 PROVIDING FOR CONSIDERATION OF H.R. 5, THE COLLEGE STUDENT RELIEF ACT 
                                OF 2007

   Mrs. Matsui, from the Committee on Rules, submitted the following

                       [To accompany H. Res. 65]

    The Committee on Rules, having had under consideration 
House Resolution 65, by a record vote of 8 to 4, report the 
same to the House with the recommendation that the resolution 
be adopted.

                SUMMARY OF PROVISIONS OF THE RESOLUTION

    The resolution provides for consideration of H.R. 5, the 
College Student Relief Act of 2007 under a closed rule. The 
rule provides three hours of general debate equally divided and 
controlled by the chairman and ranking minority member of the 
Committee on Education and Labor.
    The rule waives all points of order against the bill and 
against its consideration except for clause 9 and 10 of Rule 
XXI. The rule provides one motion to recommit with or without 
instructions. Finally, the rule provides that the Chair may 
postpone further consideration of the bill to a time designated 
by the Speaker.

                         EXPLANATION OF WAIVERS

    The waiver of all points of order against the consideration 
of the bill (except for clause 9 and 10 of Rule XXI) includes a 
waiver of section 302(f) of the Congressional Budget Act 
(prohibiting the consideration of legislation providing new 
budget authority for any fiscal year that would cause the 
applicable allocation of new budget authority made pursuant to 
section 302(a) or (b) to be exceeded). The bill violates 
section 302(f) because its direct spending will exceed the 
Committee on Education and Labor's allocation.

Pell Grant program. This power was given to the U.S. Secretary 
of Education in the Deficit Reduction Act of 2005.

forces, and authorizing the Secretary to waive burdensome 
regulations so that institutions could experiment with cost 
saving processes.
