 PROVIDING FOR CONSIDERATION OF THE SENATE AMENDMENT TO THE BILL (H.R. 
 5297) TO CREATE THE SMALL BUSINESS LENDING FUND PROGRAM TO DIRECT THE 
   SECRETARY OF THE TREASURY TO MAKE CAPITAL INVESTMENTS IN ELIGIBLE 
INSTITUTIONS IN ORDER TO INCREASE THE AVAILABILITY OF CREDIT FOR SMALL 
 BUSINESSES, TO AMEND THE INTERNAL REVENUE CODE OF 1986 TO PROVIDE TAX 
   INCENTIVES FOR SMALL BUSINESS JOB CREATION, AND FOR OTHER PURPOSES

   Ms. Pingree, from the Committee on Rules, submitted the following

                              R E P O R T

                      [To accompany H. Res. 1640]

    The Committee on Rules, having had under consideration 
House Resolution 1640, by a nonrecord vote, report the same to 
the House with the recommendation that the resolution be 
adopted.

                SUMMARY OF PROVISIONS OF THE RESOLUTION

    The resolution provides for the consideration of the Senate 
amendment to H.R. 5297, the ``Small Business Jobs and Credit 
Act of 2010.'' The resolution makes in order a motion offered 
by the chair of the Committee on Financial Services that the 
House concur in the Senate amendment to H.R. 5297. The 
resolution waives all points of order against consideration of 
the motion. The resolution provides that the Senate amendment 
and the motion shall be considered as read. The resolution 
provides one hour of debate on the motion equally divided and 
controlled by the chair and ranking minority member of the 
Committee on Financial Services, the chair and ranking minority 
member of the Committee on Small Business, and the chair and 
ranking minority member of the Committee on Ways and Means. The 
resolution authorizes the Speaker to entertain motions that the 
House suspend the rules at any time through the legislative day 
of October 1, 2010. The resolution also provides that the 
Speaker or her designee shall consult with the Minority Leader 
or his designee on the designation of any matter for 
consideration under suspension of the rules pursuant to the 
resolution. The resolution waives clause 6(a) of rule XIII 
(requiring a two-thirds vote to consider a rule on the same day 
it is reported from the Rules Committee) against any resolution 
reported from the Rules Committee through the legislative day 
of October 1, 2010.

                         EXPLANATION OF WAIVERS

    The waiver of all points of order against consideration of 
the motion includes a waiver of clause 10 of rule XXI, 
regarding PAYGO and a waiver of clause 6 of rule XXII regarding 
a Senate amendment carrying a tax measure where the House bill 
was reported by a committee other than Ways and Means.
