SA 3769. Mr. DAINES submitted an amendment intended to be proposed by
him to the bill S. 2296, to authorize appropriations for fiscal year
2026 for military activities of the Department of Defense, for military
construction, and for defense activities of the Department of Energy,
to prescribe military personnel strengths for such fiscal year, and for
other purposes; which was ordered to lie on the table; as follows:
At the appropriate place, insert the following:
SEC. __. PROHIBITIONS RELATING TO LEAKS OF CLASSIFIED
INFORMATION BY GOVERNMENT OFFICIALS FOR
PERSONAL OR POLITICAL GAIN.
(a) In General.--Notwithstanding any other provision of
law, a government official who has leaked classified
information for personal or political gain may not access or
receive classified information.
(b) Service on Congressional Committees.--A Member of
Congress who has leaked classified information for personal
or political gain may not serve on any of the following:
(1) The Committee on Armed Services of the Senate.
(2) The Committee on Foreign Relations of the Senate.
(3) The Committee on Homeland Security and Governmental
Affairs of the Senate.
(4) The Select Committee on Intelligence of the Senate.
(5) The Subcommittee on Defense of the Committee on
Appropriations of the Senate.
(6) The Committee on Armed Services of the House of
Representatives.
(7) The Committee on Foreign Affairs of the House of
Representatives.
(8) The Committee on Homeland Security of the House of
Representatives.
(9) The Permanent Select Committee on Intelligence of the
House of Representatives.
(10) The Subcommittee on Defense of the Committee on
Appropriations of the House of Representatives.
(c) Definitions.--In this section:
(1) Government official.--The term ``government official''
means, with respect to a leak of classified information
described in subsection (a), an individual who, at the time
of such leak, holds any of the following offices or
positions:
(A) An elective public office in the executive or
legislative branch of the Government of the United States.
(B) An office in the executive or judicial branch of the
Government of the United States, appointment to which was
made by the President.
(C) A position in the executive, legislative, or judicial
branch of the Government of the United States--
(i) that is listed in schedule C of rule VI of the Civil
Service Rules; or
(ii) the compensation for which is equal to or greater than
the lowest rate of basic pay for the Senior Executive Service
under section 5382 of title 5, United States Code.
(D) A position under the House of Representatives or the
Senate of the United States held by an individual receiving
gross compensation at an annual rate of $15,000 or more.
(E) An elective or appointive public office in the
executive, legislative, or judicial branch of the government
of a State, possession of the United States, or political
subdivision or other area of any of the foregoing, or of the
District of Columbia, held by an individual receiving gross
compensation at an annual rate of $20,000 or more.
(F) A position as personal or executive assistant or
secretary to any of the foregoing.
(2) Member of congress.--The term ``Member of Congress''
means a Member of the Senate or the House of Representatives,
a Delegate to the House of Representatives, or the Resident
Commissioner from Puerto Rico.
