      PROVIDING FOR CONSIDERATION OF THE BILL (H.R. 2740) MAKING 
APPROPRIATIONS FOR THE DEPARTMENTS OF LABOR, HEALTH AND HUMAN SERVICES, 
    AND EDUCATION, AND RELATED AGENCIES FOR THE FISCAL YEAR ENDING 
     SEPTEMBER 30, 2020, AND FOR OTHER PURPOSES, AND PROVIDING FOR 
CONSIDERATION OF THE RESOLUTION (H. RES. 430) AUTHORIZING THE COMMITTEE 
 ON THE JUDICIARY TO INITIATE OR INTERVENE IN JUDICIAL PROCEEDINGS TO 
            ENFORCE CERTAIN SUBPOENAS AND FOR OTHER PURPOSES

                       [To accompany H. Res. 431]

    The Committee on Rules, having had under consideration 
House Resolution 431, by a record vote of 8 to 4, report the 
same to the House with the recommendation that the resolution 
be adopted.

                SUMMARY OF PROVISIONS OF THE RESOLUTION

    The resolution provides for consideration of H.R. 2740, the 
Labor, Health and Human Services, Education, Legislative 
Branch, Defense, State, Foreign Operations, and Energy and 
Water Development Appropriations Act, 2020, under a structured 
rule. The resolution provides one hour of general debate 
equally divided and controlled by the chair and ranking 
minority member of the Committee on Appropriations. The 
resolution waives all points of order against consideration of 
the bill. The resolution provides that an amendment in the 
nature of a substitute consisting of the text of Rules 
Committee Print 116-17, modified by the amendment printed in 
Part A of this report, shall be considered as adopted and the 
bill, as amended, shall be considered as read. The resolution 
waives all points of order against provisions in the bill, as 
amended, for failure to comply with clause 2 of rule XXI. The 
resolution makes in order only those further amendments printed 
in Part B of this report, amendments en bloc described in 
section 3, and pro forma amendments described in section 4. 
Each amendment printed in this report may be offered only in 
the order printed in this report, may be offered only by a 
Member designated in this report, shall be considered as read, 
shall be debatable for the time specified in this report 
equally divided and controlled by the proponent and an 
opponent, may be withdrawn by the proponent at any time before 
action thereon, shall not be subject to amendment except as 
provided by section 4, and shall not be subject to a demand for 
division of the question. The resolution waives all points of 
order against the amendments printed in Part B of this report 
or against amendments en bloc described in section 3. Section 3 
permits the chair of the Committee on Appropriations or her 
designee to offer amendments en bloc if those amendments have 
been printed in this report and not earlier disposed of. 
Amendments en bloc shall be considered as read, shall be 
debatable for 20 minutes equally divided and controlled by the 
chair and ranking minority member of the Committee on 
Appropriations, shall not be subject to amendment, and shall 
not be subject to a demand for division of the question. The 
resolution provides that the chair and ranking minority member 
of the Committee on Appropriations or their designees may offer 
up to fifteen pro forma amendments each at any point for the 
purpose of debate. The resolution provides that at the 
conclusion of consideration of the bill for amendment, the 
Committee of the Whole shall rise without motion and no further 
consideration of the bill shall be in order except pursuant to 
a subsequent order of the House. The resolution provides that 
during consideration of H.R. 2740, it shall not be in order to 
consider an amendment proposing both a decrease in an 
appropriation designated pursuant to section 251(b)(2)(A)(ii) 
of the Balanced Budget and Emergency Deficit Control Act of 
1985 and an increase in an appropriation not so designated, or 
vice versa, but does not apply to an amendment between the 
Houses. The resolution provides for consideration of H. Res. 
430, Authorizing the Committee on the Judiciary to initiate or 
intervene in judicial proceedings to enforce certain subpoenas 
and for other purposes, under a closed rule. The resolution 
provides one hour of debate equally divided and controlled by 
the chair and ranking minority member of the Committee on 
Rules. The resolution waives all points of order against 
consideration of the resolution. The resolution provides that 
the amendment in the nature of a substitute recommended by the 
Committee on Rules now printed in the resolution shall be 
considered as adopted and the resolution, as amended, shall be 
considered as read.

