Jurisdiction and Functions of the Committee
The Committee on the Budget was established by the
Congressional Budget Act of 1974. The Budget Committee is
responsible for developing and reporting the annual
congressional budget resolution, assembling and reporting any
reconciliation legislation required by that resolution, and
implementing and governing the congressional budget process
generally.
The budget resolution provides an overall framework and
plan for action on spending, revenue, and debt limit
legislation. It sets ceilings on total budget authority and
outlays and a floor on total revenues. It also allocates
spending authority to the appropriations committees and among
the various authorizing committees that have jurisdiction over
direct spending programs. The limits and allocations set by the
budget resolution are enforced through points of order.
The budget may also include the optional reconciliation
process, which directs appropriate authorizing committees to
revise programs under their jurisdiction in order to adjust
either projected spending or revenues by specified amounts. If
more than one committee receives reconciliation instructions,
the Budget Committee is responsible for assembling the reports
submitted by the various committees for consideration on the
House floor.
In addition to its legislative duties, the Budget Committee
also has responsibility for oversight and studies related to
the budget process.
The Budget Committee's jurisdictional statement for the
111th Congress, House Rule X, clause 1(d), is as follows:
(1) Concurrent resolutions on the budget (as defined in
section 3(4) of the Congressional Budget Act of 1974), other
matters required to be referred to the committee under titles
III and IV of that Act, and other measures setting forth
appropriate levels of budget totals for the United States
Government.
(2) Budget process generally.
(3) Establishment, extension, and enforcement of special
controls over the Federal budget, including the budgetary
treatment of off-budget Federal agencies and measures providing
exemption from reduction under any order issued under part C of
the Balanced Budget and Emergency Deficit Control Act of 1985.
Summary of Activities
FISCAL YEAR 2010 BUDGET RESOLUTION
On March 25, 2009, the House Budget Committee began
consideration of House Concurrent Resolution 85 (H. Con. Res.
85), the concurrent resolution on the budget for fiscal year
2010, with markup of the Chairman's mark. Of the twenty-eight
amendments offered for a vote, one was adopted. The Committee
agreed by voice vote to a Sense of House amendment offered by
Mr. Ryan and Ms. Moore on the need for legislative action to
ensure that states have necessary resources to collect child
support and that the support pass on to families without
financial penalty. By a vote of 24 to 15, the Committee on the
Budget voted to report out H. Con. Res. 85 favorably to the
House of Representatives and the report accompanying the
concurrent resolution, House Report 111-60, was timely filed.
The Committee on Rules reported H. Res. 305, a rule
allowing consideration of H. Con. Res. 85, on March 31, 2009
(House Report 111-70). The rule provided for four hours of
general debate, with three hours controlled and equally divided
by the Chairman and Ranking Member of the Budget Committee and
one hour controlled and equally divided by Ms. Maloney and Mr.
Brady of the Joint Economic Committee. The rule also allowed
for consideration of four alternative budgets: the Progressive
Caucus substitute offered by Ms. Woolsey; the Republican Study
Committee substitute offered by Mr. Jordan; the Congressional
Black Caucus substitute offered by Ms. Lee; and the Republican
substitute offered by Mr. Ryan. The House adopted H. Res. 305
on April 1, 2009.
Pursuant to H. Res. 305, the House began consideration of
H. Con. Res. 85 on April 1, 2009. On the same day, the
Committee on Rules also reported H. Res. 316 (House Report 111-
73), a rule declaring the House to be resolved into the
Committee of the Whole House on the state of the Union for
further consideration of H. Con. Res. 85 and making it in order
to take from the Speaker's table Senate Concurrent Resolution
13 (S. Con. Res. 13) for consideration after adoption of H.
Con. Res. 85. The House adopted H. Res. 316 on April 2, 2009,
on a 242 to 182 vote.
All four budget substitutes made in order to H. Con. Res.
85 were defeated on recorded votes. H. Con. Res. 85 was agreed
to on a vote of 233 to 196 on April 2, 2009.
