TRANSPORTATION, TREASURY, HOUSING AND URBAN DEVELOPMENT, THE JUDICIARY, 
THE DISTRICT OF COLUMBIA, AND INDEPENDENT AGENCIES APPROPRIATIONS ACT,

                       [To accompany H. Res. 865]

    The Committee on Rules, having had under consideration 
House Resolution 865, by a nonrecord vote, report the same to 
the House with the recommendation that the resolution be 
adopted.

                SUMMARY OF PROVISIONS OF THE RESOLUTION

    The resolution provides for consideration of H.R. 5576, the 
Departments of Transportation, Treasury, Housing and Urban 
Development, the Judiciary, the District of Columbia, and 
Independent Agencies Appropriations Act, 2007, under an open 
rule. The rule provides one hour of general debate equally 
divided and controlled by the chairman and ranking minority 
member of the Committee on Appropriations. The rule waives all 
points of order against consideration of the bill.
    Under the rules of the House the bill shall be read for 
amendment by paragraph. The rule waives points of order against 
provisions in the bill for failure to comply with clause 2 of 
rule XXI (prohibiting unauthorized appropriations or 
legislative provisions in an appropriations bill), except as 
specified in the resolution. The rule authorizes the Chair to 
accord priority in recognition to Members who have pre-printed 
their amendments in the Congressional Record.
    Finally, the rule provides one motion to recommit with or 
without instructions.

                         EXPLANATION OF WAIVERS

    The waiver of all points of order against consideration of 
the bill includes a waiver of clause 4 of rule XIII 
(availability of reports and printed hearings from the 
Committee on Appropriations). The waiver of all points of order 
against consideration of the bill also includes a waiver of 
section 401(a) of the Congressional Budget Act of 1974 
(prohibiting consideration of legislation, as reported, 
providing new borrowing authority) because the bill provides 
borrowing authority for the Railroad Rehabilitation and 
Improvement Program, which is in violation of section 401(a).
    The waiver of clause 2 of rule XXI (prohibiting 
unauthorized appropriations or legislative provisions in an 
appropriations bill) against provisions in the bill is 
necessary because there are numerous unauthorized 
appropriations and legislative provisions in the bill.
    The exemptions specified in the resolution to the waiver of 
clause 2 of rule XXI (prohibiting unauthorized appropriations 
or legislative provisions in an appropriations bill) against 
provisions in H.R. 5576 are as follows:
          1. beginning with ``to'' on page 5, line 23 through 
        the comma on line 24;
          2. beginning with the colon on page 6, line 22 
        through ``year'' on line 26;
          3. beginning with ``for'' on page 13, line 1 through 
        ``Code'' on line 6;
          4. beginning with the colon on page 13, line 17 
        through ``expended'' on line 25;
          5. section 120;
          6. section 127;
          7. section 129;
          8. section 206;
          9. section 530;
          10. section 707;
          11. section 931.

    Measure: H.R. 5576, the Departments of Transportation, 
Treasury, Housing and Urban Development, the Judiciary, the 
District of Columbia, and Independent Agencies Appropriations 
Act, 2007.
    Motion by: Mrs. Slaughter.
    Summary of motion: To make in order and provide the 
appropriate waivers for the amendment offered by Rep. Olver 
which provides the following increases: $400 million more for 
Amtrak; $40 million more for the Community Development 
Financial Institutions Fund; $144 million more to restore the 
cut in Tenant-based housing vouchers; $261 million more for the 
Public Housing Capital Fund; $636 million more for the Public 
Housing Operating Fund, which is the amount that HUD's own 
budget admits its request leaves ``unfunded''; $100 million for 
the HOPE VI program; $30 million for Rural Housing and Economic 
Development; $65.4 million more for Housing for the Elderly; 
and, $24.4 million more for Housing for Persons with 
Disabilities. It is fully offset by a 4.11 percent reduction to 
the tax cut that was provided to individuals earning more than 
$1 million.
    Results: Defeated 3 to 4.
