congress- man W. Curtis Weldon. The event was well attended; however, the audience was predominantly comprised of business/industry and County agency persons, with representation from the coastal zone municipalities being low. During the meeting a questionnaire relative to the Task Force's goals, objectives, and issues was distributed to all attendees. (See Tab #1 for a copy of the questionnaire and refer to the kick-off meeting minutes in the May meeting notice packet under Tab #2 for the questionnaire results.) The ideas and information shared in this first general session set the stage for the Task Force's direction and future agenda. DCPD held six subsequent monthly meetings from May to October. Five of the six meetings were hosted by a different coastal zone municipality. Marcus Hook Borough, Trainer Borough, Tinicum Township, Chester City, and Eddystone Borough each hosted a meeting. DCPD arranged to have a guest speaker at each meeting to educate the group about existing programs, legislation, and/or issues pertinent to waterfront communities. The specific topics presented were the Coastal Zone Management Program, the Delaware Estuary Program and Sustainable Development, the Urban Waterfront Action Group, the Pennsylvania Municipalities Planning Code, the new state Brownfields Legislation, and the Chester City Waterfront Planning Initiatives. (See Tab #2 for agendas, minutes, and attendance records for each meeting.) The group's composition differed greatly from meeting to meeting, which made decision making and the development of by-laws difficult. Early on, DCPD, along with a core group of regular meeting attendees, recognized'that municipal participation was less than desirable. In order to garner more municipal participation, DCPD initiated an outreach program to the coastal zone communities. DCPD extended offers to make one- on-one presentations about the Task Force's purpose and goals to all 13 municipalities in the coastal zone. (See Tab #3 for municipal contact information.) The primary goal of these presentations was to stress the importance of municipal participation on the Task Force. Ultimately, five municipalities accepted the offer: Marcus Hook, Folcroft, Trainer, and Eddystone Boroughs and Ridley Township. It appeared that as a result of the presentations and other outreach measures, municipal participation increased and----- about half of the coastal zone's municipalities were regularly represented at each meeting. Although there was a relatively active core group of regular attendees, and municipal participation improved over the course of seven months, the group was not completely comfortable with finalizing and adopting by-laws at the end of 1995. Originally, DCPD had envisioned that the Task Force via a subcommittee would write its own by-laws; however, the group's preference was to have DCPD, draft them and allow the group to comment and suggest changes. DCPD, drafted by-laws and a mission statement to which the group reacted. After minor changes were made to several sections the group stalled. Many issues arose concerning the membership portion, and the group became reluctant to adopt formal by-laws. Therefore, the by-laws currently remain in draft form. (See Tab #4 for a copy of the draft by-laws.) Overall attendance began to wane in September and October which prompted DCPD to question whether the group's participants felt that the Task Force was a worthwhile undertaking. When DCPD posed the question to the group, the response was positive. It appeared that most representatives did not want to disband and that the attendees would commit themselves to active participation in the future. The core group of participants generated interesting discussions on several issues germane to the Delaware County waterfront area. These issues as well as other issues identified in the Waterfront Plan and by DCPD were prioritized by the Task Force members. They generally agreed that these could be issues on which the group should concentrate in the future., (See Tab #5 for issues list.) With each passing meeting, it became more apparent that many of the Task Force members were unfamiliar with the coastal area as a whole. Therefore, DCPD felt that one of the most important things it could do was to expose Task Force participants to the numerous and varied conditions and opportunities in the coastal zone. Hence, in lieu of an eighth meeting in November, DCPD organized a bus tour featuring coastal zone sites/areas identified in the Opportunities/Constraints section of the Waterfront Plan. (See Tab #6 for bus tour itinerary and participant list.) Based on the participants' comments, the bus tour was a success and provided the participants with a highly enlightened understanding of the Delaware County coastal zone dynamics. DCPD hopes that the stimulus of the bus tour will carry over into 1996 as DCPD, staff has committed itself to continue working with the Task Force in the role of organizer and administrator. DCPD plans to convene bi-monthly meetings beginning in January. The Task Force will further its efforts to define its role, to sustain participa- tion, and to determine how to best address or help deal with the issues/problems faced by the coastal zone communities. DCPD has already taken the lead on addressing the problems associated with planning aspects for waterfront areas. In cooperation with the Task Force, DCPD will be preparing a catalog of waterfront land use planning provisions. However, several years ago following a brief evaluation of subdivision/land development records, local comprehensive plans, and discussions with municipal officials, the Planning Department came to the realizatiornhat many of the County's waterfront communities were ill equipped from a land use planning perspective to adequately deal with redevelopment activities in a comprehensive and coordinated manner. It was also found that municipalities knew little about what resources they had to work with, what elements they would like to preserve, and how best to maximize their use. In essence, there was a lack of vision from both local and waterfront-wide perspectives. Thus, with funding assistance from CZM, the County Planning Department undertook the preparation of the Delaware Coun1y Waterfront Resources Management Plan. This document, which was designed to provide coastal zone municipalities with the tools necessary to plan for and manage growth, provides the waterfront communities with an extensive inventory of their best resources, a comprehensive evaluation of their planning and land use management documents, and an identification of major opportunities and constraints for redevelopment on a number of important sites. The study also makes a number of recommendations for local as well as coastal zone-wide planning activities and studies. The Planning Department believes that the most important of these recommendations is for the parties which have a stake in the coastal zone's success or failure to be brought together so that a common vision can be generated, potential conflicts can be minimized, and future land use planning and redevelopment activities can take place in a unified and orderly fashion. As discussed above and throughout the waterfront study, bringing the concerned parties together so that they may operate as a unit is of critical importance to the future viability and success of the County's waterfront area. However, no coordinating entity or forum for discussion currently exists that can provide the necessary mechanism for oversight to address common concerns, resolve inter-municipal issues, or provide the collective force to facilitate the County's active and competitive participation in regional waterfront revitalization programs. Therefore, the Planning Department proposes that a Delaware County Coastal Zone Task Force (charged with some of the items discussed above) be formed as early as possible. In order to facilitate the initiation of this task force, the County Planning Department, with financial assistance from the CZM Program, would be responsible for administrative support for start-up activities. Once permanently established over the course of one year, the task force would be expected to operate under its own authority and funding. Next Meeting The Delaware County Coastal Zone Task Force Kick-off Meeting Minutes April 24, 1995 Welcome County Council Chair Ward Williams thanked everyone f:or their attendance and expressed his appreciation to Walt Omlor for the use of the Training Center. He discussed the County's long-standing interest in the waterfront and how we are all in a position to participate in its revitalization. He cited other projects in the coastal zone that the County has supported, such as the widening of Rt. 291 (Industrial Hwy.), the DELCO Emergency Services Training Center, the Westinghouse facility, the Henderson Office Complex, the Riverbridge Industrial Center, and the Penn Terminals. He also mentioned the County's desire to correct the safety problems of Rt. 322, which is an issue now being