On March 27, 2009, the Senate Budget Committee reported as
an original measure S. Con. Res. 13, the fiscal year 2010
budget resolution. On April 2, 2009, S. Con. Res. 13, as
amended, was agreed to in the Senate on a 55 to 43 vote. The
House received the message on Senate action April 21, 2009.
Pursuant to H. Res. 316, the House took from the Speaker's
table S. Con. Res. 13 on April 22, 2009, striking all after the
resolving clause and inserting the text of H. Con. Res. 85 as
adopted by the House while insisting on its amendment and
requesting a conference. The House then considered a motion
offered by Mr. Ryan to instruct conferees on S. Con. Res. 13,
which was defeated on a 196 to 227 vote. The Speaker appointed
conferees.
The Senate received the message on House action on April
23, 2009. The Senate disagreed with the House amendment and
agreed to a request for a conference. The Senate considered
motions to instruct conferees and appointed conferees. The
message on Senate action was sent to the House on April 24,
2009.
The conference report on S. Con. Res. 13 (House Report 111-
89) was filed April 27, 2009. The following day the Committee
on Rules reported H. Res. 371, a rule providing for the
consideration of the conference report on S. Con. Res. 13 that
allowed one hour of general debate.
Mr. Spratt brought up the conference report under the
provisions of H. Res. 371 and the House began to debate the
measure on April 28, 2009. On April 29, 2009, the House
continued debate and, on a 233 to 193 vote, adopted the
conference report. The Senate agreed to the conference report
on a 53 to 43 vote.
THE HEALTH CARE AND EDUCATION RECONCILIATION ACT OF 2010
Section 202 of S. Con. Res. 13, the fiscal year 2010
budget, included two reconciliation instructions. One
reconciliation instruction was written for the Committees on
Energy and Commerce, Ways and Means, and Education and Labor on
health care reform. The other reconciliation instruction was
written for the Committee on Education and Labor on education
investment.
On March 15, 2010, the Committee on the Budget met to
consider H.R. 4872, the Health Care and Education
Reconciliation Act of 2010, which packaged the reconciliation
submissions ``without any substantive revision'' per section
310(b)(2) of the Congressional Budget Act of 1974. H.R. 4872
included the recommendations on health care reform submitted in
October of 2009 by the Committee on Ways and Means and the
recommendations on health care reform and education investment
submitted by the Committee on Education and Labor. The
Committee on Energy and Commerce did not submit any
recommendations.
The Committee on the Budget voted on a 21 to 16 margin to
report out H.R. 4872 favorably. Following the vote, the
Committee met to consider 20 non-binding motions directing the
Chairman to make specific requests of the Committee on Rules
regarding H.R. 4872, with 10 of the motions passing.
On March 17, 2010, the Committee on the Budget reported the
Health Care and Education Reconciliation Act of 2010 (House
Report 111-443). On March 21, 2010, the Committee on Rules
reported H. Res. 1203, a rule that provided for consideration
of H.R. 4872 with 2 hours of general debate. H. Res. 1203
passed on a 224 to 206 vote. Mr. Camp moved to recommit H.R.
4872 to the Committee on Budget and that motion was defeated on
a 199 to 232 vote.
H.R. 4872 passed the House by a 220 to 211 vote on March
21, 2010, and the bill was received in the Senate on March 23,
2010. The Senate then passed a motion to proceed to
consideration of H.R. 4872 on a 56 to 40 vote. On March 25,
2010, the Senate passed H.R. 4872 as amended on a 56 to 43 vote
and the message on Senate action was sent to the House.
On March 25, 2010, the House passed H. Res. 1225 (House
Report 111-458), a rule that made it in order to take from the
Speaker's table H.R. 4872 as amended by the Senate and consider
a motion by Mr. Miller to concur to the Senate amendments. The
rule provided 10 minutes of debate equally divided by the Chair
and Ranking Member of the Committee on Education and Labor. The
motion that the House agree to the Senate amendments was agreed
to on a 220 to 207 vote. H. R. 4872 was signed by the President
and became Public Law No: 111-152 on March 30, 2010.
