SA 3327. Mr. KAINE submitted an amendment intended to be proposed by
him to the bill S. 2296, to authorize appropriations for fiscal year
2026 for military activities of the Department of Defense, for military
construction, and for defense activities of the Department of Energy,
to prescribe military personnel strengths for such fiscal year, and for
other purposes; which was ordered to lie on the table; as follows:
At the appropriate place in title X, insert the following:
SEC. ___. ADS-B IN RETROFITTING STRATEGIC PLAN.
(a) In General.--Not later than 1 year after the date of
enactment of this section, the Administrator, in consultation
with the Secretary of Defense, shall develop and issue a
strategic plan on covered operators retrofitting aircraft
with safety-enhancing Automatic Dependent Surveillance-
Broadcast In (``ADS-B In'') equipment.
(b) Requirements.--In developing the strategic plan
required under subsection (a), the Administrator shall do the
following:
(1) Outline a process by which covered operators can
install ADS-B In equipment on their aircraft to enhance
safety.
(2) Consult with covered operators, original equipment
manufacturers, labor organizations, aviation safety experts,
industry trade associations, and any other stakeholder
determined appropriate by the Administrator, in consultation
with the Secretary of Defense.
(3) Provide a list of any special considerations relating
to covered operators retrofitting aircraft with ADS-B In in
the strategic plan, including any considerations relating to
aircraft of covered operators operating in support of
national security missions on behalf of the United States.
(4) Provide a description of the necessary equipment,
requirements, and estimated cost associated with completing
the retrofitting described in the strategic plan within--
(A) a 4-year period following the issuance of such
strategic plan; and
(B) an 8-year period following the issuance of such
strategic plan.
(c) Definitions.--In this section:
(1) Administrator.--The term ``Administrator'' means the
Administrator of the Federal Aviation Administration.
(2) Covered operator.--The term ``covered operator''
means--
(A) an air carrier operating under part 121 of title 14,
Code of Federal Regulations;
(B) an air carrier providing service under part 135 of such
title 14, pursuant to a schedule or in conjunction with part
380 of such title;
(C) a general aviation operator described in part 91 of
such title 14;
(D) a military operator operating in the national airspace
system; and
(E) the owner or operator of a public aircraft (as such
term is defined in section 40102(a) of title 49, United
States Code).