addressed by PennDOT. Mr. Williams turned the meeting over to Planning Department Director John Pickett who noted that a few years ago, the Planning Department recognized that local response to the resurgence in activity along the water- front tended to be more reactive than proactive and that a piecemeal pattern of development was beginning to evolve. He stressed the importance of creating a diversified waterfront that maximizes and coordinates the abundant and varied resources available. He mentioned that the missing component to accomplish this is the coordinated vision that can only come f rom the parties that live and work in the area. Mr. Pickett also brief ly explained what the "coastal zone" is, what the Coastal Zone Management Program is, and how in 1992 DCPD prepared the Delaware County Waterfront Resources Management Plan under a grant sponsored by the Program. Address Mr. Pickett then introduced Congressman Curt Weldon who delivered the keynote address. Congressman Weldon discussed his experiences with "turning around" Marcus Hook. He mentioned other regional initiatives such as the Delaware Estuary Program. Congressman Weldon also talked about how important it is to be able to participate and compete in the regional arena and about New Castle County, Delaware's desire to work with Delaware County on regional waterfront efforts. He stressed that Delaware County's waterfront municipalities need to act as a unit in order to accomplish this. He went on to say that the Task Force is an opportunity to join together to create a role for the County in the region and encouraged continued participation on the Task Force. III. overview DCPD Principal Planner Karen Holm mentioned that the major goal of the waterfront study was to look for comizon- goals and themes on which the waterfront could capitalize. She explained that as part of DCPD's effort, they inventoried all resources and examined local planning documents and ordinances. DCPD found that there were a tremendous number of opportunities for redevelopment, particularly in light of the availability of transportation and infrastructure, but that they were hindered by common problems such as regulatory require- ments and brownfields. Another common problem is that many planning documents are outdated and have no relationship to the activities taking place in the area. For this reason and f or reasons previously noted, the Planning Department's primary recommendation in the waterfront study was to form a Task Force to deal with the issues. The Task Force is envisioned to be a long-term, self- sustaining body with assistance from Planning Department staff to get established. She stressed that the Task Force should be driven by the players in the coastal zone. For the first year, the intended products are to be a mission statement, by-laws, and an outline of future goals and activities. Karen then requested that the attendees break into two groups to brainstorm about a possible mission statement and to make suggestions for future goals and activities. The municipal survey containing potential topics for future meetings was to be completed by the end of the break-out sessions. IV. Break-out Sessions Group A Task Force Participation It was the general belief of all attendees that more municipal participation is needed as only three municipalities were represented. Attendees made it clear that sending letters to municipal officials will not work because they generally will not respond unless there is a crisis. No crisis equals no participation. A suggestion was made that each municipality be approached individually to explain the need for their participation on the Task Force. one partic ipant suggested that an attendee from the kick-off meeting go to the municipalities who were not represented and discuss the goals and mission of the Task Force. Another reason why municipalities did not attend may be that they do not have full-time staff which would allow them time to attend daytime meetings or to send somec-ne- in their place if they had a prior commitment. There was a suggestion that perhaps someone could go to the municipal officials' night meeting and discuss it with them. It was recommended that for maximum participation, subsequent meetings be scheduled during the evening. Most believed the location to be convenient to the local governing bodies. One participant suggested that perhaps municipal officials are waiting for a "hot topic" or publication of an actual agenda for the Task Force before they will attend any meetings. others felt that the invitational letter was confusing and that perhaps the municipal officials did not understand the purpose of the meeting and the Task Force. Many attendees felt that municipal officials probably do not know about the waterfront study and what it entails. It was suggested that the Planning Department could introduce them to it and encourage them to designate staff to attend the meetings, preferably someone with planning or other relevant experience. With regard to the survey, the group felt that the County needs to sit down with the individual municipalities and ask them what problems they have and then suggest that the Task Force can help them to determine viable solutions to those problems. Meeting participants felt that the Task Force should have some sort of structure in the form of an agenda. They also wanted to know what resources would be available to the Task Force and how much time they would be expected to contribute. A one-page newsletter was suggested by Bill Payne. Karen Holm (KH) stated that the agenda for the Task Force should be Task Force generated so that there is participant commitment. Such commitment requires one meeting per month with additional meetings if one is on a subcommittee. KH will check the contract to see if there is adequate funding to produce a newsletter. People also believed that if the municipalities think the Task Force is trying to tell them what to do with their land, the whole project will fail. It was suggested that goals and objectives be presented to them in the form of advice and guidelines. Issues Discussed The group also felt that the municipalities not represented at the meeting may not have adequate ordinances and comprehensive plans and that there is a need to collect these plans, review them, and see what is missing from them. KH pointed out that this was done in the Waterfront Study. 1:7- -1 The Bi-State Compact between Pennsylvania and Delaware suggested by Rep. Weldon was discussed by the group. Some were skeptical because of the need for funding. Mike Wolf noted that such a compact would require bi- state legislation. Many felt that this was too ambitious an undertaking. Several wondered how this compact would help Delaware County because they feel that County citizens living close to Delaware tend to spend more of their time and money in that state rather than in Pennsylvania. Others felt that Delaware may be taking our industry away from us and believe that we should concentrate on making Delaware County a magnet that would also attract industry and business. One reason why Delaware County does not now attract attention may be that there are no docking areas for boaters traveling up the coast from Delaware to Philadelphia, thereby forcing them to bypass Delaware County. The issue of competition between municipalities also arose, and many feel that this attitude negatively influences the municipalities' ability to cooperate with each other and make them think regionally. It would be better to focus on common problems. We should show municipalities how their prospering can benefit each other. We must also make municipalities realize that it is in their interest to have a variety of attractions. The lack of communication between municipalities and a sense that this has created a problem in direction of resources was noted. Bruce Dorbian noted that some of the lack of communication may be a result of competition. Floating zoning and model overlays which could be transferred from municipality to municipality to save time when rewriting ordinances were also mentioned. Attendees also discussed the Rt. 291 corridor and the necessity of redeveloping it. People were confused as to why the project kept being put of f when the money has been available. The issue of riverboat gambling also arose. Some feel that a host municipality would not be willing to share the profits resulting from such activity with neigh- boring municipalities. Whether or not this issue is real enough to use as a rallying point to bring municipalities together was also discussed. Most people felt that this issue is too controversial to accomplish such a task. However, it was mentioned that perhaps the question, "Are you ready for riverboat gambling?" could be used to attract people without getting into whether they support it or oppose it. As a piggyback to the rallying ther.,@-,- Pat Killian suggested a possible motto for the Task Force, "One River, One Waterfront." It was noted that municipalities also need to realize