                         EXPLANATION OF WAIVERS

    The waiver of all points of order against consideration of 
H.R. 2740 includes waivers of the following:
     Section 306 of the Congressional Budget Act, which 
prohibits consideration of legislation within the jurisdiction 
of the Committee on the Budget unless referred to or reported 
by the Budget Committee.
     Clause 12(a)(1) of rule XXI, which prohibits 
consideration of a bill unless there is a searchable electronic 
comparative print that shows how the bill proposes to change 
current law.
     Clause 12(b) of rule XXI, which prohibits 
consideration of a bill unless there is a searchable electronic 
comparative print that shows how the text of the bill as 
proposed to be considered differs from the text of the bill as 
reported.
     Section 314(f) of the Congressional Budget Act, 
which prohibits the consideration of legislation that provides 
budget authority for a fiscal year that exceeds either of the 
discretionary statutory spending limits.
     Clause 10 of rule XXI, which prohibits 
consideration of a measure that has a net effect of increasing 
the deficit or reducing the surplus over the five- or 10-year 
period.
    The waiver of points of order against provisions in H.R. 
2740, as amended, for failure to comply with clause 2 of rule 
XXI includes a waiver of the following:
     Clause 2 of rule XXI, which prohibits unauthorized 
appropriations or legislative provisions in an appropriations 
bill.
    The waiver of all points of order against amendments to 
H.R. 2740 includes a waiver of the following:
     Clause 2(c) of rule XXI, which requires that 
limitation amendments be offered at the end of the bill. The 
waiver is necessary because the limitation amendments printed 
in this report will be offered at the end of each division. It 
should be noted that sponsors of such amendments complied with 
Rules Committee guidance when drafting amendments to the end of 
divisions rather than the end of the bill.
    The waiver of all points of order against consideration of 
H. Res. 430 includes a waiver of the following:
     Clause 4(a) of rule XIII, which prohibits the 
consideration of a measure or matter reported by a committee 
until the proposed text of the report has been available for 72 
hours.

