  SA 5228. Ms. BALDWIN submitted an amendment intended to be proposed 
by her to the concurrent resolution S. Con. Res. 33, setting forth the 
congressional budget for the United States Government for fiscal year 
2026 and setting forth the appropriate budgetary levels for fiscal 
years 2027 through 2035; which was ordered to lie on the table; as 
follows:

       At the appropriate place in title IV, add the following:

     SEC. 4___. POINT OF ORDER AGAINST ALLOWING AGENTS OR OFFICERS 
                   OF U.S. IMMIGRATION AND CUSTOMS ENFORCEMENT OR 
                   U.S. CUSTOMS AND BORDER PROTECTION WHO ARE ON 
                   DUTY OR IN UNIFORM, DURING ANY VOTING PERIOD, 
                   TO ENTER ANY LOCATION WITHIN \1/4\ MILE OF AN 
                   ACTIVE POLLING PLACE, TO SET UP A CHECKPOINT 
                   ALONG ANY ROUTE TO AN ACTIVE POLLING PLACE, OR 
                   TO INTERFERE IN ANY WAY WITH THE ABILITY OF ANY 
                   ELIGIBLE VOTER TO ACCESS HIS OR HER ASSIGNED 
                   POLLING PLACE.

       (a) Point of Order.--It shall not be in order in the Senate 
     to consider any bill, joint resolution, motion, amendment, 
     amendment between the Houses, or conference report that would 
     allow for agents or officers of U.S. Immigration and Customs 
     Enforcement or U.S. Customs and Border Protection who are on 
     duty or in uniform, during any voting period--
       (1) to enter any location within \1/4\ mile of an active 
     polling place;
       (2) to set up a checkpoint along any route to an active 
     polling place; or
       (3) to interfere in any way with the ability of any 
     eligible voter to access his or her assigned polling place.
       (b) Waiver and Appeal.--Subsection (a) may be waived or 
     suspended in the Senate only by an affirmative vote of three-
     fifths of the Members, duly chosen and sworn. An affirmative 
     vote of three-fifths of the Members of the Senate, duly 
     chosen and sworn, shall be required to sustain an appeal of 
     the ruling of the Chair on a point of order raised under 
     subsection (a).