that they must capitalize on all available resources, not just one. Perhaps we should look at the municipalities and see what sites are valuable or available for redevelopment. In many of the municipalities there are a limited number of significant real estate opportunities, so we must work with officials to develop these areas to their maximum potential. A question arose as to whether there should be an emphasis on a few large tracts of land to develop or redevelop into one use, or if the area should be broken down and used for smaller varied uses. It was noted that the new thinking in industrial development is that new industries can bring in satellite industries. It was also noted that many municipalities have trouble attracting development that will benefit them and make people want to spend time there. Some people feel that municipalities welcome anyone who wants to occupy land in their boundaries while others feel that municipalities are very picky when it comes to who purchases land. Attendees also felt that there has been a change in the perception of what is feasible and what is possible. There was a sense that we need to broaden the vision of what is possible. There is a need to dispel the fallacy that riverfront industry is dead and to convince disbelievers that the waterfront towns are user-friendly. Group Wrap-up Major goals of the Task Force: 1. Raise awareness 2. Inform and educate 3. Cooperation and coordination 4. Halt "isolationist" attitude that pervades Delaware County In closing, people generally believed that if these four issues could be brought to the attention of a few municipalities who might realize the benefits that could result from implementing such ideas, then there would be a ripple effect that would carry over to other municipalities in the County. Group B Task Force Participation General consensus was that all of the "key" players need to be involved in order f or the Task Force to -eze effective. It was noted that many municipalities were not represented at this meeting, possibly due to short staf f s or volunteer/ part-time staf f s with other day jobs. It was suggested that municipalities might be more likely to attend if the Task Force meetings are held at night or if the Task Force moves around to hold me(itings in each of the municipalities (in effect going to them instead of then coming to us). It was felt by some that the invitations to the kick-off meeting had come too late and did not sufficiently explain the potential role of the Task Force. This was suggested as one reason why people may not have come, as well as being indicative of a lack of organization and cooperation. The group felt that to keep people involved, it will be important to give them enough lead time and also more follow-through than normally occurs. Another group that was noted for its absence was developers. one person thought that it might be a good idea to have the developers in the room as well. Instructive comparisons were drawn between two other task forces, one successfully pulling all the players together and perceived as working well, one lacking municipal attendance and perceived as ineffective. Both are highway corridor intermodal task forces, but the successful one was thought to be very focused, very specific, and run by high-level PennDOT staff, thus assuring participants of catching the ear of those with decision-making power. Issues Discussed There was some confusion as to what the mission of the Task Force should or could be. With very little funding, no mandate, and no authority, it was questioned whether the Task Force could be of any use. It was suggested that the way to balance competing interests might be to make a plan, and someone else thought that might be the mission of the Task Force. One person wondered whether County Council would support the product of the Task Force, and Lois Saunders said that the Task Force can make recommendations regarding County Council's role if it wanted. Lois Saunders also explained that funding for the establishment of this Task Force was provided by a $7205 CZM grant and a $7205 County match, and that further funding was not guaranteed. Although major concerns were expressed about the possible lack of funding, one person wondered why this type of a gathering had not occurred before now, saying that the resources and problems have existed for some time and that a grant is not essent-,---Al- to this work. Development schemes were discussed. The Schuylkill River Heritage Park Corridor was mentioned as a possible model for the waterfront. The Heinz National Wildlife Refuge could function as a focus for development and/or tourism. While it was mentioned that an architect could be hired to draw up a master plan for the whole waterfront, most objected to bringing in outsiders to plan development and to the idea of a strict master plan for development. It was suggested that a function of the Task Force could be to recommend or review appropriate linkages and buffers between and among waterfront land uses. It was questioned whether the main purpose of the Task Force was to be a development commission or not. Several people mentioned that historically, community input has not been sought enough in planning efforts. For example, many agencies have plans for Tinicum Township, including the airport and the Wildlife Refuge, but the people who live there were rarely consulted as to what they would like for Tinicum. as a place in which to live and work. It was suggested that this forum is a great opportunity to air municipal concerns and/or ideas about the waterfront. Several participants felt that the existing regulations were complex, confusing, and sometimes conflicting or redundant, and that this problem has caused developers and businessmen to be apprehensive about initiating or partaking in activity on the waterfront. The issue of the need to balance environmental health with economic development was discussed at great length. An example of conflict is the dredging of the river versus preserving silt and mud flats for wildlife and birdwatchers. It was noted that the waterfront usually receives negative press, most of ten being mentioned in the context of existing or potential problems. The group felt that education and outreach are key to resolving this issue and other issues previously discussed. It was mentioned that several planning efforts focusing on the waterfront exist, including the Delaware County Planning Department's Waterfront Resources Management Study. There was general agreement that most people are not aware of the relevant reports, and that often reports are not properly utilized and/or implemented. There was a suggestion that a reading list be developed to distribute to each Task Force participant. Economic competition with Philadelphia and New CastAe- County, Delaware was also discussed. It was mentioned that Philadelphia and New Castle both have county-wide coordination; New Castle through the powers invested in the county government by the state, and Philadelphia by virtue of the fact that the city is a county unto itself. It was stressed that Delaware County needs to work extra- hard at internal coordination in order to be competitive with its two waterfront neighbors. Group Wrap-uR There was not time for a formal wrap-up, and there did not seem to be a clear agreement as to what the mission of the Task Force should be, or even whether a Task Force would be useful. However, in general the following points were stressed: 1. Increase coordination among all parties, regulations, and projects affecting development along the waterfront 2. Strike a balance between the environment and the economy 3. Stronger guidance from the Planning Department may be needed to help focus the Task Force 4. Get locals involved with the Task Force V. Wrap-up Ms. Holm thanked everyone for expressing an interest in the Task Force and encouraged their continued participation. She announced that minutes would be sent out to the entire mailing list, including all attendees, and that the next meeting is tentatively scheduled for Monday, May 22, 1995. Next Meeting(s) The Delaware County Coastal Zone-Task Force Meeting Minutes May 22, 1995 Welcome County Planning Director John Pickett (J.P.) thank,-d- everyone for their attendance, and everyone introduced themselves. County Principal Planner Karen Holm (K.H.) explained the results of the Delaware County Waterfront Resources Management Plan, prepared by DCPD in 1992, which showed that there aren't any linkages along the waterfront. She went on to explain that without linkages, Delaware County's waterfront is unable to compete with other waterfront areas in the region, such as Philadelphia and New Castle County, Delaware. The plan suggested that the formation of a task force to get the different entities talking to one another and working together should be the first step to resolving the problem. Chester City Planning Director William Payne inquired about the municipalities' responses to the study. K.H. explained that there has been little