    11. Smith, Christopher (NJ): Redirects $2 million from 
Program Administration under Departmental Management at the 
Department of Education to Emerging Zoonotic and Infectious 
Diseases at the Centers for Disease Control and Prevention for 
Lyme Disease. (10 minutes)
    12. Scott, Bobby (VA): Prohibits the Occupational Safety 
and Health Administration (OSHA) from using funds appropriated 
in this Act to finalize or implement a proposed rule to weaken 
health protections in OSHA's existing beryllium standards that 
cover construction and maritime workers. (10 minutes)
    13. DeFazio (OR), Newhouse (WA), Gianforte (MT), Schrader 
(OR): Prohibits any funds appropriated to the Job Corps program 
from being used to either alter or terminate the Interagency 
Agreement between the U.S. Departments of Labor and Agriculture 
that governs the Job Corps Civilian Conservation Center (CCC) 
program. It would also prohibit any funds appropriated to the 
Job Corps program from being used to close any of the 25 CCCs 
that are currently operating. (10 minutes)
    14. Jackson Lee (TX): Increases and decreases by 
$10,000,000 increase in funding to support greater diversity in 
the pool of diabetes research professionals and patients 
participating in clinical trials. (10 minutes)
    15. Jackson Lee (TX): Increases and decreases by 
$10,000,000 to support programs providing outreach and support 
services targeting program participants at greatest risk of not 
completing a college degree. (10 minutes)
    16. Pascrell (NJ), Collins, Chris (NY): Increases FY20 
funding for the National Institute for Occupational Safety and 
Health (NIOSH) by $900,000, with the intent to obligate that 
$900,000 to the Firefighter Cancer Registry within NIOSH. It 
offsets this increase by reducing General Departmental 
Management funding for the Department of Health and Human 
Services (HHS) by $900,000. (10 minutes)
    17. Davis, Danny K. (IL), Burgess (TX), Butterfield (NC): 
Increases funding to the account of Birth Defects, Development 
Disabilities, Disabilities and Health by $2,000,000, and 
decrease the administration account in the Office of the 
Secretary of Health and Human Services by $2,000,000. Currently 
under this account, there are zero dollars allocated for the 
Public Health Approach to Blood Disorders Program for Sickle 
Cell Disease that will support the CDC's sickle cell disease 
surveillance program to better identify affected individuals, 
to understand their health outcomes, and to evaluate strategies 
to prevent complications and risk factors that affect 
individuals living with this disease. (10 minutes)
    18. Buchanan (FL): Increases and decreases by $6,250,000 
the funding for the National Institute of Environmental Health 
Sciences under the National Institute of Health in order to 
support research into the impact of red tide and other Harmful 
Algal Blooms on human health. (10 minutes)
    19. Langevin (RI): Increases funding for the Lifespan 
Respite Care Program. (10 minutes)
    20. Foster (IL), Kelly, Mike (PA): Strikes Section 510 of 
the Labor-HHS Appropriations bill which currently prohibits HHS 
from spending any federal dollars to promulgate or adopt a 
national patient identifier. (10 minutes)
    21. Foster (IL), Kim (NJ): Adds and removes $1 from the 
Substance Abuse Treatment fund to instruct HHS to prioritize 
funding for Medication Assisted Treatment. (10 minutes)
    22. Foster (IL), Blunt Rochester (DE), Pappas (NH), Stevens 
(MI): Adds and removes $1 from the Bureau of Labor Statistics 
for the purpose of instructing BLS to accept a wider and more 
forward-looking range of inputs into its range of projections 
for its workforce of the future and should conduct the 
Contingent Worker and Alternative Work Arrangement Supplement 
(CWS) to the Current Population Survey. BLS should submit to 
Congress an estimate of the resources it would need to make a 
range of forward-looking estimates, including consultation with 
those industries that are driving rapid technological change 
and those that will be affected by that change to account for 
the increasing rate of technological job displacement. (10 
minutes)
    23. Foster (IL): Increases the Biomedical Advanced Research 
and Development Authority account by $1,000,000 to support 
increased R&D for biosecurity. (10 minutes)
    24. Schiff (CA): Decreases the Health and Human Services 
General Departmental Management fund by $5 million and then 
increases the same fund by $5 million for the purposes of 
highlighting the Office of the Assistant Secretary for Health's 
work in coordinating a national public health campaign to fight 
vaccine misinformation, funding vaccine communication research 
to strengthen the evidence base for what works in fighting 
vaccine hesitance, and encouraging vaccine counseling. (10 
minutes)
    25. McKinley (WV), Doyle (PA): Fully funds Sec. 7081 of the 
SUPPORT Act, preventing overdoses while in emergency rooms. The 
program would create a coordinated care model for overdose 
patients who present in the emergency room. (10 minutes)
    26. Butterfield (NC): Provides funding to expand the 
National Survey of Child and Adolescent Well-Being to include a 
study of children impacted by a parent's substance addiction to 
better understand the opioid epidemic's impact on maltreated 
children. (10 minutes)
    27. Johnson, Bill (OH), Tonko (NY): Funds Section 7101 of 
the SUPPORT for Patients and Communities Act at the authorized 
level to establish Regional Centers of Excellence in Substance 
Use Disorder Education. (10 minutes)
    28. Moore (WI): Provides additional resources to the CDC to 
address and better understand the causes of the thousands of 
sudden unexpected deaths of children and infants that occur 
annually in our nation. (10 minutes)
    29. Moore (WI), Speier (CA), Pressley (MA): Increases 
funding for the CDC's Domestic Violence Community Projects. (10 
minutes)
    30. Moore (WI): Provides $1,000,000 for the distribution of 
Fentanyl Sticks. (10 minutes)
    31. Hudson (NC): Increases and decreases by $25,000,000 for 
funding for the Office of Head Start's Designation Renewal 
System. (10 minutes)
    32. Matsui (CA): Increases by $2 million the administration 
for community living aging and disability services programs to 
support innovative programs that assist young people with 
developmental disabilities in obtaining and sustaining long 
term employment, and that prepare employers to support the 
success of those employees and decreases general department 
management by $2 million. (10 minutes)
    33. Barr (KY): Increases the Substance Abuse Treatment 
program by $1,000,000 with the intention of this increase in 
funding being allocated to the Building Communities of Recovery 
program. This increase will strengthen our communities' 
response to the opioid epidemic by promoting prevention, 
treatment, and recovery initiatives for individuals struggling 
with substance abuse. (10 minutes)
    34. Cleaver (MO): Increases funding for the substance abuse 
and mental health services administration by $6.5 million in 
order to support youth suicide prevention strategies This 
funding would supplement the Garrett Lee Smith State/Tribal 
Youth Suicide Prevention and Early Intervention Grant Program.