BUDGET ENFORCEMENT RESOLUTION FOR FISCAL YEAR 2011
On June 30, 2010, Mr. Spratt introduced H. Res. 1493, a
resolution providing for budget enforcement of allocations for
fiscal year 2011. On July 1, 2010, the Committee on Rules
reported H. Res. 1500 (House Report 111-552) which in part
provided that H. Res. 1493 be adopted and that House rules be
aligned with the Statutory Pay-As-You-Go Act of 2010. H. Res.
1500 passed the House on a 215 to 210 vote.
H. Res. 1493 includes discretionary and mandatory
allocations for fiscal year 2011 and an adjustment to fiscal
year 2010 discretionary allocations to allow for program
integrity initiatives under section 422(a) of S. Con. Res. 13,
the fiscal year 2010 concurrent resolution on the budget. The
resolution also includes provisions to align the rules of the
House of Representatives on Pay-As-You-Go enforcement (clause
10(a) of House rule XXI) with provisions of the Title I of H.
J. Res. 45, the Statutory Pay-As-You-Go Act of 2010 (Public Law
No: 111-139). In addition, H. Res. 1493 includes policy
provisions on deficit reduction.
BUDGET ENFORCEMENT ACTIVITIES
The Committee on the Budget worked with authorizing
committees and the Appropriations Committee to monitor
legislation and evaluate its compliance with House rules, the
fiscal year 2010 budget resolution (S. Con. Res. 13), the
Statutory Pay-As-You-Go Act of 2010 (H. J. Res. 45; Public Law
No: 111-139), and the budget enforcement resolution for fiscal
year 2011 (H. Res. 1493).
Additional Matters Related to Budget Activities
HOUSE RULES
At the beginning of the One Hundred Tenth Congress, the
House of Representatives adopted a resolution that included
several new budget enforcement provisions in addition to
standard House rules on budget enforcement. For the One Hundred
Eleventh Congress, the House continued the enforcement
provisions with certain amendments to the House Pay-As-You-Go
rule under H. Res. 5, a resolution amending provisions of the
standing rules of the House and including separate orders. The
House enforcement measures for the 111th Congress are as
follows:
Clause 7 of House Rule XXI provides that reconciliation
directives included in a budget resolution under the
Congressional Budget Act of 1974 (CBA) shall not increase a
deficit or decrease a surplus.
Clause 8 of House Rule XXI provides that, with respect to
measures considered pursuant to a special order of business,
points of order under the CBA shall operate without regard to
whether the measures concerned have been reported from a
committee.
Clause 10 of House Rule XXI consists of a Pay-As-You-Go
(PAYGO) rule requiring that mandatory spending increases and
revenue decreases be offset over two periods: (1) the current
fiscal year, the budget year set forth in the most recently
completed budget resolution, and the four fiscal years
following that budget year; and (2) the current fiscal year,
the budget year set forth in the most recently completed budget
resolution, and the nine fiscal years following that budget
year. Clause 10 also allows for one House-passed measure to
offset another House-passed measure if both measures are linked
upon engrossment. In addition, Clause 10 allows for emergency
exceptions to PAYGO for provisions designated as emergencies in
legislation. (Note that the House PAYGO rule was further
amended by H. Res. 1493, the resolution providing for budget
enforcement for fiscal year 2011.)
H. Res. 5 included separate orders relating to budget
process under section 3 of the resolution. Section 3 provides
the following: that references to resolutions in section 306 of
the CBA shall apply to only joint resolutions (not simple or
concurrent resolutions); that a point of order under section
303 of the CBA is applicable to text made in order as an
original bill by a special rule, or to the text on which the
previous question is ordered, whichever the case may be; and
that legislation establishing prospectively for a Federal
office or position a specified or minimum compensation to be
funded through annual appropriations shall not be construed to
provide new entitlement authority under the Congressional
Budget Act of 1974. Section 3 also creates a point of order,
with some exceptions, against a motion that the Committee of
the Whole rise to report a bill if the bill exceeds applicable
allocations of new budget authority under section 302(b) of the
Congressional Budget Act of 1974.