reaction since the plan was released, but that while the plan was underway the individual municipalities were polled to find out their vision of the waterfront. K.H. said that the responses varied; some being very good while others showed that some municipalities have given the matter limited consideration. K.H. discussed the misconception that the task force was being formed to develop a waterfront plan. K.H. explained that a plan could be a future project for the task force, but that consideration of developing a plan at this point would be like putting the cart before the horse. However, K.H. did stress the importance of the task force and its role in trying to develop a vision for the waterfront, which at this stage should be setting goals and getting all the key players together and talking to one another. She also explained that DCPD's role is one of facilitator with the task force determining its organization and agenda. At the end of the first year, the goal is to have established a self- sustaining task force with its own list of goals to pursue. (DCPD expects to continue working with the task force.) Results K.H. informed the attendees about DCPD's efforts to encourage municipal participation on the task force. She explained that DCPD had personally contacted the municipal manager/secretary from each of the 13 municipalities within the coastal zone via telephone. DCPD was able to set up dates for 5 of the 13 municipalities for presentations to the local governing body or local planning 'commission. Seven municipalities desired a written request to make a presentation, and only one municipality felt that a presentation would<be of no benef it. County Planning Commission vice chair Thomas Judge (T.J.) requested that the task force be provided with a list of the coastal zone municipalities so that the members could lobby the municipalities to encourage attendance and participation. J.P. named the 13 municipalities listed below. (Please note that only 6 of the 13 are actually bounded by the Delaware River.) Chester City Darby Township Eddystone Borough Folcroft Borough Lower Chichester Township Marcus Hook Borough Norwood Borough Prospect Park Borough Ridley Township Ridley Park Borough Tinicum Township Trainer Borough Upper Chichester Township The group discussed the subcommittee volunteer tally listed in the April 24th minutes. Given these results, it was decided that the Program committee should be headed by the two volunteers, Thomas O'Brien and Bruce Dorbian, serving as co-chairs. It was also decided that DCPD would develop the mission statement and the by-laws and present them to the task force for approval. DCPD would also be responsible for arranging speakers and meeting place, day, and time based on the group's preference during the first year. The members present chose not to pursue the publication of a newsletter at this time. They felt that the effort might be better served as a future activity of the task force. David Sciocchetti (D.S.) commented that the task force is an opportunity to process and resolve conflicts between the environment and economics. He also felt that the task force should establish a rallying point(s) to encourage and/or increase participation. Several issues and/or questions were posed relative to the comment. Michael Wolf recommended that the task force identify a common crisis to rally around and look for universal topics such as highways or shipbuilding. It was suggested that the task force examine the use of waterfront dynamics (e.g. Philadelphia) and that Baldwin Towers should be considered as a topic. K.H. stated that a common vision could be a rallying point and that the question, "If we could have anything we want, what would we want?" should be posed to the municipalities and other key players. J.P. suggested the issue of riverfront gambling as a rallying point. The group discussion centered around the impacts of riverfront gambling on Tinicum (potential site), the waterfront, and the County. T.J. and D.S. explained that riverfront gambling or "something else" would bring in additional tax revenues and the benefits would be spread out among the entire County. Other suggested topics included reclaiming open space, public access, and cumulative impacts of industries. In reference to public access, it was mentioned that the Chester Boat Ramp/Dock is the only lladmission-f reel' public access point on the river in Delaware County. It was explained that the boat ramp has been the victim of vandalism, but plans to expand the boat ramp are still on the books. The Fish Commission will manage the boat ramp during Chester's "distressed" period. It was suggested that public access points could be linked together, possibly via a ferry service. D.S. mentioned the John Heinz Wildlife Refuge at Tinicum as a possible site. Richard Nugent (R.N.) didn't feel that linkage to other public access points would be in keeping with the Refuge's policies which place a priority on wildlife. He also stated that the Refuge is concentrating on education. R.N. went on to mention that he was disappointed by the meeting turnout and wanted to know from where the funding and authority to continue this effort would come. D.S. remarked that there are good reasons to continue the effort. T.J. provided encouragement and said that the authority will come. III. Membership Operations This topic was tabled for the next meeting. IV. Coastal Zone Management Program Overview John Booser gave a brief synopsis of the creation of the CZM Program. He explained that the program was created in 1972 and is a partnership between the federal and state governments. He further explained that in Pennsylvania funding is filtered down to local agencies through the state government. He went on to mention that the establishment of the Delaware County Coastal Zone Task Force was f unded by a grant from the CZM Program (with 50% County match) to the County Planning Department. He stated that the grant program only funds construction projects and not maintenance projects. A discussion followed concerning the Urban Waterfront Action Group (UWAG). It was explained that the UWAG brings together a panel of experts to help facilitate [email protected] permitting process for major developments along waterfronts and that the Delaware Valley Regional Planning Commission currently stewards the program. V. Next Meeting K.H. announced that the next meeting would be a late afternoon meeting on Monday, June 26, 1995. She also stated that she hoped to be able to hold the meeting at a municipal building. K.H. announced the County's intention to adopt an Open Space grant program similar to what was implemented in Montgomery and Chester Counties. She explained that a draft plan developed by a County Council-appointed Leadership Group would be unveiled at the June 27 County Council meeting. The plan proposed $100 million grant funding for specialized categories, one of which is for Delaware River waterfront acquisition and re-greening (including coastal zone) . She pointed out that this would be a great opportunity for funding projects and that the Task Force members should start thinking about possible projects. K.H. mentioned the two volunteers for Co-chairs of the Program Subcommittee and noted that due to a time crunch in the DCPD off ice, we have not been able to put any effort towards getting the Program Subcommittee going or towards developing a well-thought out mission statement. K.H. apologized and hoped to be able to start these activities in July. V. New Business K.H. explained that so far DCPD has been targeting municipalities, regional agencies and a few large selected businesses. K. H. stated that as we begin to work on the bylaws we need to consider what specified membership we want and also how the Task Force should operate (i.e. voting procedures). K.H. asked if anyone felt that any other entity not previously mentioned should be involved with the Task Force. It was suggested that environmental groups, such as, the Environmental Advisory Council comprised of representation from Trainer, Marcus Hook and Lower Chichester should be invited to attend. It was also suggested that the current Task Force mailing list be made available to members so that they could make educated suggestions based on who is already invited to attend. K.H. said that DCPD would make this information available. K.H. opened the floor for recommendations for the Task Force bylaws. It was the groups consensus that there should be an Executive Committee comprised of representation from each of the 13 coastal zone municipalities, and authority should be given to municipal officials to designate their own representative(s). There were no suggestions as to how to determine if each municipality should be given equal representation or if representation should be based on population, size, etc... K.H. asked if attendees felt that only municipalities should be voting members with industry and County agencies only having an advisory membership or should industry and County agencies also have