  SA 3993. Mr. PADILLA submitted an amendment intended to be proposed 
to amendment SA 3951 submitted by Ms. Collins and intended to be 
proposed to the bill H.R. 4016, making appropriations for the 
Department of Defense for the fiscal year ending September 30, 2026, 
and for other purposes; which was ordered to lie on the table; as 
follows:

        At the appropriate place, insert the following:

     SEC. __. LIMITATION ON USE OF THE NATIONAL GUARD FOR THE 
                   FEDERAL PROTECTIVE MISSION IN CALIFORNIA.

       (a) In General.--Except as provided in subsection (b), the 
     President may not use the authority under section 12406 of 
     title 10, United States Code, or any other provision of law 
     to call into Federal service members of the National Guard of 
     a State for any Federal protective mission announced in the 
     June 7, 2025, Presidential memorandum entitled ``Department 
     of Defense Security for the Protection of Department of 
     Homeland Security Functions''.
       (b) Exception.--The limitation under subsection (a) shall 
     not apply with respect to the calling into Federal service of 
     members of the National Guard of a State for a mission 
     conducted entirely within that State.
