SA 3280. Mr. CRUZ (for himself and Mrs. Britt) submitted an amendment
intended to be proposed by him to the bill S. 2296, to authorize
appropriations for fiscal year 2026 for military activities of the
Department of Defense, for military construction, and for defense
activities of the Department of Energy, to prescribe military personnel
strengths for such fiscal year, and for other purposes; which was
ordered to lie on the table; as follows:
At the end of subtitle F of title X, add the following:
SEC. 1067. UNAUTHORIZED ACCESS TO DEPARTMENT OF DEFENSE
FACILITIES.
(a) In General.--Chapter 67 of title 18, United States
Code, is amended by adding at the end the following:
``Sec. 1390. Unauthorized access to Department of Defense
facilities
``(a) In General.--It shall be unlawful, within the
jurisdiction of the United States, without authorization to
go upon any property that--
``(1) is under the jurisdiction of the Department of
Defense; and
``(2) has been clearly marked as closed or restricted.
``(b) Penalties.--Any person who violates subsection (a)
shall--
``(1) in the case of the first offense, be fined under this
title, imprisoned not more than 180 days, or both;
``(2) in the case of the second offense, be fined under
this title, imprisoned not more than 3 years, or both; and
``(3) in the case of the third or subsequent offense, be
fined under this title, imprisoned not more than 10 years, or
both.''.
(b) Table of Sections Amendment.--The table of sections for
chapter 67 of title 18, United States Code, is amended by
adding at the end the following:
``1390. Unauthorized access to Department of Defense facilities.''.