voting power (with municipal voting power having equal or more strength). No decision was made. K.H. said that DCPD would devise a few options and let the Task Force react to the options and make the f inal decision. K.H. posed the question as to whether rules of order should be established in the bylaws. The group felt there was no need for formalized rules of order and decided to leave the issue open. VI. Municipal Planning and Regulations County Planning Department Director John Pickett (J.P.) gave a presentation on planning and regulation in Pennsylvania. He stated that the Pennsylvania Municipalities Planning Code (Act 247, as amended) is the planning "Bible" in Pennsylvania with municipalities having the primary role and responsibility for planni<ng and zoning; the county having a secondary role. He explained that this situation poses a problem because municipalities have power but are limited because of constraints. J.P. went on further to explain that in Pennsylvania planning has three legs; comprehensive plan, subdivision and land development ordinance, and zoning ordinance. J.P. mentioned that the MPC fails to define what a comprehensive plan is; therefore, J.P. offered two definitions; "vision for future look" and "puzzle picture on the box. 11 J.P. said that zoning regulations are basically the development specifics of what, where, and how much is allowed whose purpose is to guide reasonable overall community growth. J.P. added that zoning ordinances often end up serving the same function as a comprehensive plan rather than as a tool to implement a comp plan. He explained that zoning regulations are an exercise of the police power to protect public health. He also explained that zoning should be reasonable and cannot remove all or most economic value and should ensure development compatibility with respect to district and uses. J.P. conveyed that subdivision and land development regulations in relation to zoning regulations set forth the specifics on how development should take place (i.e. design elements). He stated that the term subdivision and land development includes all development except one single family home on an already existing lot. He mentioned some of the gray areas within these regulations (i.e. what actually constitutes a land development), and noted that municipalities have to use their own discretion where things are not clearly defined. J.P. made it clear that this type of regulation is underutilized as a planning tool. J.P. mentioned that there really is a fourth leg to planning which is the official map. He went on to say that official maps allow for exact location of future public improvements to be identified, and restricts without prohibiting development within mapped areas. J.P. wrapped up his presentation by discussing the special issues pertaining to the coastal zone/waterfront. He touched on whether there is a need for the County to prepare a waterfront plan as a component of the County comprehensive plan. He noted that current plans and ordinances did not reflect or provide for the current activity taking place within the coastal zone, especially along the waterfront. Developers are coming in with their own plans, and the municipalities are unable to effectively guide the development and/or growth in these areas. J.P. stated that both zoning and subdivision/land development regulations can make special provisions for environmentally sensitive areas, but all value of the property cannot be removed. J.P. also mentioned that public dedication of parks/open space or payment of fees in lieu thereof allows for acquisition and/or development of certain areas; however, municipalities must have an adopted plan to take advantage of this option. The discussion following J.P.'s presentation included such topics as physical and visual public access which attendees felt was very limited and needed to be increased. It was suggested that we attempt to connect public access points by using abandoned railroad lines, ferries, and water taxis. It was also suggested that the Task Force members observe and study what activities are taking place across the Delaware River. The idea of developing model provisions to address waterfront issues and activities was also discussed. V'II. Next Meeting(s) K.H. announced that the next meeting would be held on Monday, July 24, 1995 at 3:00 p.m. in the Eddystone Borough Hall, and that the speaker(s) would talk about the Urban Waterfront Action Group process. K.H. also announced that the August 28th meeting will convene at 3:00 p.m., and explained that the location would be announced at the July meeting, and that DCPD was going to attempt to continue rotating the meetings from municipality to municipality. The Delaware County Coastal Zone Task Force Meeting Minutes July 24, 1995 Introductions County Planning Director John Pickett (J.P.) thank-@ad everyone for their attendance, and everyone introduced themselves. J.P. also introduced County Councilman Paul Mattus (P.M.). P.M. addressed the group, speaking about the importance of the coastal zone (riverfront) and how the construction of 1-476 brought a renewed interest into the area. He used Baldwin Towers as an example of successful reuse of an abandoned industrial site. P.M. also discussed the importance of strengthening the leisure and tourist industry in the waterfront municipalities. He spoke of the concept of a waterfront stadium and mentioned the possibility of riverfront gambling coming to the area. His overall message was that he was in favor of proactive development along the waterfront. Bruce Dorbian (B.D.) asked P.M. how to avoid or how to limit competition between municipalities. P.M. responded that if any competition were to arise, then it would be best to deal with those situations case by case. Frank Marr (F.M.) asked P.M. what were the possible locations for riverfront gambling. P.M. said that a decision hadn't been made, but that rumors about Tinicum had surfaced. Mike Wolf wanted to know the status of the Delaware County Open space Project. P.M. stated that things were still up in the air and that the final document is still being prepared. He also stated that implementation of the project would probably be subject to public vote on the April ballot. Review Minutes J.P. asked for comments pertaining to meeting minutes from June 26, 1995. There were no additions or deletions. Review Agenda J.P. asked for comments about the July 24 meeting agenda. No one commented. IV. Old Business Karen Holm (K.H.) passed out copies of the existing mailing list to all attendees and explained how the list was compiled by DCPD at the outset of this project. K.H. remarked that it would save time and money if the list could be pared down and limited to those parties who are definitely interested in or are participating on the Ta7sk Force. She requested that the attendees consider possible additions or deletions to the mailing list and tabled further discussion until the August 28th meeting. K.H. discussed the mission statement/bylaws preliminary draft that was sent to everyone on the mailing list. She explained how they were developed and asked for questions, comments, and/or suggestions. Jill Welch (J.W.) questioned how 11coordinative and advisory" and how formal was the Task Force supposed to be. K.H. responded that the Task Force was envisioned to act as a unified body that could advise and educate themselves, County Council, and the State Legislature regarding issues affecting the coastal zone. F.M. commented that he was concerned about regulatory agencies and that he wanted to be reassured that the activities of the Task Force would not be stepping on any toes or reinventing the wheel. M.W. suggested eliminating "voting" representatives as a membership category until a hot issue develops. Bill Payne (B.P.) wanted to know if there was any existing timetable for finalizing and/or adopting the bylaws. B.D. cautioned that municipal representation was still lacking, and he felt that the Task Force should focus on getting municipal commitments before finalizing bylaws. Tom Carnwath (T.C.) was concerned that there still isn't any compelling case for cooperative ventures. He suggested that we should research any previous successful cases and use those to get and to maintain municipal interest (commitment). M.W. stressed the importance of a concrete issue to galvanize interest and asked for suggestions. F.M. responded with the dredging of the Delaware River to deepen water at low tide along the back channel. K.H. mentioned the Chester City Boat Ramp and the entire issue of public access. She asked Bill Payne to explain his efforts to develop a master plan for the boat ramp. Bill Payne explained that he was finalizing the master plan and felt that the final document should be ready by late September or early October. K.H. asked for comments about the mission statement, specifically. T.C. suggested that we add "facilitators" to the mission. B.D. said that we should delete "isolationist." J.P. concluded this segment and requested that any suggestions