    35. Grothman (WI): Reduces the amount of funding provided 
by Division A by 4.5 percent across-the-board. (10 minutes)
    36. Castor (FL), Underwood (IL), Barragan (CA), DeSaulnier 
(CA), Spanberger (VA), Moore (WI): None of the funds made 
available by this Act may be used to implement, administer or 
enforce the Trump administration's short-term, limited duration 
insurance rule. (10 minutes)
    37. Hill, French (AR): Transfers $90 million from the ACA 
navigator program to the National Institute of Mental Health. 
(10 minutes)
    38. Hill, French (AR): Allows grant funds for 
apprenticeships to be used for apprenticeship programs 
registered with the U.S. Department of Labor (DOL) as well as 
industry-recognized apprenticeship programs. (10 minutes)
    39. Speier (CA), Moore (WI), Pressley (MA): Increases CDC's 
Rape Prevention and Education program. (10 minutes)
    40. Khanna (CA), Gonzalez, Anthony (OH): Increases funding 
for the National Institute of Allergy and Infectious Disease by 
$3 million with the intent to support the Consortium of Food 
Allergy Research. Reduces funding for the Office of the 
Secretary of Education's administrative account. (10 minutes)
    41. Richmond (LA): Increases funding for Maternal and Child 
Health accounts by $7,000,000. (10 minutes)
    42. Banks (IN): Reduces spending for each amount in 
Division A by 14 percent. (10 minutes)
    43. Keating (MA): Increases and decreases by $1,000,000 to 
propose a study to examine how HHS can facilitate ways to 
include programs for social determinants of health under the 
same roof as traditional health services, and estimate what 
amount of additional funding might be required. (10 minutes)
    44. Miller (WV): Increases funding for Neonatal Abstinence 
Syndrome research by $2 million, offset by spending in the 
office of the Secretary. (10 minutes)
    45. Cicilline (RI): Increases funding for American History 
and Civics National Activities under the Elementary and 
Secondary Education Act by $500,000. (10 minutes)
    46. Bera (CA), Murphy (FL), Soto (FL): Subtracts and then 
adds $1 from SAMHSA Mental Health account to specify that 
SAMHSA should explore using its funds to explore peer to peer 
mental health programs for first responders. The LHHS report 
includes language encouraging SAMHSA to examine PTSD among 
first responders. (10 minutes)
    47. Castro (TX): Ensures that the Office of Refugee 
Resettlement reports all children's deaths that occur while 
children are in their custody. (10 minutes)
    48. Jeffries (NY): Prohibits funds from being used to limit 
the functions of the Department of Education Office for Civil 
Rights. (10 minutes)
    49. Maloney, Sean (NY): Increases and decreases by 
$5,000,000 for fund to be used specifically study the impact of 
firearm violence in elementary and secondary schools and higher 
education institutions. (10 minutes)
    50. Adams (NC), Huffman (CA), Davis, Susan (CA), Moulton 
(MA), Bonamici (OR), Lowenthal (CA): Increases the Higher 
Education account by $500,000. Funding intended to be used to 
keep open the National Center for College Students with 
Disabilities. (10 minutes)
    51. Adams (NC): Increase funding for the Children and 
Families Services Programs account by $3 million. Decreases the 
Departmental Management account by $3 million. (10 minutes)
    52. Beyer (VA): Increases and decreases funds by $500,000 
to support the Secretary of Health and Human Services to 
conduct a feasibility study on allowing geolocation services 
with respect to the location of callers to the suicide 
prevention lifeline referred to in section 520E-3 of the Public 
Health Service Act (42 U.S.C. 6 290bb-3c). (10 minutes)
    53. Beyer (VA): Requires the Secretary of Health and Human 
Services, acting through the Office of Refugee Resettlement, to 
disclose to committees of jurisdiction and legal orientation 
providers a monthly census per facility, broken down by gender 
and age group, of unaccompanied alien children in the custody 
of the Department of Health and Human Services, including 
locations operated through a contract with any other entity 
(including a Federal, State, or local agency). (10 minutes)
    54. Blunt Rochester (DE): Increases and decreases $1 from 
the Health Resources and Services Administration with respect 
to the health workforce and health professional staffing 
shortages. (10 minutes)
