  PROVIDING FOR CONSIDERATION OF THE JOINT RESOLUTION (H.J. RES. 117) 
 MAKING CONTINUING APPROPRIATIONS FOR FISCAL YEAR 2013, AND FOR OTHER 
 PURPOSES; AND PROVIDING FOR CONSIDERATION OF THE BILL (H.R. 6365) TO 
AMEND THE BALANCED BUDGET AND EMERGENCY DEFICIT CONTROL ACT OF 1985 TO 
  REPLACE THE SEQUESTER ESTABLISHED BY THE BUDGET CONTROL ACT OF 2011

                       [To accompany H. Res. 778]

    The Committee on Rules, having had under consideration 
House Resolution 778, by a record vote of 8 to 3, report the 
same to the House with the recommendation that the resolution 
be adopted.

                SUMMARY OF PROVISIONS OF THE RESOLUTION

    The resolution provides for consideration of H.J. Res. 117, 
the Continuing Appropriations Resolution, 2013, under a closed 
rule. The resolution provides one hour of debate equally 
divided and controlled by the chair and ranking minority member 
of the Committee on Appropriations. The resolution waives all 
points of order against consideration of the joint resolution. 
The resolution provides that the joint resolution shall be 
considered as read. The resolution waives all points of order 
against provisions in the joint resolution. The resolution 
provides one motion to recommit.
    Section 2 of the resolution provides for consideration of 
H.R. 6365, the National Security and Job Protection Act, under 
a closed rule. The resolution provides one hour of debate 
equally divided and controlled by the chair and ranking 
minority member of the Committee on the Budget. The resolution 
waives all points of order against consideration of the bill. 
The resolution provides that the bill shall be considered as 
read. The resolution waives all points of order against 
provisions in the bill. Finally, the resolution provides one 
motion to recommit.

                         EXPLANATION OF WAIVERS

    The waiver of all points of order against consideration of 
H.J. Res. 117 includes a waiver of section 302(f) of the 
Congressional Budget Act, prohibiting consideration of 
legislation providing new budget authority in excess of a 
committee's 302 allocation of such authority.
    Although the rule waives all points of order against 
provisions in H.J. Res. 117, the Committee is not aware of any 
points of order. The waiver is prophylactic in nature.

    Motion by Ms. Slaughter to amend the rule for H.R. 6365 to 
make in order and provide the appropriate waivers for amendment 
#1, offered by Rep. Van Hollen (MD), which would replace the 
entire sequester for 2013--which would cause deep cuts to 
important domestic priorities and defense, and even cut 
Medicare--with savings from specific policies that reflect a 
balanced approach to deficit reduction. Would protect our most 
vulnerable citizens, asks those earning over $1 million per 
year to contribute more, eliminates Agriculture direct 
payments, and cuts subsidies for Big Oil. Defeated: 3-8.