for revisions to the bylaws, mission statement, and/or the mailing list, and a list of issues for discussion should be brought to the August meeting. V. New Business J.P. passed out an article entitled "Gambling: How It Could Be Done" from the May-June, 1995 issue of The Center for Rural Pennsylvania Newsletter. It was also mentioned that a hearing on gambling was supposedly taking place today (July 24th). He also alluded to P.M.'s update on Baldwin Towers. J.W. volunteered to speak to the Task Force about train transit and other transportation issues/concerns that should be considered when planning for waterfront development/redevelopment. K.H. said that she would follow up with J.W. to select which meeting date would be okay for J.W. Vi. Urban Waterfront Action Group A three-person panel shared its thoughts and experiences with the Urban Waterfront Action Group (UWAG) . The first person to speak was Barry Seymour (B.S.) of the Delaware Valley Regional Planning Commission. He explained that the UWAG was started in the early 1980s as a response to the rise of waterfront development/ redevelopment and the complications caused by the wide variety of permits that were required for project completion. B.S. further explained that the goal of the UWAG meeting was to limit or eliminate permits by bringing together in one room all of the permitting agencies involved in a particular project. The developer presents the project and gets feedback on the permitting process, i.e. pitfalls and other pertinent information. William Jenkins (W.J.) from the Army Corps of Engineers Regulatory Branch added that he has participated in numerous UWAG meetings as the representative from the Army Corps of Engineers and feels that the meetings are productive and worthwhile to the regulatory agencies and to the developer. Pat Quigley (P.Q.) of Pat Quigley Associates, Inc. brought the perspective of a frequent user of the UWAG meeting process. She felt that there were several pros to the program and very few cons. P.Q. stated that the UWAG process is a time saver, a "reality check" and a money saver. She also added that it allows the developer to set milestones. She said that problems can arise when an agency representative is not knowledgeable. P.Q. also said that agency follow-up can be slow and that the process is limited to large developments with impact on the waterfront (coastal zone). She said that the best results from a UWAG meeting come when the developer c-an- provide sufficient detail about the project and already has an idea of what the issues of concern are. B.S. concluded the presentation by stating that the UWAG is mainly advisory and less technical. He added that UWAG meetings provide mitigation opportunities for the developer and negotiation ammong the regulatory agencies. M.W. asked about the status of the 1987 Corps manual. The response was that the manual is currently being revised. It was also mentioned that there are two bills in Congress which severely restrict what currently can be regulated as a wetland. Vii. Introductions County Principal Planner, Karen Holm (K.H.) thank--d everyone for their attendance, and everyone introduced themselves. ii. Review Minutes K.H. asked for comments pertaining to meeting minutes from July 24, 1995. There were no changes. III. Review Agenda J.P. asked for comments about the August 28 meeting agenda. No one commented. IV. Old Business K.H. reiterated the need to pare down the current Task Force mailing list. She asked if anyone had studied the current list and if they had any suggestions for additions and/or deletions. Bill Payne (B.P.) said he did not have a copy of the current mailing list. K.H. said DCPD would get him a copy. Bruce Dorbian (B.D.) commented that the Sun Oil representative should be replaced by a staff person from the refinery, and he suggested Public Affairs Manager Shannon Breuer. K.H. discussed her efforts to recruit a PECO representative for participation on the Task Force. B.D. suggested the name Ralph Brown as a possible PECO representative. There were no other suggestions from the attendees. The concensus of the group was that the paring down of the mailing list should be left to the discretion of DCPD based on suggestions they have received and on the participation level of individuals/organizations. The discussion turned to the Task Force bylaws. K.H. explained that it is expected that the Task Force would operate on a concensus basis, but that the reason for the membership and voting language in the draft bylaws was to establish provisions for voting procedures if, for some reason, a concensus could not be reached. Attendees did not question the rationale. K.H. asked for comments about the proposed changes to Sections I and II of the bylaws. The group agreed that the proposed changes were fine. K.H. went on to discuss possible changes to Sections IIA., IIB., and IIC which refer to the perceived roles and responsibilities of the Task Force. B.D. suggested to include "New Castle County" under Section IIB1. Bob Tudor (B.T.) suggested that other funding options shou;ld- be listed under Section IIC1. K.H. responded that DCPD would furnish more options under this section. K.H. explained the rationale behind the jurisdiction language in Section III. The attendees did not object to any of the language in this section. Further discussion on the bylaws was tabled for future meetings. K.H. referred to waterfront topics that were previously discussed as possible issues the Task Force may want to address. B.P. asked about the issues mentioned in the Waterfront Resources -Management Plan, 1992 prepared by DCPD and recommended that the Task Force start addressing those issues first. K.H. said that DPCD will extract some of the issues from the plan and prepare a list for the September meeting. The discussion about possible issues the Task Force should considering addressing ensued. By the conclusion of the discussion, it appeared the public access, recreation, and waterfront gambling were the "hot" topics that the group felt strongly about. Another "hot" topic that was mentioned was the reuse of abandoned industrial sites and its effect on waterfront redevelopment. Since the guest speaker was going to address this issuel further discussion on this was put aside until later in the agenda. V. New Business B.T. announced that a one-day workshop sponsored by the Delaware Estuary Program and the Ridly-Chester-Crum Watershed Association will be held on November 18. More details will be provided at the September meeting. Francie Howat (F.H.) provided information on the Baldwin Towers project in Eddystone. She stated that a major tenant will be moving in on November 1st and a ribbon cutting ceremony would follow soon thereafter. F.H. promised to invite the Task Force members. B.P. reminded everyone about the CZM grant funding round and that the deadline for grant proposals is October 15. He felt the Task Force should find out what projects are being proposed from Delaware County and should consider endorsing and/or supporting specific projects. B.D. agreed with B.P. and strongly encouraged participation in the CZM project grant application process. He felt that more participation would make the projects more competitive and produce more quality proposals. K.H. reiterated the importance of supporting the Delaware County CZM grant applications and how presenting a united front would gain leverage with the CZM Steering Committee. She explained that in comparison with Erie-- County, the other Pennsylvania coastal zone, the grant selection process is slanted in the Delaware River coastal zone because this coastal zone spans more than one Pennsylvania county. Delaware County's representation on the CZM Steering Committee is limited to three entities whereas Philadelphia has over f ive representatives. Hence, the importance f or Delaware County entities to support each other's proposals is obvious. B.D. inquired about the Ridley Township Ball Park study and referred to the possibility of bringing about better coordination among parties that would be affected by the construction of the Ball Park. John Pickett (J.P.) offered to arrange a presentation for the Task Force on the study's results. V1. Brownfields Legislation Bruce Beitler (B.B.) of the DEP Environmental Clean-ups Program gave an overview of the federal and state change in attitude and perspective towards the clean-up of abandoned industrial sites (brownfields). He remarked that previous legislation seemed to deter the redevelopment of brownfields because the risk to developers was very high, and the clean-up standards seemed arbitrary. He stated that Pennsylvania passed a 3-part legislative package, effective July 18, 1995, that intends to alleviate the problems associated with previous state legislation. B.B. commented that the DEP Southeast region staff is still receiving training on implementation of the new legislation and that the learning curve is in effect. Under the new legislation, the developer may choose between 3 categorical standards