  SA 3756. Mr. KAINE submitted an amendment intended to be proposed by 
him to the bill S. 2296, to authorize appropriations for fiscal year 
2026 for military activities of the Department of Defense, for military 
construction, and for defense activities of the Department of Energy, 
to prescribe military personnel strengths for such fiscal year, and for 
other purposes; which was ordered to lie on the table; as follows:

       At the end of subtitle E of title XII, add the following:

     SEC. 1265. PROHIBITION AGAINST THE DEPLOYMENT OF UNITED 
                   STATES ARMED FORCES IN GAZA AND THE WEST BANK.

       (a) Sense of Congress.--It is the sense of Congress that--
       (1) as the United States and Israel have mutually benefited 
     from the decades of friendship and strategic security 
     partnership between our two countries, it is in the interest 
     of the United States to support and facilitate Israel's 
     ability to defend itself from terrorism and from threats 
     posed by the Islamic Republic of Iran and its proxies;
       (2) it is not in the interest of the United States to 
     engage in a new and extended military deployment to the 
     Middle East, to expend taxpayer dollars to support United 
     States military operations in Gaza or the West Bank, or to 
     support any other military actions that would worsen the 
     suffering or facilitate the forcible displacement of the 
     2,000,000 civilians residing in Gaza;
       (3) the United States should not deploy United States Armed 
     Forces to Gaza or the West Bank, risk United States lives in 
     Gaza or the West Bank, or otherwise use United States funds 
     to conduct military operations in Gaza or the West Bank; and
       (4) there is no congressional authorization, as required by 
     law, for the use of United States military force in Gaza or 
     the West Bank.
       (b) In General.--The United States Armed Forces shall not 
     deploy personnel, engage in hostilities, or conduct any 
     operations (other than intelligence, surveillance, and 
     reconnaissance operations) within the boundaries of the Gaza 
     Strip or the West Bank.
       (c) Rule of Construction.--Nothing in this section may be 
     construed to prevent the United States from--
       (1) defending against an attack on the United States or its 
     personnel or facilities located outside the United States; or
       (2) collecting, analyzing, or sharing intelligence, 
     including with the Government of Israel and other nations or 
     international organizations, as appropriate, related to

     threats from Hamas or the Islamic Republic of Iran or its 
     proxies.
