SA 4086. Ms. BLUNT ROCHESTER submitted an amendment intended to be
proposed to amendment SA 3951 submitted by Ms. Collins and intended to
be proposed to the bill H.R. 4016, making appropriations for the
Department of Defense for the fiscal year ending September 30, 2026,
and for other purposes; which was ordered to lie on the table; as
follows:
At the appropriate place in division D, insert the
following:
Sec. __. (a) Notwithstanding section 430 of the General
Education Provisions Act (20 U.S.C. 1231), section 415 or
section 419 of the Department of Education Organization Act
(20 U.S.C. 3475, 3479), section 1501 or 1535 of title 31,
United States Code, or any other provision of law, none of
the funds appropriated in this Act or any other
appropriations Act may be used to transfer or delegate
significant responsibilities, including administering
programs, making grant awards, carrying out technical
assistance, enforcing rights and requirements (including data
collection and sharing requirements), and monitoring
grantees, related to implementation of programs under the
Individuals with Disabilities Education Act (20 U.S.C. 1400
et seq.), the Rehabilitation Act of 1973 (29 U.S.C. 701 et
seq.), the Education of the Deaf Act of 1986 (20 U.S.C. 4301
et seq.), the Helen Keller National Center Act (29 U.S.C.
1901 et seq.), the Act entitled ``An Act to promote the
education of the blind'', approved March 3, 1879 (20 U.S.C.
101 et seq.), and the Act entitled ``An Act to authorize the
operation of stands in Federal buildings by blind persons, to
enlarge the economic opportunities of the blind, and for
other purposes'', approved June 20, 1936 (commonly known as
the ``Randolph-Sheppard Act'') (20 U.S.C. 107 et seq.) that
are administered by the Department of Education as of the
date of enactment of this Act, from the Department of
Education to another department or agency.
(b) Notwithstanding the second proviso of section 314, the
Department of Education shall support staffing levels at the
Department of Education necessary to fulfill its statutory
responsibilities including carrying out programs, projects,
and activities funded under this Act in a timely and
effective manner.