of remediation, all of which incorporate the federal requirements. The standards' categories are more clearly defined; therefore, the developer has a better understanding of what to expect and incurs less risk. B.B. cautioned that the new legislation does not relieve banks and economic development corporations from federal liability. He felt that the upcoming Superfund Reauthorization will address the liability issue at the federal level. K. Introductions County Principal Planner, Karen Holra (K.H.) thank,@=-d- everyone for their attendance, and everyone introduced themselves. Ii. Review Minutes K.H. asked for comments pertaining to meeting minutes from August 28, 1995. She mentioned that DCPD were already aware that certain names were omitted from the attendance roster and wanted to know if anyone present knew of any other names that were omitted. No one commented. III. Review Agenda K.H. asked for comments about the September 25 meeting agenda. No one in audience commented; however, K.H. stated that discussion on the "Membership" section of the Bylaws would be tabled for the October meeting due to a lack of municipal representation at this meeting. IV. Old Business K.H. discussed the "Issues" listed on the handout that was available at the sign-in table. She elaborated on the issues that were either pulled from the Waterfront Plan or generated by Task Force members or generated by DCPD staff. She gave examples of how some of the planning issues could be addressed by the Task Force via DCPD and how transportation issues could be addressed via the DELCO TMA. Then K.H. asked if there were any issues that should be added to the list. Bill Payne (B.P.) suggested that no additions should be made and that the Task Force should concentrate on the ones already on the list. He also suggested that ranking criteria should be developed in order to prioritize the issues. K.H. said @hat DCPD would develop ranking criteria and include the issues list along with the ranking criteria in the October Task Force mailing and request responses by the October meeting (October 23rd) . Further discussion about possible issues the Task Force would want to rally around was tabled until the October meeting. V. New Business Discussion, ensued during the information sharing portion of the agenda. K.H. shared information about the proposal for a permanently moored floating entertainment barge in Tinicum. She explained how this proposal prompted her to realize the difficulty municipalities may have in regulating waterbody/waterfront activities without adequate zoning and land development controls. The siting of waste disposal facilities was also discussed in relation to exclusionary zoning, right of use and municipal impacts. B.P. suggested that the Ta-.rk Force should lobby to have zoning considerations as part of the permit review process. James Walsh offered to send DCPD the review requirements for waste disposal permits. K.H. explained that DCPD staff had been on a bus tour consisting of coastal zone sites highlighted in the 1992 Waterfront Plan. K.H. proposed that DCPD arrange a similar bus tour for interested Task Force participants in addition to or in lieu of the November meeting. The consensus was that a mid-morning to early afternoon (i.e. 10 a.m. to 2 p.m.) tour should be arranged in lieu of a November Task Force meeting. K. H. said DCPD would follow up and provide more details in the October mailing and at the October meeting. VI. Delaware Estuary Program James Walsh (J.W.) , Pennsylvania Coordinator for the Delaware Estuary Program, gave an overview of the Management Conference of the Delaware Estuary Program and explained the status of the Comprehensive Conservation Management Plan (CCMP) for the estuary. J.W. said the theme of the CCMP is sustainable development and places a heavy emphasis on achieving and maintaining an environmentally and economically sound estuary. He showed how implementation of the action items in the CCMP would accomplish this goal. VII. Next Meeting(s) K.H. announced that the next meeting would be held on Monday, October 23, 1995 at 3:00 p.m. in the City of Chester and that the Bill Payne would talk about Chester's coastal zone initiatives. K.H. reminded everyone that the bus tour would take the place of the November meeting. K.H. explained that this would be a function of the Executive Committee and that the Executive Committee would be comprised of the official participating municipal representatives. Another major matter was mentioned by Bruce Dorbian (B.D.). He was concerned that the non-municipal representation would outweigh the municipal representation because it appears that more non-municipal entities have been represented at the Task Force meetings. The comment prompted K.H. to poll the group about whether or not they felt the continuation of the Task Force would be a worthwhile effort considering we have had less than the desired participation level by municipalities. The general concensus was that the Task Force is a good idea and could be an ef f ective and productive group, but the success would be limited if more of the coastal zone municipalities don't participate. Sherice Trotter (S.T.) stated that only 5 of the 14 coastal zone municipalities have showed a consistent interest in the Task Force. Several suggestions were made to get the other 9 municipalities "on board. 11 Most of the suggestions centered around economic development and coupling County funds for development in the coastal zone with participation on the Task Force. The group also felt that although the main objective of the Task Force is to generate a regional perspective for- redevelopment of the waterfront, one role of the group should be to help the municipalities deal with issues that may only affect 1 or 2 municipalities. Michael Wolf commented that there is a wealth of expertise in the group that could be used to benefit individual municipalities when needed. For discussion purposes, the group used the proposed "Floating Entertainment and Conference Center" development in Tinicum Township as a prime example of a type of matter that could arise in an individual municipality with which the group could possibly provide technical assistance. The group discussed how they could approach municipalities that could benefit from the group's assistance. s.T. commented that a Task Force meeting could be the prime forum to discuss the issue with Tinicum representatives if they were present. V. New Business K.H. reported that the Coastal Zone Bus Tour, in lieu of a November Task Force meeting, is tentatively scheduled for November 17, 1995 from 8 a.m. to 12 noon. She sent around a sign-up sheet and explained that 20 seats were available on a first-come-first-served basis for Task Force Members. S.T. mentioned that she had attended an Urban Waterfronts National Conference in Portland, Oregon on October 19-21, 1995. She said the workshops she attended were very informative and that the conference was a great way to become a part of a valuable information network. S.T. said she would be prepared to give a more detailed report at the January meeting. VI. Public Access - Chester City Boat Ramp Master Plan Bill Payne (B.P.) , Director of Chester City Planning Department gave an overview of the Chester City Boat Ramp Master Plan and the Chester City Waterfront District Zoning Overlay. He explained that both projects are funded by CZM grants. The presentation consisted of a slide presentation of the diverse Chester waterfront, of the details for the expansion of the Chester City boat ramp, and of the plans for mixed uses in the redevelopment of Chester's waterfront. BYLAWS OF THE DELAWARE COU14TY COASTAL ZONE TASK FORCE I. CREATION AND NAME OF ORGANIZATION The Delaware County Coastal Zone Task Force, hereinafter called the "Task Force," is created in response to rece-nt-- revitalization efforts and other activities occurring along the Delaware County waterfront area, and the desire on the part of coastal zone communities and other interested parties to coordinate their efforts and activities for mutual benefit. The purpose of the Bylaws is to formalize the operation and to clarify the role of the Task Force. II. MISSION OF THE ORGANIZATION The Task Force is coordinative and advisory only. Its mission is: To heighten awareness of the coastal zone's importance by informing and educating the stakeholders about their connection to the Delaware River and to facilitate the redevelopment of the waterfront with a regional perspective by fostering cooperation and coordination among coastal zone comm"nities. Important roles and responsibilities associated with carrying out the mission include: A. Local Coordination 1. Provide a forum for discussion of coastal zone issues and other activities that are of waterfront- wide impact. 2. Facilitate the implementation of the 1992 Delaware County Waterfront Resources Management Plan, and encourage the linkage of waterfront resources. 3. Educate stakeholders on coastal zone values and opportunities. 