STATUTORY PAY-AS-YOU-GO ACT OF 2010
Statutory Pay-As-You-Go was reinstated in February 2010
when President Obama signed into law H. J. Res. 45 which
included the Statutory Pay-As-You-Go Act of 2010 under Title I.
The House of Representatives passed H. J. Res. 45 on February
2, 2010. The previous statutory PAYGO law, which was enacted in
1990 under the Budget Enforcement Act and extended in 1993 and
1997, expired in 2002.
The Statutory Pay-As-You-Go Act of 2010 establishes budget
enforcement tools aimed at preventing increases in the deficit
or decreases in the budget surplus arising from the enactment
of direct spending or tax legislation. Generally the law
requires that the budgetary effects of direct spending or tax
legislation be recorded by the Office of Management and Budget
(OMB) on scorecards covering five- and ten-year periods. If the
final OMB scorecards at the end of a Congress reflect a debit,
the President is required to issue a sequestration order making
across-the-board cuts to non-exempt direct spending programs
sufficient to cover the debit. The Act exempts designated
emergencies and four specified areas of legislation over a
limited time period. There is no expiration date in the Act.
OVERSIGHT ACTIVITIES
Under clause 1(d)(1) of House Rule X, a responsibility of
the Budget Committee is the development of a concurrent budget
resolution that sets spending and revenue levels in aggregate
and across all budget functions. The budget functions encompass
all Federal programs or activities other than those that are
defined as off-budget, such as Social Security and the Postal
Service, and those that are considered non-budgetary, such as
the Federal Reserve. The Committee's formal oversight
responsibility focuses on laws governing the budget process and
the agencies responsible for administering elements of those
laws. Under clauses 1(d)(2) and (3) of House Rule X, the major
laws falling within its oversight are the Budget and Accounting
Act of 1920, the Congressional Budget Act of 1974, and the
Emergency Balanced Budget and Deficit Control Act of 1985. The
two agencies with primary responsibility for administering
elements of these laws, and hence which fall under the
Committee's jurisdiction, are the Office of Management and
Budget and the Congressional Budget Office. In addition to
these general oversight responsibilities, the Budget Committee
has special oversight responsibility under clause 3 of House
Rule X to study the effect of budget outlays of existing and
proposed legislation and to report the results of such studies
to the House on a recurring basis.
The Committee met on January 22, 2009, to organize for the
111th Congress. In addition to adopting its rules of procedure,
the Committee adopted a written oversight plan. The priorities
of the oversight plan included holding hearings and receiving
testimony from Members of Congress, Cabinet-level and other
Federal officials, and expert witnesses to review the
President's budget submissions and other budget priorities;
assessing the performance of Federal agencies in both
administration and service delivery; studying the budgetary
effect of existing law and proposed legislation, as well as
government regulation, on government spending; and reviewing
views and estimates submitted by committees in development of
the concurrent resolution on the budget.
With regard to budget enforcement, the oversight plan
included ongoing oversight of the Office of Management and
Budget's budget activities under the Budget and Accounting Act
of 1920, the Congressional Budget Act of 1974, the Balanced
Budget and Emergency Deficit Control Act of 1985, the Budget
Enforcement Act of 1990, and other applicable laws. The
oversight plan also outlined the necessity of studying
alternatives to improve ways in which Congress and the
President develop and enforce budgetary decisions and the
appropriateness and efficiency of tax incentives and direct
spending by the federal government. In addition, the plan
outlined the Committee's role in working with House committees
to help ensure compliance with budget laws and rules.
The Budget Committee's oversight plan proposed a total of
22 hearings for the 111th Congress. The Committee exceeded this
plan by holding a total of 30 hearings for the 111th Congress
(excluding hearings designated for Members' days).
