 PROVIDING FOR CONSIDERATION OF THE CONFERENCE REPORT TO ACCOMPANY THE 
 BILL (H.R. 2647) TO AUTHORIZE APPROPRIATIONS FOR FISCAL YEAR 2010 FOR 
    MILITARY ACTIVITIES OF THE DEPARTMENT OF DEFENSE, FOR MILITARY 
 CONSTRUCTION, AND FOR DEFENSE ACTIVITIES OF THE DEPARTMENT OF ENERGY, 
  TO PRESCRIBE MILITARY PERSONNEL STRENGTHS FOR SUCH FISCAL YEAR, TO 
  PROVIDE SPECIAL PAYS AND ALLOWANCES TO CERTAIN MEMBERS OF THE ARMED 
    FORCES, EXPAND CONCURRENT RECEIPT OF MILITARY RETIREMENT AND VA 
   DISABILITY BENEFITS TO DISABLED MILITARY RETIREES, AND FOR OTHER

  Ms. Slaughter, from the Committee on Rules, submitted the following

                              R E P O R T

                       [To accompany H. Res. 808]

    The Committee on Rules, having had under consideration 
House Resolution 808, by a nonrecord vote, report the same to 
the House with the recommendation that the resolution be 
adopted.

                SUMMARY OF PROVISIONS OF THE RESOLUTION

    The resolution provides for consideration of the conference 
report to accompany H.R. 2647, the ``National Defense 
Authorization Act for Fiscal Year 2010.'' The resolution waives 
all points of order against the conference report and against 
its consideration. The resolution provides that the conference 
report shall be considered as read. Finally, the resolution 
provides that the previous question shall be considered as 
ordered without intervening motion except one hour of debate 
and one motion to recommit, if applicable.

                         EXPLANATION OF WAIVERS

    The waiver of all points of order against consideration of 
the conference report includes a waiver of clause 8 of rule 
XXII (requiring a three-day layover of conference reports and 
the accompanying joint explanatory statement). Although the 
conference report contains a table of earmarks as defined in 
clause 9 of rule XXI, there is a technical violation of the 
rule because the disclosure does not contain the required 
preamble.
    Although the rule waives all points of order against the 
conference report, the Committee is not aware of any points of 
order. The waiver of all points of order is prophylactic.
