NATIONAL PARK FOUNDATION REAUTHORIZATION ACT OF 2022

The Committee on Natural Resources, to whom was referred
the bill (H.R. 7693) to amend title 54, United States Code, to
reauthorize the National Park Foundation, having considered the
same, reports favorably thereon without amendment and
recommends that the bill do pass.
Purpose of the Bill
The purpose of H.R. 7693 is to reauthorize federal funding
for the National Park Foundation.
Background and Need for Legislation
The National Park Foundation was established by Congress in
1967 with a mission to generate private support and build
strategic partnerships to protect and enhance America's
national parks for present and future generations. As the
official nonprofit partner of the National Park Service, the
foundation leverages federal investments with private
donations, raising more than $100 million each year to help pay
for park improvements and projects designed to improve visitor
experience. The National Park Foundation has, to date, received
a total of $23 million in federal appropriations. H.R. 7693
would reauthorize federal funding for the National Park
Foundation through FY 2030 and increase the annual
authorization level from $5 million to $15 million.
It is the hope of the Committee that this increased
authorization will allow NPF to address more projects at our
nation's parks, particularly those with a direct impact on
visitor services such as trail improvements or projects that
alleviate overcrowding.
Committee Action
H.R. 7693 was introduced on May 10, 2022, by Ranking Member
Bruce Westerman (R-AR). The bill was referred solely to the
Committee on Natural Resources, and within the Committee to the
Subcommittee on National Parks, Forests, and Public Lands. On
July 13, 2022, the Natural Resources Committee met to consider
the bill. The Subcommittee was discharged by unanimous consent.
No amendments were offered. The bill was adopted and ordered
favorably reported to the House of Representatives by unanimous
consent.

Committee Oversight Findings and Recommendations
Regarding clause 2(b)(1) of rule X and clause 3(c)(1) of
rule XIII of the Rules of the House of Representatives, the
Committee on Natural Resources' oversight findings and
recommendations are reflected in the body of this report.
Compliance With House Rule XIII and Congressional Budget Act
1. Cost of Legislation and the Congressional Budget Act.
The bill has been noticed for consideration by the House under
suspension of the rules without amendment. With respect to the
requirements of clause 3(c)(2) and (3) of rule XIII of the
Rules of the House of Representatives and sections 308(a) and
402 of the Congressional Budget Act of 1974, the Committee has
requested from the Director of Congressional Budget Office a
cost estimate for this bill and a statement as to whether this
bill contains any new budget authority, spending authority,
credit authority, or an increase or decrease in revenues or tax
expenditures. The Committee has received the following partial
response for the bill from the Director of the Congressional
Budget Office, which reflects the text of the bill as
introduced, as reported, and as noticed for suspension:
Legislation Considered Under Suspension of the Rules
The Majority Leader of the House of Representatives
announces bills that will be considered under suspension of the
rules in that chamber. Under suspension, floor debate is
limited, all floor amendments are prohibited, points of order
against the bill are waived, and final passage requires a two-
thirds majority vote.
At the request of the Majority Leader and the House
Committee on the Budget, CBO estimates the effects of those
bills on direct spending and revenues. CBO has limited time to
review the legislation before consideration. Although it is
possible in most cases to determine whether the legislation
would affect direct spending or revenues, time may be
insufficient to estimate the magnitude of those effects. If CBO
has prepared estimates for similar or identical legislation, a
more detailed assessment of budgetary effects, including
effects on spending subject to appropriation, may be included.

The Committee adopts as its own any finalized additional
materials of the Director of the Congressional Budget Office
regarding the bill, should such materials be made available
before House passage of the bill.
2. General Performance Goals and Objectives. As required by
clause 3(c)(4) of rule XIII, the general performance goals and
objectives of this bill are to reauthorize federal funding for
the National Park Foundation.
Earmark Statement
This bill does not contain any Congressional earmarks,
limited tax benefits, or limited tariff benefits as defined
under clause 9(e), 9(f), and 9(g) of rule XXI of the Rules of
the House of Representatives.
Unfunded Mandates Reform Act Statement
An estimate of federal mandates prepared by the Director of
the Congressional Budget Office pursuant to section 423 of the
Unfunded Mandates Reform Act was not made available to the
Committee in time for the filing of this report. The Chair of
the Committee shall cause such estimate to be printed in the
Congressional Record upon its receipt by the Committee.
Existing Programs
This bill does not establish or reauthorize a program of
the federal government known to be duplicative of another
program.
Applicability to Legislative Branch
The Committee finds that the legislation does not relate to
the terms and conditions of employment or access to public
services or accommodations within the meaning of section
102(b)(3) of the Congressional Accountability Act.
Preemption of State, Local, or Tribal Law
Any preemptive effect of this bill over state, local, or
tribal law is intended to be consistent with the bill's
purposes and text and the Supremacy Clause of Article VI of the
U.S. Constitution.

SECTION 101122 OF TITLE 54, UNITED STATES CODE
Sec. 101122. Authorization of appropriations; use of funds
(a) Authorization of Appropriations.--There are authorized to
be appropriated to carry out this subchapter [$5,000,000]
$15,000,000 for each of fiscal years 2017 through [2023] 2030.
(b) Use of Funds.--Funds made available under subsection
(a)--
(1) may be advanced each fiscal year to the National
Park Foundation in a lump sum without regard to when
expenses are incurred;
(2) shall be provided to the National Park Foundation
for use to match contributions (whether in currency,
services, or property) made to the Foundation;
(3) may not be used by the National Park Foundation
for administrative expenses of the Foundation,
including for salaries, travel and transportation
expenses, and other overhead expenses; and
(4) may not be deposited by the National Park
Foundation into any fund that will be invested or earn
interest in any way.