4. Provide a local contact for interested coastal zone communities. B. Regional Coordination 1. Coordinate with other regional waterfront entities (i.e. Philadelphia, New Castle and Wilmington, DE, Camden, NJ, etc.). 2. Coordinate with other regional efforts and/or programs (i. e. Delaware Estuary Program, GreenSpace Alliance, and etc.). C. State Coordination 1. Develop projects for CZM funding. 2. via representatives on the Coastal Zone Steering Committee, a. Recommend local project funding priorities to the State CZM Program. b. Inform the CZM Program of pertinent local issues or problems. c . Recommend changes or new initiatives to the State Program. d. Other funding coalition. III, JURISDICTION The jurisdiction of the Task Force is the area encompassed by the f inal boundary of the Delaware Estuary Coastal Zone as presented in the "Commonwealth of Pennsylvania Coastal Zone Management Program and Final Environmental Impact Statement" (FEIS). The municipalities located either entirely or in part within the Coastal Zone boundary are: Chester City Darby Township Eddystone Borough Folcroft Borough Lower Chichester Township Marcus Hook Borough Norwood Borough Prospect Park Borough Ridley Township Ridley Park Borough Tinicum Township Trainer Borough Upper Chichester Township IV. MEMBERSHIP A. Permanent voting membership shall consist of 23 members from 9 member groups, and each member shall have one vote. The member groups are: Coastal Zone Municipalities - 13 votes These 13 representatives will also serve as the Executive Committee. Delaware County Government - 2 votes CCounty council, Planning commission and/or Department, Conservation District, Commerce Center, and Convention & Visitors Bureau) Industry - 2 votes (i.e. Sun Oil, British Petroleum, PECO, Scott Paper, Philadelphia Airport, Boeing, etc.) Developers - 1 vote (i.e. Henderson Group, etc.) John Heinz Wildlife Refuge at Tinicum - 1 vote RDC Institute, Inc. - I vote Delaware County Transportation Management Association - I vote Marina Owners 1 vote Citizen Groups 1 vote (i.e. Darby Creek Valley Assoc., Chester-Ridley- Crum Creeks Assoc.1 League of Women Voters, Interested Individuals, etc.) [Please note that in this scenario local municipal representation outnumbers all other combined representation 13 to 10.] B. Permanent advisory membership shall consist of 6 additional members from County Government, Industry, Developers, and Citizen member groups. Each group's additional representation shall be equal to its voting power. The Executive Committee shall invite specific organizations from the Industry, Developers, Marina Owners, Watershed, and Citizen member groups to appo:@-nt-- a representative and an alternate to serve a 2-year term as a permanent voting member. The number of organizations invited from each member group shall be equal to its voting power (see Section IV.A.). The Executive Committee shall also invite specific organizations from the Industry, Developers, and Citizen member groups to appoint a representative and an alternate to serve a 2-year term as a permanent advisory member. The number of organizations invited from each member group shall be equal to its voting power (See Section IV.A.). F. Designation of the allotted voting and advisory representation from the County Government shall be at the discretion of County Council. G. The appointing authorities of the John Heinz Wildlife Refuge at Tinicum, RDC Institute, Inc., and the Delaware County Transportation Management Association shall designate a primary representative and at least one alternate representative. No organization shall have permanent voting and permanent advisory representation during the same 2-year term. A representative shall cease being a representative of any group, government, or agency at the time said individual's affiliation with his/her organization terminates. This shall be the case for both permanent voting and advisory members. The appointing authority for a member or member group shall be asked to appoint a new representative to replace an individual who has become disaffiliated from that group. V. DUTIES AND ELECTION OF OFFICERS A. Officers of the Task Force shall be elected by the voting members. The officers shall be a Chair and a Vice chair. Defining agendas for Task Force meetings. Collaborating with the Task Force Coordinator on meeting preparations. (See Section VI.). Discharging the agenda and limiting discussion as appropriate in fulfilling this duty. Determining when an issue shall be subject to voting procedures. Serving as a standing member on any duly designated subcommittee. Representing the position of the Task Force in a public forum. D. The Vice Chair shall fulfill the responsibilities of the Chair when the Chair is unable. VI. SUPPORT A. A Coastal Zone Task Force Coordinator shall serve as support staff (non-voting) to the Task Force. The Coastal Zone Task Force Coordinator shall arrange meeting dates, prepare agendas, keep minutes, and distribute to members all information pertinent to the execution of the mission set forth for the Task Force in Section II. B. The Coastal Zone Task Force Coordinator may be a representative from any organization on the membership mailing list who offers. A memorandum of understanding (MOU) shall be established between the Task Force and the organization to set forth the length of service and other spec ifics deemed necessary by both parties. C. An organization which volunteers a representative to serve as the Task Force Coordinator shall not be precluded from having a permanent voting or permanent advisory representative. If the organization also has a permanent voting or permanent advisory representative, that representative is not required to serve a dual role; another individual may be appointed by the organization to serve as the Task Force Coord inator. D. As deemed appropriate, the Task Force -may designate subcommittees to address concerns and present recommendations to the full committee. These duties may include doing research and providing any other pertinc-nt-- support outside of regular Task Force meetings. A subcommittee may only be established by consensus of the voting members; however, any Task Force member may serve on a subcommittee. VII. MEETING AND PROCEDURES A. The Task Force shall meet at least times per year. All members shall be notified in writing at least [ _ ] days prior to every meeting. B. A quorum shall exist when at least 12 [Do we want to require a minimum number of municipal members as part of quorum?] of the voting members are in attendance. If a quorum is not present to vote on an issue, the position of each representative of a permanent voting member in attendance may be recorded. Should a matter of special importance require a vote and a quorum is not present, the Coastal Zone Task Force Coordinator may be authorized by the voting members in attendance to conduct a telephone poll of the absent voting members; the results of the poll will be distributed to all members. C. Issues brought to the Task Force shall, whenever possible, be decided by consensus of the voting members. Issues moved to a vote shall be decided by a majority vote; in the event of a tied vote, any motion shall be considered defeated. D. Rules of order shall be determined at the discretion of the Task Force. If necessary, the Task Force shall have the option to invoke Robert's Rules of Order. E. If either primary or alternate representatives of a permanent voting member group are not in attendance for two consecutive Task Force meetings, the member's voting privileges may be temporarily suspended upon the motion of voting members. The Coastal Zone Task Force Coordinator shall contact the appointing authority of any organization disqualified from voting, informing him/her of this revised voting status. Voting privileges will be restored upon receipt of written affirmation from the suspended member of the organization's intent to participate and the names of the individuals who are primary and alternate representatives and upon that organization's representation at the next scheduled meeting. No distinction should be made between excused and unexcused absences. [Do we want similar provisions/penalties for permanent advisory member absenteeism?] F. The Task Force shall maintain a mailing list of interested parties. BYLAWS These bylaws and any amendments thereto shall be effective immediately upon adoption. These bylaws may be amended at any meeting of the Task Force upon [_] days written notice to all members. A two-thirds quorum vote of the members attending the Task Force meeting at which said amendment is acted upon shall be required for passage of any amendment. All meetings of the Coastal Zone Task Force shall be advertised and are open to the public, pursuant to the Act of July 3, 1986-84, known as the Sunshine Act. The secretary shall insure that notices of meetings are made in accordance with the Sunshine Act provisions. The public may attend any meeting; however, the ability to comment shall be subject to the discretion of the permanent voting membership.
