PROVIDING FOR CONSIDERATION OF THE BILL (H.R. 1173) TO REPEAL THE CLASS 
                                PROGRAM

    The Committee on Rules, having had under consideration 
House Resolution 522, by a nonrecord vote, report the same to 
the House with the recommendation that the resolution be 
adopted.

                SUMMARY OF PROVISIONS OF THE RESOLUTION

    The resolution provides for consideration of H.R. 1173, the 
Fiscal Responsibility and Retirement Security Act of 2011, 
under a modified open rule. The resolution provides one hour of 
general debate on the bill, with 40 minutes equally divided and 
controlled by the chair and ranking minority member of the 
Committee on Energy and Commerce and 20 minutes equally divided 
and controlled by the chair and ranking minority member of the 
Committee on Ways and Means. The resolution waives all points 
of order against consideration of the bill. The resolution 
makes in order the amendment in the nature of a substitute 
recommended by the Committee on Energy and Commerce now printed 
in the bill as original text for purpose of amendment and 
provides that it shall be considered as read. The resolution 
waives all points of order against the committee amendment in 
the nature of a substitute. The resolution makes in order only 
those amendments that are submitted for printing in the 
Congressional Record not later than the legislative day of 
Tuesday, January 31, 2012, or pro forma amendments for the 
purpose of debate. Each such amendment may be offered only by 
the Member who caused it to be printed or a designee, and each 
amendment shall be considered as read if printed. The 
resolution provides that after general debate the bill shall be 
considered for amendment for a period not to exceed three 
hours. The resolution provides one motion to recommit with or 
without instructions.

                         EXPLANATION OF WAIVERS

    The waiver of all points of order against consideration of 
the bill includes a waiver of clause 3(c)(4) of rule XIII, 
requiring the inclusion of general performance goals and 
objectives in a committee report. The waiver is necessary 
because the Committee on Ways and Means Report [H. Rept. 112-
342, Part 2] did not include an adequate statement of general 
performance goals and objectives.
    Although the resolution waives all points of order against 
the committee amendment in the nature of a substitute 
recommended by the Committee on Energy and Commerce, the 
Committee is not aware of any points of order. The waiver is 
prophylactic in nature.
