 PROVIDING FOR CONSIDERATION OF THE BILL (H.R. 3726) TO ESTABLISH THE 
CASTLE NUGENT NATIONAL HISTORIC SITE AT ST. CROIX, UNITED STATES VIRGIN 
  ISLANDS, AND FOR OTHER PURPOSES; AND FOR CONSIDERATION OF THE BILL 
(H.R. 4474) TO AUTHORIZE THE CONTINUED USE OF CERTAIN WATER DIVERSIONS 
LOCATED ON NATIONAL FOREST SYSTEM LAND IN THE FRANK CHURCH-RIVER OF NO 
RETURN WILDERNESS AND THE SELWAY-BITTERROOT WILDERNESS IN THE STATE OF 
                     IDAHO, AND FOR OTHER PURPOSES

                Mr. Polis, from the Committee on Rules, 
                        submitted the following

                              R E P O R T

    The Committee on Rules, having had under consideration 
House Resolution 1038, by a nonrecord vote report the same to 
the House with the recommendation that the resolution be 
adopted.

                SUMMARY OF PROVISIONS OF THE RESOLUTION

    The resolution provides for consideration of H.R. 3726, the 
Castle Nugent National Historic Site Establishment Act, under a 
closed rule. The resolution provides one hour of debate in the 
House equally divided and controlled by the chair and ranking 
minority member of the Committee on Natural Resources. The 
resolution waives all points of order against consideration of 
the bill except clauses 9 or 10 of rule XXI. The resolution 
provides that the committee amendment in the nature of a 
substitute recommended by the Committee on Natural Resources, 
now printed in the bill, shall be considered as adopted and 
that the bill, as amended, shall be considered as read. The 
resolution waives all points of order against provisions of the 
bill, as amended. This waiver does not affect the point of 
order available under clause 9 of rule XXI (regarding earmark 
disclosure). The resolution provides one motion to recommit 
H.R. 3726 with or without instructions.
    The resolution also provides for consideration of H.R. 
4474, the Idaho Wilderness Water Facilities Act, under a closed 
rule. The resolution provides one hour of debate in the House 
equally divided and controlled by the chair and ranking 
minority member of the Committee on Natural Resources. The 
resolution waives all points of order against consideration of 
the bill except clauses 9 or 10 of rule XXI. The resolution 
provides that the bill shall be considered as read. The 
resolution waives all points of order against provisions of the 
bill. This waiver does not affect the point of order available 
under clause 9 of rule XXI (regarding earmark disclosure). The 
resolution provides one motion to recommit H.R. 4474 with or 
without instructions.

                         EXPLANATION OF WAIVERS

    Although the rule waives all points of order against 
consideration of H.R. 3726 (except for those arising under 
clauses 9 and 10 of rule XXI) and against provisions of the 
bill, as amended, the Committee is not aware of any points of 
order. The waivers of all points of order are prophylactic.
