  SA 3809. Mr. MARKEY submitted an amendment intended to be proposed by 
him to the bill S. 2296, to authorize appropriations for fiscal year 
2026 for military activities of the Department of Defense, for military 
construction, and for defense activities of the Department of Energy, 
to prescribe military personnel strengths for such fiscal year, and for 
other purposes; which was ordered to lie on the table; as follows:

       At the appropriate place in title XV, insert the following:

     SEC. 15__. LIMITATION ON AVAILABILITY OF FUNDS FOR DESIGN AND 
                   DEVELOPMENT OF SPACE-BASED INTERCEPTOR 
                   CAPABILITY.

       (a) Limitation.--None the funds authorized to be 
     appropriated by this Act or otherwise made available for 
     fiscal year 2026 for the development and deployment of a 
     next-generation air and missile defense architecture (known 
     as ``Golden Dome'') may be obligated or expended to design or 
     develop a space-based interceptor capability until the 
     Secretary of Defense submits to the congressional defense 
     committees the following:
       (1) A complete architecture plan and lifecycle system costs 
     for the constellation of satellites required for the space-
     based interceptor capability.
       (2) A certification by the President that the deployment of 
     space-based interceptor capability would not have a negative 
     impact on strategic stability with Russia and China.
       (3) A written commitment that the Director of Operational 
     Test and Evaluation will be provided with the resources 
     necessary to provide effective oversight of the space-based 
     interceptor testing program and that space-based interceptors 
     will undergo realistic operational testing before deployment.
       (4) An independent technical review by the National Academy 
     of Sciences on the military and cost effectiveness of space-
     based interceptors to counter intercontinental ballistic 
     missiles.
       (b) Form.--Any submission to the congressional defense 
     committees described in subsection (a) shall be submitted in 
     unclassified form, but may include a classified annex.
