The Committee on Rules, having had under consideration
House Resolution 171, by a nonrecord vote, report the same to
the House with the recommendation that the resolution be
adopted.
SUMMARY OF PROVISIONS OF THE RESOLUTION
The resolution provides for the consideration of H.R. 2216,
Making Supplemental Appropriations for the Fiscal Year Ending
September 30, 2001, under an open rule. The rule provides one
hour of general debate equally divided and controlled by the
chairman and ranking minority member of the Committee on
Appropriations.
The rule waives all points of order against consideration
of the bill. The rule provides that the amendment printed in
part A of this report shall be considered as adopted. The rule
also waives clause 2 of rule XXI (prohibiting unauthorized
appropriations or legislative provisions in a general
appropriations bill) against provisions in the bill, as
amended. The bill will be considered for amendment by
paragraph.
The rule makes in order the amendment printed in part B of
this report, which may be offered only by a Member designated
in the report and only at the appropriate point in the reading
of the bill, shall be considered as read, shall not be subject
to amendment, and shall not be subject to a demand for division
of the question in the House or in the Committee of the Whole.
The rule waives all points of order against the amendment
printed in part B of this report.
The rule waives points of order during consideration of the
bill against amendments for failure to comply with clause 2(e)
of rule XXI (prohibiting non-emergency designated amendments to
be offered to an appropriations bill containing an emergency
designation).
Members who have pre-printed their amendments in the
Congressional Record prior to their consideration will be given
priority in recognition to offer their amendments if otherwise
consistent with House rules. Finally, the rule provides for one
motion to recommit, with or without instructions.

AMENDMENTS MADE IN ORDER UNDER THE RULE
Part A--Summary of amendment to be considered as adopted
Young (FL)--Deletes the Employment and Training
Administration Training and Employment Services rescission.
Part B--Summary of amendment made in order
Toomey/Flake/Tancredo--Deletes the $389 million rescission
in FEMA Disaster Relief Funds. Enacts an across-the-board cut
in Fiscal Year 2001 non-defense discretionary spending of
0.33%. The across-the-board reduction achieves savings of
approximately $1 billion, sufficient to offset the non-defense,
non-Veterans portions of the supplemental not currently offset
and to replace the savings achieved through the FEMA
rescission. The rescission is based on the same language used
to implement the 0.38% across-the-board cut in Fiscal Year
2000.
PART A--TEXT OF AMENDMENT CONSIDERED AS ADOPTED
Under Title II, Chapter 5, delete the heading ``Department
of Labor, Employment and Training Administration, Training and
Employment Services, (Rescission)'' and the paragraph that
follows.
PART B--TEXT OF AMENDMENT MADE IN ORDER
An Amendment To Be Offered by Representative Toomey of Pennsylvania, or
Representative Flake of Arizona, or a Designee
In chapter 9 of title II, strike the item relating to
``Federal Emergency Management Agency''.
At the end of the bill, insert after the last section
(preceding the short title) the following:
Sec. ____. (a) Government-Wide Rescission.--(1) There is
hereby rescinded an amount equal to 0.33 percent of the new
discretionary budget authority provided (or obligation limit
imposed) for fiscal year 2001 in this or any other Act for each
department, agency, instrumentality, or entity of the
Government.
(2) Paragraph (1) shall not apply to budget accounts included
under major functional category 050 (national defense).
(b) Restrictions.--In carrying out the rescissions made by
subsection (a)(1), no program, project, or activity of any
department, agency, instrumentality, or entity may be reduced
by more than 15 percent (with ``programs projects, and
activities'' as delineated in the appropriation Act or
accompanying report for the relevant account, or for accounts
and items not included in appropriation Acts, as delineated in
the President's most recently submitted budget).
(c) Report.--The Director of the Office of Management and
Budget shall include in the President's budget submission for
fiscal year 2003 a report specifying the reductions made to
each account pursuant to this section.
