SA 3437. Mr. SHEEHY submitted an amendment intended to be proposed by
him to the bill S. 2296, to authorize appropriations for fiscal year
2026 for military activities of the Department of Defense, for military
construction, and for defense activities of the Department of Energy,
to prescribe military personnel strengths for such fiscal year, and for
other purposes; which was ordered to lie on the table; as follows:
At the appropriate place, insert the following:
SEC. _____. JUSTICE FOR UNITED STATES VICTIMS OF STATE
SPONSORED TERRORISM.
Section 404(d)(4)(D)(iv)(IV) of the Justice for United
States Victims of State Sponsored Terrorism Act (34 U.S.C.
20144(d)(4)(D)(iv)(IV)) is amended by striking item (bb) and
inserting the following:
``(bb) Remaining amounts.--
``(AA) In general.--Not later than 30 days after the date
of enactment of the National Defense Authorization Act for
Fiscal Year 2026, the Special Master shall authorize payment
to any victim described in clause (i) equal to the amount
that the authorized lump sum catch-up payment was offset by
amounts received in Peterson v. Islamic Republic of Iran, No.
10 Civ. 4518 (S.D.N.Y.).
``(BB) Remaining amounts.--All amounts remaining in the
lump sum catch-up payment reserve fund, including any accrued
interest, in excess of the amounts described in subitem (AA)
and subclauses (I) and (II) of clause (iii), shall be
deposited into the Fund under this section. If the Special
Master transferred the balance of the lump sum catch-up
payment reserve fund before the date of enactment of the
National Defense Authorization Act for Fiscal Year 2026, the
payments required under subitem (AA) shall be made from the
Fund.''.
