  SA 4050. Mr. SCHIFF submitted an amendment intended to be proposed to 
amendment SA 3951 submitted by Ms. Collins and intended to be proposed 
to the bill H.R. 4016, making appropriations for the Department of 
Defense for the fiscal year ending September 30, 2026, and for other 
purposes; which was ordered to lie on the table; as follows:

        In the matter under the heading ``program management'' 
     under the heading ``Centers for Medicare & Medicaid 
     Services'' under title II of division D, strike the period at 
     the end and insert ``: Provided further, That the 
     Administrator of the Centers for Medicare & Medicaid Services 
     shall not terminate a critical access hospital provider 
     agreement with any hospital that was designated and certified 
     as a critical access hospital as of January 1, 2024, and 
     receives notice from the Centers for Medicare and Medicaid 
     Services during the period beginning on December 1, 2024, and 
     ending on January 1, 2027, that the facility was found to be 
     noncompliant with the distance requirements under section 
     1820(c)(2)(B)(i)(I) of the Social Security Act (42 U.S.C. 
     1395i-4(c)(2)(B)(i)(I)): Provided further, That the 
     Administrator shall use available funds in the Centers for 
     Medicare & Medicaid Services Program Management Account to 
     pay for the additional expenditures by reason of the 
     preceding proviso, as determined by the Administrator.''.
